RESOLUTION NO. 9059
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CUPERTINO RESCINDING SCHEDULE C OF RESOLUTION 9031
AND ESTABLISHING USER FEES FOR PLANNING SERVICES
WHEREAS, the State of California requires fees charged for service rendered not
to exceed the cost of delivering said services; and
WHEREAS, a public hearing has been held to review user fees; and
WHEREAS, the City Council of the City of Cupertino has established guidelines
for setting user fees;
NOW, THEREFORE, BE IT RESOLVED that:
I. User fees are established per attached Schedule C,
2. All user fees for Planning Services previously established by Council
action or resolution are hereby superseded.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this ~tday of March ,1994, by the following vote:

DEFINITION OF PLANNING FEE SERVICES
Full Application
An application which typically involves all steps of the development review process
incl~g. Pre-applicati~n Revi~. Enviro~en~ ~ew Commit!CC. the. Planning
CommissIon, and the City Council. The applic:aüon reqwres an advertised public hearing
before the Planning Commission and a public hearing or agendized review before the City
Council.
Applications requiring the preparation of an Environmental Impact Repon (EIR) are included
in this category. The application fee for partic:ularly complicated applications and those
requiring the preparation of an EIR will be based upon an hourly rate as described in the fee
schedule.
I.imited Application
An application which involves all steps of the development review process outlined in the
Full Application description with the exception of the City Council.
Minnr Application
An applic:ation which involves minim.1 steps in the review process and is exempt from the
California Environmental Act. The staff evaluation and report preparations are less
extensive, The application requires Planning commission review.

Miscellan~1L" Application
An application which typically involves a non noticed review by the Planning Commission.
The application does not typically require pre applic:atioD ~ or Environmental Review
and involves minimal staff pi~JI'IIlItion. Examples of this applic:ation are interpretation or
clarification of conditions of approval or ordln........ requirements. sign exceptions, fence
exceptions, and tentative !DIp and use permit extensions. '.
Appeal
A request from the project appücant or interested ~ to reverse or amend a decision made
hy staff or an advisOry bodý. An appointed public official serving on the board that made
the decision subject to the appeal, an appointed public official serving on a board that is
directly affected by the decision and the City Council members are exempted from the fee
requirement

An application which receives final approval by staff either via an advertised public hearing
or non hearing format. The application may involve a pre application meeting
and/or Environmental Review Committee review.
Tempnrarv Si~ Pl!n'n1t
A staff review of a temporary sign application which includes an evaluation of the sign
request, the entry into the temporary log and site review by Code Enforcement Officers.
The pennit fee is in addition to the submittal of a deposit to guarantee removal of the sign
upon expiration of the temporary permit.
NOTES:
Combined applications which are procased simultaneously (i.e., filed at the same time)
will be classified based on highest rating.
Mixed use applications will be classified based upon the highest intensity and review
process.
The Director of Community Development will have discretion to classify projects based
upon the above criteria.
