V A. REPORT OF THE PLANNING COMMISSION (See Minutes of May 24)
Mayor Dempster asked C'.ai rman Gates if he had any speci-
fic comments to make, in addition to the Minutes. Chair-
man Gates said he did not, but would answer any questions.
1. P. F. &. V, I. Forderer- Application for Variance
to permit erection of 6' fence 3' from sidewalk on
V%A NI side street of a corner lot - 21968 Oakdell Place.

Mayor Dempster asked Chairman Gates how the Planning
Commission had arrived at this decision, Chairman Gates
said the Planning Commission found nothing in the appli-
cation which warranted granting of this variance.
Mr. P. F. Forderer, 21968 Galdell Place, Cupertino,
said he feels he is being deprived of the use of 16%
of his property and this, to him, is a hardship. He
felt that nothing detrimental was found in the hearing
of this application. He said the City Planner found
no reason why this would not be acceptable.
Councilman Noel asked Mr. Forderer the size of his lot.
He answered that it is 75' x 150' and he is being
placed in the position of not being able to use
1300 sq. ft. of it.
Mayor Dempster asked the applicant why, specifically,
wants his fence moved out to within 3 feet of the side
streets i.e., how would he attain better utilization
of the yard. Mr. Forderer feels he will get no bene-
ficial use of the area unless it is fenced. He wants
to use it for a vegetable garden or a storage area.
Councilman Noel asl.ed about the P. G. & E. easement
along this property.. He also quoted from the May 24th
Planning Commission Minutes regarding future extension
of Oakleaf Road and the fact that the proposed fence
would block the view to the intersection of Oakdell
Place and Oakleaf Road.
The Director of Planning was asked for his comments.
He said the adjacent land is now undeveloped. At such
future time as it is subdivided, the fence should be
returned to the set -back line.
The Chief Building Inspector was asked to draw a dia-
gram of the situation on the blackboard, for the benefit
of the Council and the audience.
Mayor Dempster asked the City Attorney who is respon-
sible to keep the P. G. & E. easement. The City
Attorney said he has never heard of a fence being built
on an easement. If abandonment proceedings on the
easement take place, the fence might be permitted.

The Dir. of Public 1,1orl:s said this case is almost ident-
icle to the recent application 9-V-65 by Per. & Mrs. Elms
to move a fence into the set -back to accommodate a swim-
ming pool. The pool was to stay within th;c set -back line
but the fence was extended 3' to provide adequate decking.

Mr. Gordon Dodge, Riviera Drive, Cupertino, said he is
in the swimming pool business and they do this sort of
thing all the time. He said ycu can .put anything that
is not permanent on an easement. He did. not consider
a fence permanent.
Councilman Fitzgerald said he was inclined'.to agree with
the Planning Commission in this case. There has already
been a reduction of the set -back here, This could create
a traffic hazard -- a blind corner.

B. REPORT OF THT11 ARCHITECTURAL.AND SITE APPROVAL

Vice -Chairman Guy Fitch said he had nothing to add to
the Minutes.as recorded.
The Chief Building Inspector said the H-.Control wanted
to bring to the attention of the City Council, Condition
rll, on application 184-HC-65, as recorded on Page 2
of the May 25th Minutes.
The City Manager said the Church has always cooperated
with the City and, if the Council so desires, he will
check this out and report back at the next meeting,

Councilman Finch ti-as concerned that no mention was made
about the easement between the Shell Service Station at
Stevens Creek Blvd and B,aney Avenue and the property
being reviewed under application 186-HC-65.

that the matter of the above -mentioned easement be
brought to the attention of the City Manager and request
of a report from him at the next meeting on this.

Mr. Bernard Ponseggi, 22J50 Cupertino Road, Monta Vista,
was interested in application 185-HC-65; the 22-unit
apartment building to be.located.on Lands of Cook and
Wilson. He asked if the plans are exactly the same as
those approved.over a year ago.. He was.told they are.
Mr. Ponseggi said.the property is up for sale., includ-
ing the plans. Since the integrity of the builder had
a lot to do with the original -approval of this appli-
.:cation, he'wondered sf the fact that t is property may
change ow.h6rship would affect the deci on made on it.

Mr. Paul Ruberidale, General Contractor, 487 James Road,
Apt. 101, Palo Alto, said that, due to the difficulty of
financing last year, Messrs. Cook and Wilson considered
selling it. He said that -present. plans are that he will
build it, accordinc to the plans; for them.
Councilman Finch said he, personal17/7,-never looks at a
set of plans to see caho the builders is. It is up to
the Building Department to see to it that it is built
accordin-, to pla.Is and specifications.
Councilman 1•1oel said that, in addition to the Ten Standard
H-Control Conditions, there are four more, and he is
not concerned that this development will not be of the
same quality as previous Cooly & Wilson buildings.
Councilman Fitzgerald said that Condition 'i=13 specifies
that landscaping; plans are to be submitted to the
H-Control prior to final completion of the buildings.

that the H-Control applications reviewed in the Minutes
of the H-Control on May 25, 1965, with the exclusion of
application 186-HC-65, be approved.

The City Clerk announced that he had just that day received
a letter from the applicant requesting a postponement.
Mayor Dempster asked if anybody in the audience had come
specifically in regard to this application. There was only
one person, who said it would not inconvenience him to
return to the next Council Meeting.

to postpone until the next regular Council meeting, the

E. Resolutions No. �71(b): Amending the Holiday Schedule
The City Manager said our present Resolution specifies that
holidays falling on the weekend will be observed the follow-
ing Monday. All cities in California observe these holidays
that fall on the weekend on the previous Friday. It seems
fitting that Cupertino would do the same.

Saratoga -Sunnyvale Road, to be established as a County
Highway.

Sunnyvale City Council meetings regarding Mary

2. Extension of Rodrigues and Signalization Thereof:
The Sheriff's evaluation concurrs with the Highway
Department's report, However, the State will
review their
report when Rodrigues Avenue has been
completed, east of'Saratoga-Sunnyvale Road.
Councilman Fitzgerald asked about the possibility of
stacking lanes at this intersecton'now. The City
Manager said this, too, would. be investigated upon
completion of Rodrigues Avenue, east of Saratoga -
Sunnyvale Road.
C. REPORT OF DIRECTOR OF PUBLIC WORKS
The Director said that.Item.s 1,. 3, 4, 5 and 6 of his
report are progress reports.
Item 2, Wolfe Road Project. The Director has been
assured that this project will be completed within 2
weeks, Barricades are in poor condition and traffic
has gone on the approaches, This condition will have
to be remedied before surfacing can be done,

1. In addition to the Minutes, the Recreation Director
said that the following night, the Recreation and
Parks Commission will have a representative from a
third consultant to make a presentation. He in-
vited the.City Council and th:e,public to this
meeting, to be held at the Youth Center at 8 P.M.
2. The Recreation Department is ready:to start its
summer. program 'June 28th to August 27th.
There are 23 different facilities this year.
3. The Cupertino TwiIrlers, who are trained by, but not
sponsored by, the Cupertino Recreation Department,
won an award in the last Memorial Day festivities.
4. The Parks and Recreation Commission will make their
recommendations on priority and choice of landscape
architects at the next Council meeting.

CC: wo, and Cupertino are involved in this. About six weeks ago

the County Board of Supervisors voted to abandon this
project. The above -named cities are trying to generate
interest"in reviving it either as a strip or complete
chair., Councilman Noel tiiould like some indication from
the Council whether we should participate in this.

Cupertino's representative on this project. Councilman
Finch said he does not feel this must be an uninter-
rupted park chain,
