RESOLUTION NO. 3506
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
AUTHORIZING EXECUTION OF AN AGREEMENT'BETWEEN THE MAYOR
AND THE CITY CLERK TO RETAIN THE SERVICES OF A FINANCIAL
CONSULTANT; AND RATIFYING THE RETENTION OF BOND COUNSEL
WHEREAS, it is deemed necessary and in the best interest of the City to
employ the services of a financial consultant preparatory to submitting a pro-
posed $ 2,700,000 bond issue question to the electorate in the General Election
in October, 1973; and
WHEREAS, there has been presented to the City Council an agreement by and
between the City of Cupertino and STONE & YOUNGBERG for that said firm to act
as the financial consultant, pursuant to the terms and conditions contained in
that agreement dated July 13, 1973 ; and
WHEREAS, the services of ORRICK, HERRINGTON, R014LEY & SUTCLIFFE have been
secured as bond counsel in connection with the said proposed bond issue as
authorized by Minute Order of the City Council to the City Manager; and
WHEREAS, it is deemed desirable to ratify the retention of said bond coun-
sel through a formal resolution;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cupertino
as follows:
Section 1. The Mayor and the City Clerk are hereby authorized to execute
the agreement tiTith STONE & YOUNGBERG herein referred to in behalf of the
City of Cupertino.
Section 2. The retention of the firm of ORRICK, HERRINGTON, ROWLEY &
SUTCLIFFE as bond counsel for the herein referred to proposed bond issue
is hereby ratified.
Section 3. The City Clerk is hereby instructed to prepare certified
copies of this resolution to the aforementioned firms.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this 16th day of July ,1973, by the following vote:
AYES: Councilmen - Frolich, Jackson, Meyers, Sparks, Irwin
NOES: Councilmen - None
ABSENT: Councilmen - None
