V ORAL AND WRITTEN COMMUNICATIONS Mayor Finch asked the audience if there were any oral communi- cations dealing with other than items on the agenda. There were none. WRITTEN: 1. Letter from Mrs. Ann Anger protesting the H-Control decision on the Rintala application. 2. Letter from Cmdr. Martin Kuhn inviting Mayor Finch to participate in the official ground -breaking ceremony at the U. S. Naval and Marine Corps Research Training Center in Alameda. 3. Letter from Mr. William Haack regarding fluoridation. 4. League of California Cities Bulletin. 5. League of California Cities bi-monthly meeting of March 25th at Sakura Gardens, Mountain View. REPORT OF THE PLANNING COMMISSION Chairman Gates said he had no special report, but would answer any questions the Council might have. B. REPORT OF THE ARCHITECTURAL AND SITE APPROVAL COMMITTEE (See Minutes of Feb. 16 & 23, 1965) Chairman Small commented on the Rintala application, saying that the man already has the industrial zoning and now he wants to upgrade his business. ITSUO UENAKA-SPRINIG3DALE NURSERY: Appeal re: Application 1-V-65 for variance to allow a sign. 35' high.; Springdale Nursery, Saratoga -Sunnyvale Road. Denied by Planning Commission Resolution 244, Feb. 8, 1965. Council Resolution No. 1070, Mr. Uenaka, 19449 Via Madrona Court, Saratoga, and Mr. Melvin Peterson, of Ad Art, presented the rendering of the proposed sign, along with a sample of their letterhead stationery and pictures of their signs in Campbell and San Jose. Councilman Noel asked Planning Commission Chairman Gates about the reasoning behind the negative motion for this application. Chairman Gates said that at first, there was a motion to approve, but that it was a tied vote, 2-2. The following week, those 2 who had voted for this application reversed their decisions and the vote on the motion to deny was 6-0. It was felt that if this variance were granted there would be a flood of variance applications for signs. Mr. Peterson said the sign in Campbell is 60' high. Furthermore, all the Springdale advertising, letterhead, etc., utilize this design in order to create an image. Councilman Fitzgerald said he had to agree with the Planning Commission's reasoning. He felt that maybe the Sign Ordinance needs to be changed. Mayor Finch cited sign variances already approved in Cupertino: Mayfair, Boulevard Center, Portal Plaza, and Gemco. Councilman Fitzgerald said each of those variances were granted because of a hardship presented by the applicant. There is no hardship here -- they want to create an image. He would.rather see the Sign Ordinance changed than to grant this variance. Mayor Finch feels any small businessman needs just as much help as any large business in Cupertino. There was some discussion of rearranging of the sign, but, as Mr. Peterson pointed out, there is a minimum height.of lf'�' and a maximum height of 20' in which to work. All the illumina- ted portion of the sign is within the Ordinance. Mayor Finch asked for comments from the audience. There were none.. The City Attorney pointed 'out two changes : 1. The term "interested persons" is changed to its present ­ wording. 2,. A change to make quite certain that eve,-ybody who has a right to appeal has time to appeal.. The City Attorney said that the term"interested persons" was used before and is used in the County Ordinances.' Chairman Gates wanted to call attention to the minority vote's opinion here. in that he felt the door should be left open for reciprocal agreements between neighboring cities. The City Attorney gave the First Reading of Ordinance 002(a-1). Moved by Councilman.Dempster, seconded by Councilman Fitzgerald, to close the Public Hearings. Motion carried, 5-0 D. ANNEXATION HEARING: "Mercedes 64-5 Revised." First Reading Ordinance No. 304. Attorney Dan Oneal, First National Bank B�u.ilding, San Jose, said that he represented Kaiser Cement and Gypsum Company, and that they objected to this annexation for the following reasons. 1. This land was p`archa.sed by Permanente as a buffer between the plant and the city. 2. Permanente now services the land with all'the services needed: water, fire department, police protection by the Sheriff's Office. No ' sewers are needed here. 3. The remaining lands of Permanente are almost all within the County of Santa..Clara. This will create confusion dividing it up among the various municipalities. 4. .They do not feel there is any'need for Cupertino to annex this property. . In answer to the direct question, Mr. Oneal said there is now a 1/4 section annexed to the City ofPalo Alto. He said some Years ago, Bermanente tried to have all their property green - belted. Permanente has no intention of developing this property; they only want it as a buffer. -5- The City Attorney said there are no objections to this annexa- tion in writing so it would be in order to have a First Reading and possibly take action at the Second Reading. Second Reading. Moved by Councilman Dempster, seconded by Councilman Noel, to have Ordinance No. 302 read by title only. This was done by the City Cler?. Moved by Councilman Noel, seconded by Councilman Fitzgerald, to enact Ordinance Nn. 302. The problem arose in that no time limit was imposed in the Ordinance for having the street improvements done, which could affect the Stevens Creek Blvd. improvement program. Councilman Noel withdrew his motion; Councilman Fitzgerald withdrew his second. Moved by Councilman Dempster, seconded by Councilman Fitzgerald, to table this Ordinance No. 302 to enable the problem of the street improvements to be resolved. We have received a letter from Mr. Karl Belser, Director of Planning, in regard to the bridle.path. 4. The City Manager gave a resume of the program of the Feather River Project Association and recommended renewal of the membership. Moved by Councilman Dempster, seconded by Councilman Fitzgerald, to continue the membership in the Feather River Project Association and to pay the $25.00 membership fee. The County Executive has prepared a report recommending that the contract cities receiving Sheriff's Patrol Service be increased by 300 per hour, 6. County Assistant Director of Public Works states they have prepared 75% of the property title reports for the Stevens Creek Improvements Program. They are expediting the job. 7. The Los. Altos Garbage Company is requesting an extension of the time of their contract and an increase in rates. There was considerable discussion on this point. 8. The City is in the process of collecting on the delinquent business licenses. 9. Mr. Bona cich is willing to go along with the amended agreement in regard to the equal division of expenses in case, the city hall construction is started before the crop is harvested. The City Attorney recommended the City Council adopt Resolution No. 1052a Amending Resolution No. 1052 to Provide for Co -paying Agents in New York & Chicago. REPORT OF RECREATION DIRECTOR 1. The first meeting of the new Recreation Commission will take place on, Tuesday, March 2nd, .at - the Collins School Library. Mayor Finch said he plan-ned to be there. . =9- 2. A report on the third quarter for the Recreation Department shows twenty special classes (requiring a fee) with a base registration of 894 participants. The average weekly playground attendance is about 1800. G REPORT OF CITY PLANNER The City Planner gave copies of the County's Commercial Land Needs to each of the Councilmen. XI UNFINISHED BUSINESS A Camarda Complaint: Public improvements re: house -moving, 20030 Forest Avenue. The Assistant City Engineer said he had reviewed the storm drainage fees for the entire parcel with the applicant. The rear portion of his property is an orchard and he has said it will remain so and asked if it must be included in the storm drain fee. Councilman Dempster felt it would be unworkable as a general rule to pro rate this. Many homes in Cupertino have retained some of the fruit trees and it could get very involved. Mayor Finch asked if the Neighborhood Plan shows any street bordering on the back portion of this lot. The Assistant City Engineer said there was, but that it probably would not be developed for some time to come. Councilman Noel said he felt Mr. Camarda was complaining; not so much about the charge, as about his treatment at City Hall. The Assistant City Engineer said Mr. Camarda was told about the improvement costs and he became upset when he found they were higher than he had anticipated. Councilman Stokes asked if it is normal procedure to issue a building permit before these fees are paid. The City Manager said this home was moved down from the hills. The City sent out two building inspectors to check this out. Survey crews were out on the site three times. He felt Mr. Camarda knew all along what procedures he must follow. Councilman Stokes felt the City was wrong in that the normal procedure was not followed. Councilman Fitzgerald recommended the City set up a check list of procedures to be followed and in the future, hand each applicant a copy of it so he has something tangible to refer to. The Chief Building Inspector said there is such a check list which is given to applicants. When questioned, he did not know for sure whether one was given to Mr. Camarda. Councilman Dempster moved they proceed 'co the next order of business. -10- B Schedule Public Hearing on garbage franchise, The City Attorney said he has checked the contract as it now exists. The Mayor felt the City should be furnished an annual report; an audit should be provided and paid for by the. garbage company. Councilman Stokes felt that this was a private business and - how they run it should be their own business. If there is some question, it should be opened for bids. Councilman Dempster felt that all we should be concerned with is their gross revenue. He felt we should let this matter ride until November, when the present contract expires. Councilman Noel requested the City Staff find out what other cities pay and what specific services are included. Moved by Councilman Noel, seconded by Councilman Stokes, to have this matter on the March 15th agenda for a Public Hearing. Motion carried, 5-0 C City Hall Architecture. Mayor Finch reviewed the special meeting of February 24th, which was set up for the review of mission style architecture requested by a citizens' group. Only about 15 of these 450 interested persons came to this special meeting, The Mayor explained that.Mr. Blessing could not come to the Council meeting this evening because he is out of town, but he made the renderings available. Moved by Councilman Dempster, seconded by Councilman Fitzgerald, to open the Public Hearings, Motion carried, 5-0 Mr. David Laing, 21931 Oaknoll Court, Cupertino, reviewed the statements of Mr. Blessing at the special meeting. There were two renderings, one of which had overlays showing a modification. Dr. Joseph Brown, 10365 N. Saratoga -Sunnyvale Road, Cupertino, wanted to know what the difference was. It was explained that the top that is concrete on the one rendering could be tile. Mr. Louis Stocklmeir, 22120 Stevens Creek Road, Cupertino, asked if the rooftop is flat; he would prefer to see the the con- tinue to the top of .the roof. Councilman Dempster said that it is flat because.the mechanical workings are to be put up there. Mayor Finch said we should not be-to.o concerned with the colors on the renderings. They are giving us the shape of the building rather than the materials or colors. -11- Mr. Stocklmeier commented that this is a big improvement over the original plans. He preferred the one with the tile. Mayor Finch called for a five-minute break to enable the audience to closely inspect the renderings. Mr. David Laing said he liked the second propo, al because it had more architectural continuity. He added that wood sides could encourage carving.of initials just as well as wood posts, as suggested by the architect. He felt the all -tile roof and wood uprights add more continuity. He also recommended having the basement. Mr. Warner Wilson, 10237 Creston Drive, Cupertino, said he preferred the original rendering. Mr. Stocklmeier asked about the costs. Mayor Finch quoted figures from the Minutes of the special meeting. He said this proposal would constitute, a savings of about $54,000 over the original design. Planning Commissioner Robert Johnson said he agreed with Mr. Laing. He said a can of spray paint on the cement columns could do as much or more damage as carvings on wood. Mr. Earl McKelvey, 21783 Terrace Drive, Cupertino, said he does not see character in these renderings. He feels the architect took.all the ideas presented to him and compiled them into these renderings. Dr. Brown said he liked these renderings but would like to see the the followed through to the rooftop. He prefers wood columns, and feels the.wood sidingshould be.of a darker color. Mrs. Michael Kowitz,. 11072 Bel Aire Court,. Cupertino, said she is a new resident in Cupertino and wonders whether or not any instructions were given to the architect to inhibit his imagination. The Mayor said there have been no conferences with the architect since the special meeting which was requested by the citizens' group.. He said he would be skeptical, at this point, to ask for any more renderings. Mrs.'Bolby,.11124 LaPaloma Drive, said she prefers the the to go to the top . o.f the roof. AYES: Councilmen Dempster, Fitzgerald, Noel, Stokes, Finch NOES: None Motion carried, 5-0 C Miscellaneous Mr. Don Bandley, Cupertino Realty, said he is acting as Agent for the Cali property at the corner- of McClellan'an.d Saratoga - Sunnyvale Road. He said he has been informed that Humble Oil's Use Permit has expired. There is some confusion as to effective dates. Mr. Bandley explained that they have knocked down the trees and put a chemical toilet on the property in preparation for con- struction, but that they had hit some snags that delayed the construction. The Building Department suggested they make out another appli- cation for a Use Permit, but they only have until March 15th to get started. Mr. Bandley feels that since ground work has been done, this cons"'itues startii:ig of construction and the Use Permit should still be valid. He asked for an interpreta- tion by the City Attorney. Councilman Dempster feels a staff report is in order here. He feels that removal of the trees const.tu.ted intent. -13- The City Attorney said that the one year time lim]Ltation is to kill dead applications, not living ones. Councilman Dempster asked if the architectural approval was based on the specific rendering. The City Attorney recommended we have a notice: of revocation and hold a public hearing. Moved by Councilman Dempster, seconded by Councilman Noel, that the cut-off date for having th.e foundation laid for this service station be set for August 19, 1965.
