A RESOLUTION OF THE CITY QOUFCTL OF THE CITY OF CUPERTINO
MAKING APPLICABLE; THE PROVISIONS OF THE CALIFORNIA
VEHICLE CODE TO PRIVATE ROADS LOCATED WITHIN WESTRIDGE
SUBDIVISION, TRI.C'T NO. 4323, LOCATED WrSTEaLl OV Al'D
ADJOINING SILVER OAK WAY
WHEREAS, Westridge Subdivision, Tract No. 4523, located westerly of
and adjoining Silver Oak Way contains privately owned and maintained roads
within the City of Cupertino that are not generally held open for use of
the public for purposes of vehicular travel., but, by reason K their proximity
to, Or connection with hi.4;hi7ay'u, the interests Of any residents reS7.d'1_l'tg
along such roads and the motoring public will best be served by application
of the provisions of the California Vehicle Code to such roads; and,
WHEREAS, there was filed with the City of Cupertino a petition requesting
such application by a majority of the owners of such privately o mcd and
maintained roads; and,
WHEREAS, a description of such roads is as follows: All roads within
said subdivision, excepting delineated parking areas.
WHEREAS, a public tearing with respect to such petition was duly and
regularly held by the City Council of the City of Cupertino, on the Kh day
of June, 190, after ter.. (10) days prior t r.itt-en notice to all owners of
such roads.
NOW, TUER.EFORE, BE IT RESOLVED by the City Council of the City of Cupertino,
State of California, pursuant to Section 21107.7 of the California Vehicle
Code, that the provisions of the California Vehicle Code shall apply to the
privately owned and maintained roads herein.above described, providQi appro-
priate signs are erected by the property owners at the entrance to such roads,
of such size, shape and color as to be readily legible during daylight hours
from a distance of one hundred feet (100'), to the effect that the road is
subject to the provisions of the California Vehicle Code; and,
BE IT FURTHER RESOLVED, that the Director of Public Works of the City*
of Cupertino is hereby authorized and directed,to supervise the erection of
any such signs by the property owners, as well as any additional signs which
may be required to be erected in the future, all of which signs shall be
erected by the property owners at their sole cost and expense,
BE IT FURTHER RESOLVED, that this resolution may be rescinded and all signs
at the entrances to and upon such roads may be removed by the City Council
of: the City of Cupertino, after holding a public hearing after ten (10) days
written notice to the ot:neys of such roads, if the City Council finds and
determines that it is no longer in the interest: of any residents residing
along such roads and that the motoring public will not best be served by
application of the provisic.n.s of the California Vehicle Code to such roads.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Cupertino this 18th day of June, 1973, by the following voter
