Dear Frank,
- In our previous discussions, you stated that the property owner of the -
subject site is unwilling to record a deferred street inprovenent covenant
as requi.red�by Condition 6 of 15-U-87 You indicated that Shell Oil would
be willing to enter into a deferral agreement which runs with the lease,
but not with the land.
-- Staff- has determined that an agreement against the lease would not. fulfill
Condition 6° City Council policy on deferred street-inprovements does.._..- _
require a covenant recorded on the property. If Shell will not be able to
comply with .Condition 6, the station must cease 24-hour operation and
remove the snack shop. Please inform me as to Shell Is course of action
In regards to other conditions, staff has approved the parking plan as
required under Condition 2 Staff has also reviewed your proposed
security plan. I.have enclosed a copy of the City's security standards.
It appears that Items 3 and 4 have been fulfilled. Please respond to the
other items.

The applicant/property owner ahall implement a security plan to reduce
the potential for theft and robbery, which shall consist of the
following minimum requirements: -
1) Require exact c =ge or credit card sales after 11 EI or provide
physical separation between custcmn and cashier/cash.
2) Institute a prepayment_ system for gasoline sales after 11PM.
3) Install a moneydrop floor safe to which the attendant has no
access.
4) Provide adequate site lighting, including areas away from the
street frontage .accessible by vehicle Location and type of
