Mayor Jewett wanted it to be known that the delays were through no fault of the City of Cupertino. Dr. Joseph Brown, 10365 N. Hwy 9,Cunertino, advised the Council not to rush this thing through at this point. He advised against a combined Hearin€, rather than having two separate, published Hearings. VI MISCELLAIGDUS Mayor Jewett announced that a replacement for the vacancy on the Planning Commission has been selected. Councilman Dempster moved that Mr. Scott Thompson be apWo hated to the Planning Commission. Councilman Benetti seconded the motion. AYES: Councilmen: tti, Dempster, Finch, Saich, Jewett NAYS: None notion passed, 5 -0 IT STUDY SESSION REIAffn To .PROPERTY EAST AND W93T OF HIGHWAY 9, NORTH OF STEVENS CRBO .%VD. Property owners of the Yscell, Rodriguez, Mariana and Reynolds property were in the evdience. CouncilssnFinch stated the City Council feels now 1s the time for this property to be rezoned and the Council would like to see this property broagbt back in for a rezoning application, fees for this application tr be waived, through the regular channels of Public Ammrings, etc. Councilman Saich felt the only real problem is the road pattern- -4- Councilman Banettl stated that he understood this study session to be on the merits of the &cell application only. Mayor Jewett felt the P-C -H zoning application should include the property on the east and west aides of Highway 9. The original applicants were: Paul Mariani, Ralph Rodrigues, Do►. Zccell, Nsthilds poso and Paul Mariani/Mathilda Sousa. The Pearl Reynolds property should slso be considered at this ties. Attorney Anderson stated that to protect themselves, they must first have a Hearing at the Planning Commission level; however, one Public Hearing could suffice. Mr. Paul Mariani stated that this does not seem so much a study session as it does a talk with the property owners to go down and have a Public Hearing. Mr. Pacheco, real estate man representing Mr. Rodriguez, stated his client is willinb to cooperate. Mr. Excell stated he was willing to cooperate because he wants to develop his property while he is still young enough to enjoy it. Mayor Jewett advised the property owners to make the move and the Planning Commission and City Council will act upon it. VII ADJOURNMENT Councilman Dempster moved to adjourn at 10:45 P.M.
