Resolution 136. Appeal.
Mr. Philip Ingber, rtcpresenting Alpha land briefed Council on
the application. Alpha developed 24 units of apartments on Rodrigues
Avenue under R -3 zoning, ordinance 160. Plans were discussed with
the City, presented to H- Control, approved, and Alpha built six four -
plexes. Each four -p'ez is on a metes and bounds lot 70' x 1291. The
applicant learned that they did not meet the requrements for four
=its on property 70'x:129' if the buildings sold individually. They
discussed this with the Real Estate Hoard in :an Francisco, and were
advised to subdivide. They then attempted to divide six lots into
three, getting eight units on three 140'x129' lot. The Engineering
Department found they did not meet sideyard requirements. They were
11' short on the aide yard, but met density requirements. Mr. Ingber
Pained out the 34' shout on the agenda, believing it an error. The
City Clerk explained that in reviewing the ordinance, that the City
has agreed that 34' is the proper interpretation. The City Attorney
agreed.
During meetings with the Planning Commission, there seemed to
be confusion on the interpretation of tine ordinance. Therefore, the
applicant requested a meriting with their attorney, members of the
piamning Commission, anCt the City Attornev. The request was denied.
'Are applicant stated that the Commission expreseed the feeling
that Aapha land Ommpaoy was trying W break the density requirements.
