Robert Dempster requeating to be heard on a Use Permit condition imposed recently on the service station located at Boaestead Road and Maxine Avenue, 2) from .evera1 fourth-graders at the Arch Wilson School requesting 'preservation of the foothill property; 3) frOlll the Wilson School first-graders with work enclosed relative to the preservation of open space. Mr. Ryder explained, for the information of the Council, that due to the recent holiday, the Planning Commission Minutes and the Water Commission Minutes vere not available for this meeting. corresc=.õence After a brief discussion, it vas moved by Councilman Fro1ich and seconded discuss.~= by Councilman Green that the appeal of Application 14-Z-70 be scheduled for public hearing on December 21 and this motion passed unanimously. In reverting back to Item No. 11 under Written Communications, it vas moved by Councilman Frolich, seconded by Councilman Green and passed unanimously that the fund raising be approved, as requested, vith a waiver of the Business License fee. It vas suggested by the Mayor that a response be forwarded to the students at the Wilson School, indicating Cupertino's position and setting forth action taken during the course of the evening's meeting. Robert Dempa~er referred to a condition of a Cse Pe.1mit re- cently approved by the City Council wherein it vas indicated that an existing service station baving a valid Use Permit would be abandoned in excbange for the construction of a new unit. He men- tioned the service station located at Pasadena and Stevens Creek Boulevard as the station selected, adding that it had an existing Use Permit, that the abandonment would include the large parcel behind the service station and, further, that the buildin~ would be removed from the site. He concluded by requesting the City Council's approval of the selected site subject to the City Attorney and his ~orking out the proper documents to complete this action. In response to an inquiry regarding the Use Permit, ~r. Dempster said the permit would be vacated at th~ County level and rever$ion rights would be signed over to the City of Cupertino. It vas ooved by Counci1can Green, seconded by Council:an Frolich and passed by a unanimous vote of the Council that tbe selected site be accepted as the location for abandonment, subject to Ðro~er documents being submitted to the City Attorney and City Council and including the reco~mendation of Mayor Stokes that the docU3ents prepared reflect that the building will be removed from the site.
