AYES, Como Aguilar, Fitch, Klausmeyer, Kowitz, Irwin KAYSm None Motion carried, 5-0 V APPLICATIONS A. Applyeaticsna 270®HCd67, Richard J:. Kehrig,, 963 Orehid Way, San Jose,, requesting Architectural and Sate.Approval of the landscape plan for the Standard Oil service statican which is to be located at the southeast corner of Homestead Road and Taney Avenue. Mr. Kehrig reviewed the conditions placed on his Use Permit for a service station, which included Architectural and Site Control approval of his landscape plans. -1- In answer to Comm. Aguilar's questions, Mr. Kehrig said there will be 6" concrete curb enclosures around all planters and the planters will be sprinklered. Chairman Irwin asked if there will be any visibility problems with the planter in the corner radius. Mr. Kehrig said that planter will have some shrubs 4' high with a 3' spread, some shrubs 3' high with a 2' spread, and a rock garden mounded 3' above the height of the planter. Moved by Comm. Fitch, seconded by Comm. Kowitz, that application 270-HC-67 be recommended for approval to the City Council, per the prints submitted, including the notation that the 6" curbs do exist around all planting areas and that they are all sprinklered. AYES: Comm. Aguilar, Fitch, Klausmeyer, Kowitz, Irwin NAYS: None Motion carried, 5-0 B. Application: 280-HC-67 (Speedee Mart), F. Dennis Burrow, AIA, 121 Whitney Avenue, Los Gatos, requesting Architectural and Site Control Approval to construct a "Speedee Mart" store; to be located on the north side of Silverado Avenue, 187.96' east of Saratoga -Sunnyvale Road. (continued) Chairman Irwin recessed the meeting at 8:15 P.M. for fifteen minutes, to allow the applicant time to appear. The meeting reconvened at 8:30 P.M. Based on the assumption that the applicant for application 280-HC-67 received due written notice from the City of this meeting, it was moved by Comm. Aguilar, seconded by Comm. Fitch, to recommend no further consideration of this application at this time. Comm. Kowitz felt, in light of the fact that the organized homeowners have come to these meetings twice with their petition, only to find that the applicant is not present; the applicant should be required to reapply. At this point, there was the recommendation of the Chairman that the applicant not be forced to refile, but rather the Committee continue this application until the first meeting in September so that the homeowners who have attended the last three meetings would have adequate representation at the next consideration of this application. The two -meeting time span would allow for stated August vacations of the majority of the homeowners. The Chairman restated that he felt the applicant should not be made to reapply and pay the fee again. -2- M_ Moved by Conmi. Kowitz, seconded by Comm.° Fitch., to _.,-Lmend the motion as shown:. If the assumption is correct that Mr. Burrows received due and timely notice of this meeting, the application should be refil6d. Vote 'on the amendment.-, AYES: Comm. The Building Inspector was asked to discuss 'with 'Mr. Talbott the carrying out of the promises made to the Committee on June 14th. B. Chairman Irwin noted the Produce Depot had an A -frame sign on a table all, last week, and over the weekend they displayed two A -frame signs and two leaning signs, all non -conforming. VII NEW BUSINESS A. The Committee received two referrals from the County Archi- tectural and Site Control Committee., asking if the Cupertino Architectural and Site Control Committ I ee had sny,-r6ccomfiendd.- tions to make on them. -3- There followed a lengthy discussion on this matter. Although the Committee felt this was a good idea, this communication was received by the City right after the last Committee meeting, and since it was scheduled to be acted upon by the County on the following day, and this Committee had not had an opportunity to visually check the area, they had no recommendation to make at this time. Chairman Irwin asked the staff to see that these matters are inserted in the agenda from now on, to provide the Committeemen time to check them out before their meeting. It was decided Chairman Irwin would contact the County Architectural and Site Control Chairman the following day to discuss the possi- bility of a joint meeting, with the intent of finding some common ground to help them work together more closely. It was emphasized by Comm. Kowitz that the Committee, in this instance, did not have adequate time to consider these two applications and do them justice. Moved by Comm. Kowitz, seconded by Comm. ,Aguilar, that Chairman Irwin contact the County Architectural and Site Control Chairman in regard to the submitted referrals and to discuss how future referrals will be handled.
