V APPLICATIONS
A. Application: 285-HC-67, Ad Art, Inc., P.O. Box 648, San Jose,
requesting the Arch. & Site Control Committee to consider an
Exception to Sign Ordinance 353, Sec. 6.124 and 7.021 to erect
a roof sign for the Red Carpet Realty, located at 10054
Saratoga -Sunnyvale Road.
Mr. Ken Dalgleish, Sales Manager for Ad Art, 2772 Camino Diablo,
Walnut Creek, California, explained the standard Red Carpet Realty
sign is used at all their locations. The square footage is not over
that allowed, but the spire exceeds the height which the Ordinance
allows. He said Ad Art was retained to design a standard sign which
would be in good taste and which would be a credit to the community.
Photographs of the sign were submitted, and the print was placed on
the bulletin board.
The Exceptions requested were: Sec. 6.124 (height above roof area)
and Sec. 7.021 (3% of the gross area of said establishment).
Chairman Irwin pointed out that over a year's work has gone into the
new Sign Ordinance and that every effort was made to make it workable,
for the sake of the applicants and the City. He felt the Ordinance
provided enough latitude to allow for originality and imagination.
He felt that in this case there was not sufficient hardship to war-
rant an Exception.
Mr. Jim McLey, of Ad Art, Incorporated, explained in detail the pro-
posed sign.
Mr. Don Bandley, President of Cupertino Realty, Inc., agreed that the
new Sign Ordinance is a fine ordinance and serves as a guideline.
But, he said this location is an older business district, in an out-
dated and outmoded building which will sooner or later be removed;
with a background of feed tanks, etc., to contend with. The spire
on this sign is non -illuminated, and is an aesthetically essential
part of the sign. He believed the above reasons were a basis for a
hardship in this case.
From an aesthetic viewpoint, considering existing signs on the existing
buildings, Comm. Aguilar thought the proposed sign would be out of
proportion to the buildings.
Comm. Kowitz agreed that the sign would be more beautiful with the
spire, but it does not conform to the Ordinance and it won't lose its
identity without the spire. He believed the sign would be too high
and out of proportion with the spire.
Comm. Fitch commented that the Sign Ordinance is very recent and con-
siderable study has been put into it, including the consideration of
just this type of situation. He felt the proposed sign would not be
in keeping with the area.

to erect a roof sign at 19701 Stevens Creek Blvd. (continued)
Mr. Martin, General Manager of Stevens Music, Inc., said that unless
they are granted an Exception, they will have to design another sign
than the unique one which is their trademark. He presented a photo-
graph of the alternate sign.
The Assistant Planner explained the sign must be at least 10' above
the sidewalk and not more than 10' above the highest point of the roof.
Discussion followed. Since Mr. Martin had not been fully apprised of
all the facts, he asked for a continuance of this application.
Moved by Comm. Aguilar, seconded by Comm. Kowitz, to continue
application 287-HC-672 Stevens Music, Inc., to the next regular
meeting, pending submission of additional information to the staff
prior to the meeting.
It was pointed out that accurate measurements of the building's
structural design is needed, as well as the maximum height of the
sign, and that this information should be submitted to the Building
Department prior to the next meeting of this Committee.
Comm. Fitch noted that the sign is somewhat unique and seemed all right
as long as they can meet the height requirement. He also noted this
would make the existing sign compatible with the building and its
surroundings.

presence at this meeting. He briefly explained his plans for his sign
and offered to come back with more detailed information. His application
number is 258-HC-67.
Comm. Fitch commended Mr. Milam for his response and cooperation.

'Rev. Garlick explained the sign will set in the front of the

III VERBAL COMMUNICATIONS (continued)
Mr. Art Brown stated he was present at this meeting, in response to
a letter he received from the Building Department. He has been the
Gemco Store Supervisor for two weeks. He explained the existing
"H" fence will be brought out to form a square fence and all present
merchandise, etc., which are now on the parking lot will be enclosed
within the fence. In addition, Mr. Brown said they have started
another planting program, using red ice plant. Every effort will be
made to cope with the litter problem.
Comm. Fitch said the A -frame sign at the service station area is
non -conforming and deteriorates the area. Application should be made
for a permanent sign. Comment was also made on the old tires in the
area. Mr. Brown pointed out the tremendous volume of merchandise
handled here daily, and said every effort will be made to keep this
a neat, clean operation.
V F. Application: 290-HC-67, F. Dennis Burrow, 644 University Avenue,
Los Gatos, resubmitting for Arch. & Site Control Approval to
construct a 7-Eleven store, to be located on the north side of
Silverado Avenue, 187.961 east of Saratoga -Sunnyvale Road.
Mr. Burrow was not aware of the letter and petition which was
submitted by Mrs. Laura Giddings at the previous meeting when his
application was postponed. The staff was instructed to send two
copies of this letter and petition to him.
Mr. Burrows reviewed the last Hearing on this application. He said
his area of concern is with on -site conditions. He said he came
away from the last meeting with the feeling that most of the diffi-
culties lay with the off -site conditions.
Mr. Burrows submitted a new proposal, based on factors brought up at
his last Hearing, incorporating a gabled roof with shingles, which
would be compatible with the homes in the area. There will be natural
wood siding and stucco on the exterior of the building.
In the interest of expediency, Chairman Irwin reiterated the scope of
the responsibility of this Committee.
In discussing the parking spaces, Comm. Aguilar asked how many
employees will be here at any one time. Mr. Burrow said the 7-Eleven
operation is normally a "Mom and Pop" business.
Comm. Fitch commented that although the sale of alcoholic beverages in
a residential area is of some concern, it is controlled by the Alcoholic
Beverage Commission. He noted there could be other types of business
in this location; e.g., a hardware store, where this factor would not
be involved. He asked if truck loading and unloading would encroach
on the parking area, and how the trash collection will be accomplished.
He also wanted more specific information on the on -site lighting and
landscaping; specifically in relation to the adjacent residence.

Planning Department and Planning Commission not to interfere=with
-the alcoholic beverage issue because the Alcoholic: Beverage :Com
mission preempts the Planning Commission on this'mattera They have

the applicant to appear before them to acquire this license...
Mr. Burrow asked for comments -from the Committee on. -the building
and landscaping as presented at.this time. He asked that:the;:s•ign3ng
come before the Committee at a later date. He commented.'that- .the
construction of a residential type fence would:: probably be the. most
satisfactory. A wooden fence` would most effectivelybounces tY e
light and noise back onto this property. Planting would not,be

Comm.Kowitt asked if there were to be any roof appurtenances
Mr. Burrow` said nine air conditioning units go on- the. roof at the,
rear and will be screened with wood vertical siding, mat.erial.a... The
roof will form a canopy and lights will be set inside, thi&area
to illuminate the building.
Mrs® Giddings, Silverado Avenue resident, offered the information
that the residence next door has two bedrooms on the west side: of:`
the housep; which would be adjacent to this commercial property..
It was suggested that perhaps the building could. be 'shifted on= the
lot and the trash enclosure placed on the west side,. to. .niffi
disturbance of the neighbors. .Mrs. Giddings further, suggested
exterior lights similar to those used on the City Hall propeerty
to be utilized here since they would be less `offensive �to. -ti e:
neighbors. kfim Burrow agreed to try to incorporate these two.
suggestions into the plan.

application 290-HC-67 approval to the City Council per the:follow_
ing conditions.
1) Per print submitted with the following contingencies:. -
a) `Adequate adjacent_ property screening to be integrated
into the. overall design.
b) Cement the roofing.
c) Board and batten and stucco exterior.
d) Shift aarbaRe/rubbish enclosure to west side of building

G. Application: 291-HC-67, Floyd B. Bean, of Triangle Associates,
900 N. San Antonio Road, Los Altos, California, requesting
Arch. & Site Control approval to erect a triplex, to be located
on Alpine Dirve off Foothill Blvd. (La Cresta #2).
Mr. Floyd Bean, 900 N. San Antonio Road, Los Altos, representing
the Perrotti Construction Company, presented the plans for the
triplex. The architecture is French provincial and exterior colors
are white and charcoal. The owner will live in one of the units
and have two garages. The rental units will each have one garage
and one open parking space.
The Assistant Planner said this plan conforms with the area; several
triplexes have been constructed in the area already.

the City Council approval of application 291-HC-67, per the plans
submitted, including the 10 standard conditions.

of the ice dispenser in front of the Stop and Shop Market on
Blaney Avenue. There also appears to be a flashing sign in
the window of this market.
