Mr. Gary Stokes, Civil Engineer, presented the application stating
that this reprised proposal incorporated .all the conditions..:impoeed
upon the application at its continuation.under date of Sep•t,embcr.12.

Mr, Stokes explained that the service building had a.mansard roof
along all, four walls of the building which. closely re.zsembled :the
roof of the sales building; bath roofs to be,,constructed lof con ete

Mr. Stokes stated that the on -site lighting was intended to provide
a minimum amount of lighting for security purposes with some flood
lights shining into the yard; the exterior lighting to provide low
lights for the display area and the decorative fence, all of which
to be at a maximum height of 21.
Chairman Small suggested to discuss the architecture, the landscaping,
the lighting and the signs for this application separately. The members
agreed.
The applicant explained that the construction would be such as to enhance
a proposed Polynesian theme, the landscaping to continue around the
eastern exposure off Vista Drive by a low privet hedge along the fence,
and with a chain link fence with redwood slats along the sidewalk,
identical to the one as shown for the adjoining Ivey Chevrolet agency.
In explaining the change of elevation from that originally proposed,
Mr. Stokes stated that the service building would have a 121 wall with
4' of mansard roof. Some discussion ensued on the necessity of
constructing a concrete wall for parcel 3 of they ?ropryrty. Mt. Stokes
stated that if it was deemed necessary and was not showL on the sub-
mitted plans, it would be constructed to adhere to the requirements
of the Ordinance.
The Chief Building Inspector, who had been asked for his opxnon, stated
that this site does not abut residental property; hence, ao concrete wall
need be constructed.
Mr. Stokes continued his.presentation by stating that there would be
double flood lights on each corner, all below the height of the bottom
of the mansard roof, and there would be no light standards.
When a possible installation of a paging system was discussed, which
system might interfere with the adjoining school property, Mr. Stokes
emphasized that this matter had been discussed prior to the Planning
Commission's approval of this application which approval had been
conditioned upon the application being reviewed after one year at
which time all stated objections could be eliminated.
Mr. Stokes explained that the landscaping had been designed by a
landscape architect and would include palm trees, dwarf lllies of
the nile, junipers, shrubs and agapansas, with all diet areas now
proposed on the plans to be planted with ground cover or ycvered
with bark. Mr. Stokes offered to have the landscape architect appear ,.
before this Committee, if this was deemed necessary, to explain the
landscaping in detail. Mr. Stokes also stated that the -pal would
be paved with exposed aggregate small enough for the dollies which
carry the boats to roll over easily when the boats are stored for

Mr. Norman related that the anchor as shown on the submitted drawings�
had originally been proposed butwould be eliminated according to

Mr. Benevich explained that when the application for the building was
originally approved the submitted plans had shown clean and clear
background lines for the roof top construction but that, subsequently, the
explained building had been sold to the Monsanto Corporation who had found
the installation of a 916" air conditiong unit including chiller with
a 1016" fence mandatory for their operation. According to Mr.
Benevich, this construction had been; placed on top of the roof
where it remained in plain view.
In this connection, Mr. Benevich questioned the verbiage of the
wording first condition of the 12 Standard Conditions, indicating that
questioned applicants might find a loop -hole in the wording to allow such con-
structions. To refresh the members' memories, Mr. Benevich read
the entire first condition of the 12 Standard Conditions.
amendment Member Youmans moved to amend the first condition of the 12 Standard
to first Conditions as follows:
condition 'Appurtenances shall not be visible from any street or any area
of 12 commonly used by the public. Further, that a`l! sup-h ap-artenaaces
standard shall be placed within the roof line of the building for which
conditions they are installed. This shall apply to items such as meter
boxes, exhaust fans, air-conditioning units, and -he lime."
Member Fitch seconded and the motion passed unanimoualvr.
Considerable discussion ensued on how the i nstallat--lon c ld Asa"ve been
permitted and, since it was now in existence, how such viola,_"_ins could
discussion be prevented in the future. It was the feeling of the Corm i ttee members
that this application should have beer. re -submitted as it wa= modified
from the originally submitted, discussed and approved playas, particularly
since the original approval had been based upon plans which da not show
any constructions on top of the roof line.
The Chief Building Inspector felt that, with the amendment to the first
conditions, all future violations could be controlled. However, it was
directive the consensus of the Committee members that a specific directive, perhaps
requested in the form of a minute order, should be requested of, and passed and
approved by, the City Council to intensify the powers of the Building
Department in enforcing the Ordinance to the :fetter, precluding even the
slightest deviation from the Ordinance.
Member Fitch moved that any architectural changes proposed subsequent
changes to the initial approval by the Architectural and Site Control Committee
to be of any application should they be submitted to the Building Department
submitted shall be submitted to H Control for review prior to the final in-
spection. Member Youmans seconded and it was passed unanimously.
Member Youmans suggested to request a City Council directive by which
request any builder shall submit modified plans for review by R Control prior

plans and is in clear violation of the Ordinance.

It was the feeling of the Committee members that perhaps a precedent
should be set by requiring the applicant to dismantle what had,been
constructed without the approval of this Committee. The members
requested to be supplied with the originally submitted plans showing
the clear roof top and all minutes of meetings during which Applic-
ation 332-HC-68 was discussed so that the Chairman could present this
case in point to the City Council for their directive and action.
New Business

The members of the Committee asked questions relative to previouI sly
reported and continuing Ordinance violations within the City of Jg
Cupertino. One question centered on the Goodwill pick-up centers
�n Cupertino which are debried and cluttered and give a most un-
8ightly impression.
Member Fitch moved that this matter be referred to the City Council
with a request for a directive to the, Goodwill representatives' to
either police the pick-up centers at more frequent intervals or
to remove the boxes. Member Youmans seconded and it was passed
unanimously,
It was the consensus of the Committee members that the proposed
presentation of slides of European architecture as offered by
Mr. Laurin would- be_ most interesting to 4WPoa�tlttee members and
Al
not just to,.Ilthe�;-.quorum.present at this meeting. Considering the
rather leng, t1iyagendas, the members.fel.t.that a special study sessia)nI,,
would be warranted at which the presentation could be made without 1
the necessity of also conducting listed business.
Member Youmans moved to adjourn the meeting to a study ses,siorn, to
be scheduled for Wednesday, October 2, 1968 at 8000 p.m. Member
Fitch seconded and it was passed unanimously.
