Application Requirements
Justification Statement: Explanation of why the tree(s) should be removed and, if needed, ISA certified Arborist
report.
• The overgrown tree roots from the oak tree on my property are lifting the concrete around my back
neighbor's pool and have also caused a sizable crack in the pool itself. This damage will require costly
repairs. The roots are also possibly responsible for dislodging part of the fence between our two
properties. It is evident that the oak tree was planted too close to the property line. Maintenance of the
tree and the leaves it drops on my yard and in my neighbor's pool is an additional hardship on me. Also,
the tree consistently grows into the electrical wires and phone lines of other neighbors, causing the
distinct danger of a possible fire hazard. Photos of the tree and the pool damage it has caused are
included with this application.

Replacement Plan: Site plan showing a location for the replacement tree, approved by an ISA certified arborist
when needed.
• No plans for a replacement tree.

Here is the information I got from John Martire of the Cupertino Planning Department:
• You must contact an arborist (probably the same people that removed your pine tree) and
have them write up a report that gives information on the oak tree that you want to
remove and the reason you want to remove it.
• The report should mention that the overgrown tree roots are lifting the concrete around
my pool and have caused a crack in my pool. The roots are also possibly responsible for
knocking down part of the fence between our two properties. I think you also mentioned
that maintenance of the tree and the leaves it drops are a hardship on you. Photos should
be provided with the report. I can provide some photos if you like.
• Once the report is written by the arborist, the arborist should contact John Martire of the
Cupertino Planning Department (408-777-3319) to start the process in motion.
