OF THE PLANNING COMMISSION OF THE CITY OF
CUPERTINO RECOMMENDING APPROVAL OF A USE
PERMIT TO OPERATE A RESTAURANT AND BAR WITH
A CAPACITY OF 200 SEATS IN AN EXISTING SHOPPING
CENTER IN A P (PLANNED DEVELOPMENT WITH COMMERCIAL,
LIGHT INDUSTRIAL AND RESIDENTIAL INTENT) ZONING DISTRICT.

LOCATION: Southwest corner of Valley Green Drive and De Anza Boulevard.
FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of February 8, 1982.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does exist,
the special conditions enumerated herein shall apply.
15. The approval is based upon Exhibits A and B of Application 30-U-81
as may be amended by special conditions contained herein.
16. The subject development with the proposed mix of land uses is
deemed to reasonably comply with the trip constraint originally
assigned to this site. Further changes in land use may be subject
to review should it be deemed that they may exceed the forty trip
per acre assignment under the 1973 traffic study.
17. The applicant shall provide a minimum of 73"on-site parking spaces which
shall comply with City of Cupertino standards for size and backup area.
The applicant shall maximize the number of parking spaces by restriping.
18. The modified parking requirement is based upon the parking studies
submitted in conjunction with this application. Should parking become
a problem as determined by the City of Cupertino, the applicant
hereby agrees to the following:
a• Retain a traffic engineer to evaluate the nature and degree of the
parking condition relating to the subject use and the Rancho De
Anza Shopping Center.
b. Implement parking mitigation measures including, but not limited
to, provision of off -site employee parking and/or employee shuttle
service for employees of the shopping center to free up
the on -site parking spaces for patrons of the business.

c. Reduce the number of seats within the restaurant and/or bar during
peak periods to correspond to the City's normal restaurant and
commercial parking standard as applied to this center.
The applicant agrees to undertake any and all measures on his own
to reasonably assure that parking does not become a problem with this
facility. This use permit shall be subject to review by the Planning
Commission should the City receive complaints and/or observe excessive
parking conditions at the subject center.
