Consistent with CEQA Guidelines Section 15206, the Project is considered a project of statewide, regional, or areawide significance. The City of Cupertino, acting as the Lead Agency, determined that the Project could result in potentially significant environmental impacts and that an EIR is required. This NOP has been prepared for the EIR for the proposed Project in compliance with Section 15082 of the CEQA Guidelines. The City is soliciting comments on the scope and content of the EIR. The City will prepare an EIR to address the potential environmental impacts associated with the Project at a programmatic level consistent with CEQA Guidelines Section 15168. The proposed Project, its location and potential environmental effects are described below. Members of the public and public agencies are invited to provide comments in writing as to the scope and content of the EIR. The City needs to know the views of your agency as to the scope and content of the environmental information that is germane to your agency's statutory responsibilities in connection with the proposed Project. Your agency will need to use the EIR prepared by the City when considering your permits or other approvals for the Project. NOP - CUPERTINO GENERAL PLAN AMENDMENT, HOUSING ELEMENT UPDATE AND ASSOCIATED REZONING EIR MARCH 5, 2014 Due to the time limits mandated by State law, your response must be sent at the earliest possible date, but no later than the close of the 30 -day NOP review period at 5:00 p.m. on Monday, April 7, 2014. If you submit comments on the scope of the EIR, you will automatically be added to the City's distribution list for future notices and information about the environmental review process for Project. If you do not wish to submit comments on the scope of the EIR, but would like to be added to the City's mailing list, you can submit your contact information, including email address with a request to be added to the mailing list. PROJECT LOCA SON As shown on Figure 1, Cupertino is located on the southern portion of the San Francisco Peninsula in Santa Clara County. The city is generally bounded by the cities of Los Altos and Sunnyvale to the north, Santa Clara and San Jose to the east, Saratoga to the south, and unincorporated Santa Clara County to the west and southwest. The city is accessed by California State Route 85 (SR 85) and Interstate 280 (I-280). PROJECT DESCRIPTION The City of Cupertino is currently undertaking a community-based planning process to review land use alternatives as part of a focused General Plan Amendment. Proposed alternatives include options for City-wide development allocations (office, commercial, hotel and residential), as well as building heights and densities for major mixed-use corridors including city gateways/sub-areas/nodes (Figure 2), special centers (Figure 3), and seven study areas (Figure 4). The primary purpose of the proposed General Plan Amendment is to replenish, re- allocate, and increase citywide office, commercial, hotel, and residential allocations in order to plan for anticipated future development activity while keeping with the community's character, goals, and objectives. The secondary purpose of the General Plan Amendment is to consolidate development requests by several property owners for amendments to the General Plan by reviewing seven study areas. The potential land use alternatives and changes to urban design and mobility policies would require amendments to the current City of Cupertino General Plan (2000-2020) adopted by the City Council on November 15, 2005. The City is also updating its Housing Element to accommodate the Regional Housing Needs Allocation (RHNA) for the 2014-2022 planning period and meet its fair share housing obligations of 1,064 units, and amending Chapter 19.56 (Density Bonus) of the City's Municipal Code to be consistent with the current Housing Element Program 12 (Density Bonus Program). Refer to Figure 5 for the potential Housing Element sites. The project may also include changes to the City's zoning map to improve consistency with the General Plan to incorporate changes to Housing Element policies as requited by State Law or as adopted by the City Council. Consistent with Section 15168 of the CEQA Guidelines, a program -level EIR will be prepared to analyze the potential impacts of the General Plan Amendment, Housing Element Update, and associated Rezoning. The seven study areas and Housing Element sites will be studied at site -level for overall development envelope and traffic generated. However, consistent with CEQA Guidelines Section 15168(c), the EIR will not evaluate the impacts of specific, individual developments that may be allowed under the proposed General Plan and any such subsequent projects will be required to be examined in the light of the program -level EIR to determine whether an additional environmental document may need to be prepared. Such subsequent environmental review could result in a Negative Declaration, a Mitigated Negative Declaration or a Subsequent EIR. NOP - CUPERTINO GENERAL PLAN AMENDMENT, HOUSING ELEMENT UPDATE AND ASSOCIATED REZONING EIR MARCH 5, 2014 PUBLIC AGENCY APPROVALS The proposed Project will require adoption by the Cupertino City Council. The Planning Commission and other decision-making bodies will review the proposed Project and make recommendations to City Council. While other agencies may be consulted during the General Plan amendment process, their approval is not required for Project adoption. However, subsequent development under the General Plan Amendment, Housing Element Update, and associated Rezoning may require approval of local, regional, State, or federal agencies that may rely on the programmatic EIR for decisions in their areas of expertise.
