WHERE IT REFERS TO THE TREE REMOVAL EXEMPTION SECTION 14.18.150.
2. Subject: General Plan Amendment, 2014-2022 Housing Element, associated Rezoning,
Zoning map and text amendments and Specific Plan Amendment, and related actions
for environmental review to consider citywide amendments to the City's General
Plan, including the Housing Element, Heart of the City Specific Plan, Vallco
Shopping District, heights, densities, commercial, retail, residential allocations, and
recommendations on the Housing Element sites, and to rescind all actions taken on
these issues during the November 10, 2014 Council meeting.
Recommended Action: A. Rescind all actions taken on November 10, 2014 and
consider the issues anew, disregarding prior votes and directions; and
B. Conduct a public hearing and take actions on the recommendations of the
Planning Commission which recommends that the City Council take the following
actions in accordance with the Draft Resolutions (Attachments A - F) with the
exceptions noted in Attachment G:
1. Adopt Resolution No. 14-210 for Certification of an Environmental Impact Report,
adoption of Findings and a Statement of Overriding Considerations, and adoption of
Mitigation Measures and a Mitigation Monitoring and Reporting Program, (EA-2013-
03), in substantially similar form to the attached Resolution (Attachment A);
2. Adopt Resolution No. 14-211, GPA-2013-01 in substantially similar form to the
attached Resolution (Attachment B and as amended by Attachment G), for:
a. Draft General Plan (Community Vision 2040); and
b. General Plan Map Amendments.
3. Adopt Resolution No. 14-212 to authorize staff to, in substantially similar form to
the attached Resolution (Attachment C and as amended by Attachment G):
a. Forward the Draft 2014-2022 Housing Element to the State Department of Housing
and Community Development (HCD); and
b. Use the prioritized list of Alternative Housing Element sites (in case one or more of
the adopted sites are not accepted by HCD as Housing Element sites).
4. Conduct first reading of Ordinance 14-2124, "An Ordinance of the City Council of
the City of Cupertino Rezoning Certain Sites in the City for Conformance with the
General Plan and Housing Element Zoning Map Amendment," Z-2013-03
(Attachment D and as amended by Attachment G);
5. Conduct first reading of Ordinance 14-2125, "An Ordinance of the City Council of
the City of Cupertino amending various Chapters in Title 18 and Title 19, including
the amendment of the Density Bonus Ordinance, the addition of a Chapter in Title 19
to implement policies in the General Plan, the addition of a Chapter in Title 13 to
improve readability," Municipal Code Amendment, MCA-2014-01 (Attachment E);
and

6. Adopt Resolution No. 14-213 approving Specific Plan Amendment, SPA-2014-01,
in substantially similar form to the attached Resolution (Attachment F).
A. RESCINDED ALL ACTIONS TAKEN ON NOVEMBER 10, 2014 AND
CONSIDERED THE ISSUES ANEW, DISREGARDING PRIOR VOTES AND
DIRECTIONS; AND
B. CONDUCTED A PUBLIC HEARING AND:
1. Adopted Resolution certifying the Environmental Impact Report for the General Plan
Amendment, Housing Element Update and Associated Rezoning Project; and Adopting
Findings and a Statement of Overriding Considerations, Mitigation Measures and a
Mitigation Monitoring and Reporting Program with the changes outlined in the Housing
Element Resolution pertaining to the Priority Housing Sites.
2. Adopted Resolution approving a General Plan Amendment to reallocate and replenish
development allocation, amend the General Plan Land Use Map and Development
Standards, Comply with State Law and Reorganization, and Improve Presentation and
Readability with the following changes:
a. Modify the Citywide Development Allocation (Table LU-1) as follows:
(i) Retain existing Development Allocations except Vallco Shopping District should
show 2,000,000 s.f. of office allocation and 389 residential units (as a Plan A Priority
Housing Site). If there is no Specific Plan adopted by May 31, 2018, the City will
consider removing office allocation and 389 residential units.
(ii) Identify residential allocation in the appropriate Special Areas in conformance with
the Priority Housing Sites.
b. Modify the Community Benefits Program (Policy LU— 1.3) to remove the program
specifics and replace with general language as a placeholder until the item is revisited in
first quarter 2015.
c. Revise the Community Form Diagram (Figure LU-1) to reflect existing heights and
densities except for Priority Housing sites that are part of the approved Housing Element.
3. Adopted Resolution authorizing submittal of the Draft Housing Element and technical
appendix to the State Department of Housing and Community Development for review, with
removal of Exhibit HE-2 and incorporation of the changes identified below related to the
recommended Priority Housing Sites.
Column A of the table is a list of the Priority Sites should a Specific Plan for the Vallco
Shopping District be approved by the City Council by May 31, 2018 and column B of
the table is a list of the Priority Sites in case a Specific Plan is not adopted by May 31,
2018.

Minimum density for any residential development on these sites shall be at 20 du/acre.
4. Adopted Resolution amending the Heart of the City Specific Plan in conformance with the
General Plan.
5. Conducted First Reading of Ordinance No. 14-2124 to rezone certain sites for conformance
with the General Plan and Housing Element with a modification to be consistent with the
changes as reflected in Resolutions 14-211 (General Plan Amendment) and 14-212 (Draft
Housing Element).
6. Conducted First Reading of Ordinance No. 14-2125 to amend various chapters in Title 18 and
Title 19 and add a chapter in Title 13 and Title 19 for conformance with State Law,
consistency, and to improve readability with the following changes:
a. Modify the Community Benefits Program (Section 19.144.070) to remove the program
specifics and replace with general language to reflect the Council decision on the General
Plan.
b. Modify Chapter 19.80, Planned Development, to reflect that sites requiring a Specific Plan
shall be governed by the Specific Plan.
