Ma;yor Lazaneo stated that the first order of business would be to. hear
Mr. and Mrs, H. L, Headlee of 20739 Scoffield Drive, Cupertino, on the
closing of Western Avenue, adjacent to their property. The City Coun-
cil had, by an earlier order, directed the developer of Pepper Tree
Tract to construct a vertical curb and place a barrier at the entrance
to Western off of Scoffield Drive, adjacent to the Headlee home. Mr,
Headlee informed the Council that they had purchased the home as a corner
lot and had paid a premium price for the property, it being a corner
lot, and they were very much opposed to having their right of entry
blocked off,
Councilman Pelosi stated that the Council's action was determined by
the fact that if Western Avenue would eventually be opened into Stevens
Creek Road, it would be a thoroughfare for delivery trucks into the
shopping centers on Stevens Creek Road and too, it would tend to gener-
ate a tremendous amount of traffic along Western Avenue.
Mayor Lazaneo stated that this was the first and only objection that
they had had to the closing of this short section of Western Avenue,
Councilman Benetti said that the reason he voted for the closing was
that, at the hearing for the final map for Pepper Tree, this matter
was discussed and the residents of Town and Country Tract (quite a
few were present) were in agreement with the closing of the street.
This is why I voted for it,
Councilman Jewett said that on review of this matter, I do not think
that we are justified in Closing off this street and depriving the
Headlees the right of entry to the side of their property.
Councilman Saich recommended that a car width opening be provided in
the curb way, giving the Headlees sufficient driveway space to get to
the side of their property, Mr. Headlee stated that he did not want
a barrier placed at the curb line that it would be placed at the dead
end of Western Avenue. .
The City Manager stated that providing a driveway did not necessarily·
constitute a public thoroughfare and the City would not be obligated for
any maintenance work on the short section of vfestern Avenue that the
Headlees would use,
Councilman Baich moved to rescind the original order cloSing off Western
Avenue. Seconded by Councilman Pelosi.

Councilman Pelosi moved that a 12 foot opening be provided on the
easterly side of Western Avenue. That is to say, beginning with the
curb adjacent to the Headlees property, and then extending 12 feet
westerly along Western Avenue. That a suitable barricade be installed
at the rear of Western Avenue, that the back of the curb be refilled
arid black topped so that an entry way would be provided for the
Headlees on to Western Avenue. That a NOT A THROUGH STREET sign be
