IV PUBLIC HEARINGS
1. Ivan Bilich: Application to rezone lots 43 & 44, from R-l:B--:2 to
R-3-H; north of Stevens Creek Blvd. from Blaney to Portal \Jh-;t of
Wheaton Drive. Recommended by Planning Commission Resolution 49,
Continued,
The Mayor reviewed the May 1 hearing as reported in the minutes of the
meeting and asked if there were any new opinions to be given.
Louis D. Segal said that the position of Idlewild Greens remains the
Eame and that it was clearly stated in the record. He also said that
the Planning Commission made its best step in denying the Mariani app-
lication at the last meeting, The problem of multiples is not yet
solved, he said, but since the City is close to acquiring the services
of a planning consultant he requested that no addltlonal zonings be
affected to burden the future planning consultant,
Jerry Fitzgeral~ representing the applicatn located the property on
the map and reviewed the surrounding uses. He pointed out that the
property adjoins the commercial and potentially commercial property and
will serve as a buffer. He said the neighborhood plan employs a traffic
pattern which would make it possible to use the property for R-3 zoning,
The property is 188 ft. by 1320 ft, He also said that there are only
2 places in the City with lots so shaped and located adjacent to comm-
ercial or potentially commercial, He added that the general plan pre-
pared by the former planning consultant showed R-3 for this location,
Councilman Jewett asked whether or not immediate developement would
result, to which the applicant replied in the affirmative, Mr, Fitz-
gerald said that the street pattern might require the builder to place
single family dwellings on Portal Avenue. One of these single famlly
lots would be partially on the adjoining property,
The City ~1gineer stated that the existing neighborhood plan for the
area was prepared immediately prior to the submission of the Triumph
No, 1 map by Ripley HOnES and the selection of a school site adjoining
this subdivision. Consequently, Neighborhood Plan #8 is presently be-
ing revised and will be ready in about 2 weeks.
Councilman Pelosi referred to the small pieces of property located
along Blaney Avenue and the effect the proposed street pattern would
have, He proposed that the Council study the road patterns in all the
neighborhoods. The City Engineer advised that none of the neighborhood
plans has ever been adopted by the Council, He explalned the difficul-
ties involved in trying to estimate the future uses and ownership of
the land, the size of the parcels, etc.

Endorsing AB 2048 Relating To Establishing County
Cities And Requesting The State Legislature And
The State Of California To Enact Said Blll Into
The City Attorney reviewed the background on the resolution pointing
out that the State Legislature has already enabled cities to invest
funds in unincorporated areas and also enabled the County to invest
funds in designated County highwa~charging the city wlth their consent.
Adding to the information submitted in his memorandum dated May 9, 1961,
the City Attorney said that Highway 9 and Stevens Creek Blvd. would not
be a burden on the taxpayers of the City if the State and County assumed
the maintenance responsibilities, The basis and theory behlnd the re-
cent $70 million bond program involves the concept that the County
could take jurisdiction over sertain city streets, he said,
Councilman Saich agreed and emphasized that the electorate voted on the
assumption that the roads designated in the County report would be im-
proved with the monies voted, Sinc~ 30% of the money was allocated to
the cities for use on city streets he also maintalned that the bond
issue was passed with the intentions reflected in Resolution 447.

to study the matter,
The Mayor said he considered it a problem for Sunnyvale to deter~
min~ rather than Cupertino,
Councilman Pelosi recalled that a simllar appllcation had been sub-
mitted previously and withdrawn.
John Racanelli referred to the "informal gentlemen's agreement" be-
tween Sunnyvale and Cup~rtino on the boundary line subject and said
that this agreement is the reason for the letter. Sunnyvale, he
said, would not act on the application without referring it to Cup-
ertino, He said the surroundings militate against single dwelling
use for the property,
The Mayor reiterated his opinion that it is not up to the City of
Cupertino,

4. George Yamaoka: Letter appealing the decision of the Planning
Commission on his request for a temporary building permit for fruit
stand,
The Planning Commission Chairman reviewed the application and vote
which resulted. in a 3-3-1 deadlock,
Mr, Yamaoka informed the Council .that he intended to operate the
stand the. same as last year selling fresh fruits and vegetables, and
he will not erect the stand until the road is paved and the sidewalk
installed, The stand will be used for the present season and will be
removed in December, he said.

Yamaoka for a fruit stand to sell produce of ,the season for the

5, J, R,...McC:ormick, President of Russelhurst Homeowners Association:
Copy of lêttèr to Board of Supervisors concerning traffic control at
Old Stevens Creek Road and Crescent Road, Councilman Pelosi said that
the County has taken traffic off Old Stevens Creek Road by using de-
tour horses routing the traffic around Crescent Road.
He said that traffic must still enter Stevens Creek Road at the
dangerous triangle, He said further, that the City should write to
the County expressing concern over the present realignment of traffic,
The Mayor advised the Council to look at the streets prior to the
next meeting.
6, The Mayor asked the support of all Cupertino citizens on national
Poppy Days, May '26 and 27. He urged the citizens to support this
worthy program by a small donation.
7, County Boundary Commission: Lat'est annexatiòns within 3 miles of
Cupertino.

The City Engineer explained that the City lS still in need of
standard specificatlons e.apecially in view of the fact that
hillside developement in the City of Cupertlno may be approach-
ing,

The Mayor scheduled the standard specifications for the next
study session,
C. Report of City Attorney
Sae City Attorney memorandum dated May 15, 1961,
The Mayor authorized theCity Manager to try once again to secure
the necessary dedication to construct the Regnart Creek Channel
through Tract #2551,
D, Report of Planning Commission
The Chairman advised the Council thatthe Commission will try to
send clear recommendations to the Council. He then submitted lists
compiled by a Planning Commission sub-committee altering the present
procedure on Commission appllcations. The new procedure would re-
quire applicants to appear flrst before the H Control Committee and
also put into effect the check lists proposed by the Engineering
Department dated 2/23/61,
Councilman Benetti said that he had been invited to attend this
sub-committee meeting and that the committee had purposely omitted
reference to the aforementioned check lists and decided instead to
follow procedures affected by the administrative office.
Mr. Small then offered to change the recommendation of the sub-com-
mittee.
Councilman Pelosi asked the City Attorney if the H Control Committee
can take first jurisdiction over Planning Commission applicants.
The City Attorney advised that referral to the H Control Sommittee ¡"I.
would be meaningless in some cases, such as that of Mariani, where-
in no plans or specs have been submitted, thus allowing the H Con-
trol Committee nothing to study,
Councilman Jewett said that subjects were becoming confused, He
said that he has not seen the list and would like to do so before
venturing opinion.
The Mayor but the subject over to Thursday, May 18 and requested
coples for the City Cow1cil.

Board have a meeting scheduled for May 23,
2, Paul Finch of the Cu~rtino Recreation Commission reported that
the Commission has been denied use of school facilities for danQing
classes,

May 19 at 8PM, Collins. School,

Councilman Benetti sa~d that the High School District has made 2
nigþts per week available to adults pending the meetlng between
the' Fremont Union School Board and the City Councll.
3. City Manager referred to the Planning Commisslonæquest for a
traffic study in the vicinlty of Bubb Road In connection with the
9 Planning Commission application for that neighborhood.
The City Englneer advi~ed that the City not expend additlonal
money for traffic pattern studies around Bubb Road at this time,
but that the applicant be required to submit some evidence that a
feasible circulation plan could be worked out with the proposed
zonings in mind,
The Mayor advised the Clty Manager to contact the applicants
concerning submission of additional information of the type afore-
mentioned,
4. The City Manager read a letter from Brancado Paving Company rela-
tive to lots 11 and llA on Scenic Blvd, The applicant is willing
to dedicate the proper street frontage but wants the Clty to waive
the improvements on the 29 ft. of frontage until the remainder of
the street is improved,
Councilman Pelosi proposed that the matter be postponed so that
the Council can look at the affected property,
The Mayor advised the City Manager to prepare a report on the
property for May 18,

through the City Manager for a requisition to the City Engineer;

decision on Highway 9 j.nterchange can be expected from the State
until a decision is reached on the requested interchange for Wolfe
Road,
Councilman Pelosi said that Mary Avenue is also a problem,
The Mayor said that the coming meeting with the Fremont School
Board will permit the Council to gain further information on Mary
Avenue~

waters for the Hetch Hetchy system has been delayed until after
San Francisco makes its presentation to the Water Commisslon on
May 17.

lDg the size or compostion of the Water Commisslon to the Board
of Supervisors,

Mayfair Ðusli.nes on the grounda of faulty eqw.pment, Peerless
Sta~es bought the operating rights of Mayfair Busllnea on May 7 and

pension of the injunction against Mayfair. San Jose City Lines is
