Prior to polling the Council Mr. Fitzgerald, representing
the applicant, said that Cali has dedicated property for
Wolfe Road, 400 ft. x 45 ft. by agreement with Rousseau
Organization and on that basis does not feel he should st and
expense for the signalization or other improvements.
Councilman Jewett observed that signals at the intersection
are recommended by the Planning Commission in their Resolu-
tion of approval. He maintained that the applicant should
contribute to the installation of a signal inasmuch as he

will be the main beneficiary of the commercial property
and the flow of traffic.
The City Engineer suggested some fixed means of providing
for each corner and the respective owners participate in
the cost of a signal at the intersection. He pointed out
that a 120 ft. ROW is a very wide road over which to sus-
pend a traffic signal.
Councilman Benetti agreed that the financial participation
of owners in the signalization should be uniform and should
be specific.
q Mr. Fitzgerald further stated that Cali and Rousseau have
an agreement that Rousseau will be responsible for and fur-
nish all improvements due to the fact that Cali has dedica-
ted a portion of Wolfe Road in the extent of 400 ft. x 45 ft.
Councilman Lazaneo observed that the City need take no cog-
nizance of such private agreements and that the applicant
should be subject to some responsibility for the signal inas-
much as it has been defined as a Qty project.
3. Stephen Dorcich: Application to rezone 2 lots from R-3-H
to C-l-H, northeast corner Blaney and Stevens Creek Blvd.
Recommended by Planning Commission Resolution 41.
The Chairman declared the hearing open and asked for dis-
cussion from the floor.

F. Ordinance 002D: Amending Ordinance 002By Adding The Classi-
fication "Amusement Resort Zone".
First reading given.
Councilman Lazaneo brought an objection to the requirements
of the ordinance particularly to the use permit provisions,
He maintained that to allow a riding academy in section 2.1a
should preclude the requirement of section 2.lb, wherein
stables require a use permit. He said it is inconsistant,
that a riding academy can't be maintained without stables;
therefore, he favored elimination of the use permit for stables
He applied the same principle to golf courses and restaurants
and other uses.
Councilmen Jewett and Benetti observed that the use permit
would give the City a control in that more than one such
use (uses), perhaps strictly commercial, would apply for per-

mits in which case the use permit provision would allow
the City to distinguish and control. They based their
reasoning mainly on the ground that use permit regulation
would allow the City to keep strictly commercial faciflties
out of the A-R zone.
Councilman Lazaneo said the method was impractical, that
it would unduly harass the buTIder or investor to apply for
use permits.
The City Attorney said he could see no legal problems in
the ordinance and that it was entirely a policy decision.
Councilman Benetti said he would like to consider the poss-
ibility of waiving section 8.1.

problems of the Mt. View-Stevens Creek Road. Property owners
and operators of the several quaries will all be at Collins
q School to give their view points.

2. Gardner Bullis, Attorney: Letter on behalf of this clients,
LeCroye Silvey, et al, concerning potential flood damage to
property down stream from the Cook and Wilson subdivision.

3. Mrs. E. R. Worst, Wunderlich Drive: Copy of letter to editor
of Cupertino Courier relative to alledged comments about Ran-
cho Rinconada Subdivision.
4, Rose Johnson: Letter objecting to references made at a recent
meeting of the RRHOA. The Mayor and Council authorized the
City Manager to respond to the two previous letters and ex-
press the sentiments of the City Council to the effect that
they do not agree with the attitude mentioned in the letters.
5. Cupertino Chamber of Commerce: Letter expressing appreciation
for the investment of $1,000.00 by the City of Cupertino for
Chamber services.

8. American Legion, Stevens Creek Post: Letter protesting the
ban on sale of fireworks in Cupertino.
Ed Martens, writer of the letter, and Gene Ravizza on behalf
of Cupertino Lions Club, petitioned the Council verbally to
lift the ban on fire works (see further down).
9. Ray Dunnet, Mayor of Los Altos: Letter with respect to joint
meeting of Los Altos and Cupertino Councils to resolve matter
of future boundaries. March 8 suggested. (subsequently can-
celled) ,
10. League of California Cities: Notice of Peninsula Division
meeting, Algiers Restaurant, Redwood City, March 16.

PROTESTS:
Ed Martens (see VII 8) stated to the City Council that his
Post had obligated itself for $1600.00 worth of fireworks,
proceeds to go to various programs. He described this at
some length, concluding with the opinion that fireworks will
be used in the City despite the ban on sales.

Gene Ravizza objected to Ordinance 169 on behalf of the Cup-
ertino Lions Club. HenaiBtained that the accident occuring
last year was not the result of "safe and sane fireworks"
but was inflicted by some sort of toy gun employing caps
which he said can be purchased the year round. He also based
his argument on the fact that the ordinance is impo~sible to
enforce (meaning the use, not sales) and that such a situa-
tion tams to encourage children and others to circumvent the
law. He asked the City Council to rescind the ordinance.
The Cupertino Variety Store made a similar appeal.
Councilman Saich proposed that the City schedule a hearing on
the subject to arrive at the best solution.
James Moriarity, Red Devil Supply Co., addressed the Cit y
Council to protest Ordinance 169. He repeated many of the
previous objections, stated that the trend is toward legal-
izing the sale and use of safe and sane fireworks. He stàed
that statistics show that not a single injury has been the
result of "safe and sane fireworks", also that municipal ref-
erendums have resulted in votes favoring the sale of fireworks.
Further, he said that several Cities in the County permit
such sales.
Councilman Lazaneo proposed that a check be made of the ad-
jacent cities.
The Mayor stated that the City Council had left instructions
to stop the purchase of fire works by vendors and ordaniza-
tions selling fireworks in the past. He said he would like
to see a hearing on the subject.
Councilman Benetti said that he would like to hear from the
people in the City of Cupertino before he would consider re-
scinding Ordinance 169, rather than simply hearing from com-
panies and organizations with an investment in the sale of
fireworks.
Moved by Councilman Saich that the City Council set a public
hearing on the 20th of March for consideration of the oral
petitions to allow the sale of fireworks within the City
limits and to consider rescinding Ordinance 169.

purchased by the City, at a cost not to exceed $50.00, for
the use of the Cupertino Youth Club, to be appropriated from
the Recreation Commission budget.

Councïman Saich said he is still awaiting notice of a hearing
that was supposed to be scheduled on the matter.

The City E ,gineer reported that the standard 90 ft. road con-
templated by the City requires a median or dividing strip,
also a left hand turn lane or stacking lane may be indicated
at the future intersection of Wolfe and Stevens Creek Blvd.
George Oakes, representing Rousseau, agreed with the idea of
median strips on traffic islands in general, but speculated
that it might work hardship at this particular intersection
due to the location of a gas station at the south west corner.
He also observed that such a 90 ft. road is so wide for the
traffic it will need to carry that U Urns can be made in app-
ropriate places without benefit of a stacking lane. He summ-
arized by saying he has no objection b a divider strip if
proper access is provided to the adjoining shopping center.

subject subdivision, particularly to the motion of the Plan-
ning Co@nission which referred to the construction of a foot
bridge across the Calabazas Creek.
George Oakes said his map is being prepared to include ded-
ication of a 10 ft. pedestrian path leading to the proposed
bridge location.
Moved by Councilman Lazaneo that the City Manager and Coun-
cilman Jewett contact the school district relative to the
construction of a foot bridge across the Calabazas Cree]c;

a planning consultant (s).
