III PETITIONS AND COi';'UNIC¡\'fIONS A, hrri tten 1, Mark Thomas & Company: Cupertino alternate route 114 _ preliminary plans of route relocation, The Nayor said that the October 16 meeting resulted in a recommendation to move the Stevens Creek Freeway westward to a point approXimately 600 feet east of the railroad approximatels parallel to the tracks, If adopted this will change the curvature at the corner of the Nonta Vista Subdivision. 2, State Board of Equalization: Statement of local tax distribution for the period August 8 to September 4, 1957 Warrant enclosed: ,,,,812,8), B. Oral nr:-TucCi petitioned the City Council for an interpretation of the Business License Ordinance to enable him to operate a furniture auction sale in what is now the Charron Warehouse on Randy Lane, or to amend the Ordinance to relieve him of the license payment of .,50, first day, .~25 per day thereafter The City Attorney explained that the ordinance is designed to limit and prevent auctioneer:ng which may continue for months although obstenslbly conducted to sell a given amount of good If the business in ~uestion is a sale by the owner of goods rather than a so called professional auctioneer, Ordinance 10 is not designed specifiCally to cover the situation, The feeling of the Council was that the matter should be studied and Councilman Nathanson moved that the problem of auctioneer ing within the Citv be t3ken under advisement and the findi~~ reported at the next meeting; seconded by Councilman Saich, carried 5 - 0, IV UNFINISHED BUSINESS A. .9-r~~Dances and Rpsolutions for Adoption _ None B, Soci::ll Security Agreement and Resolution Resolution No. 52 was adopted along with the Applic2tion Agreement to be forwarded to the OASI section Sacramento, California, then relayed to the Federal Government office for verification, The Social Security will be in effect for the two employees so requesting on January 1, 1958. C, Purchase of Furniture _ Prices Quoted 1. After comparing bids a camittee of three, Nr, Nathanson, Mr, Paizis, and Mr, Martin, was appointed to inspect the furniture during the following week, 2. The painting will cost ~216 for the entire interior of the building, Adding the costs for alterations, the tote will be under the $400 allocated. Moved by Councilman Saich that the entire interior bE painted; seconded by Councilman Nathanson, carried 5 _ 0, ). Councilman Nath3nson said that the City now has place to store the parallel parking signs that the County Traffic Engineer has offered. -2- D, Corte Madera Highlands LID - Consideration of Revised Plan In response to a petition signed by a11 of the owners of the area in question, Resolutions were adopted to approve modified plans and specifications of this Improvement Distric1 Resolution 62 declares intention to change.work.proPO¡;ed to be done under Resolution of Intention No. 56 adòpted Septem- ber 16, 1957 and describing such proposed changes and stating estimated decrease in cost by reason thereof. Resolution No. 63 orders work, determines prevailing rate of wages, and directs notice to bidders in~Corte Madera Highlands, Local Improvement District, in the City of Cuper- tino, l'Ioved by Councilman Paizis, seconded by Councilman Saich that both resolution be adoPted, carried 5 _ O. Town and Countr Subdiv sio Streets l, A letter from John Rodrigues, r. requested that the City take title to Western and Rodrigues Avenues .and the access road and the one foot easements. The repair work has been found satisfactory, Rodrigues expects to pre- sent the deeds vesting title to the City shortly, 2. Deeds to Parcel A, the intersection of Mariani and El Vista Avenues, are also accepted prior to the next Coun cil meeting with the change in name of the school distri and a formal resolution accompanying, as requested by the City Attorney. E, V NEW BUSINESS A, Attorney's Rep0r1 Mr, Anderson described a notice from the PUC, The State Department of Public Works has allocated five million dollar~ for construction of railroad underpasses and grade separatio' Cities requiring such grade separation can apply for a por~ of this money. The Council requested that the matter be submitted to Mark Thomas for consideration and Possible assistance in the preparation of an application. Mr. Saich reported that the streets were in need of sev- eral signs, Two are needed at Stevens Creek Road and Highway 9, Three in Town and Country Subdivision plus some in Felton Park Tract, also speed limit signs on El Vista and Mariani Avenues, 2. Sign permit for Cupertino Presbyterian Church. Mr, Leonar reported th~t he had taken the sketch to the County; they advised that Church directional signs are sometimes allowed in the right of way if the local government makes the installation and consequently has the prerogative of remoVing when necessary, In this case the Church will arrange to install the Sign themselves to the satisfactio; of the City. -J- , E~ 2. Paul Swanson: Applic8tion has been filed for a temporary used car lot to be ~ollowed by a new Ford agency, Hearin has been set for Nove~ber 15. 3. Chrysanthemum bed on Rodrigues: Harry Chow has p~esented three separate plans which include 60 foot streets. Cho~' himself intends to build a four bedroom three bath house, He has signed the petition for sewers through LID ). The Council requested that the interest of the citizens along Rodrigues be determined, to learn whether or not a meeting is still desired. Mr, Leonard as~ed the Council for authorization to sign the building permit for Chow's accessory buildings, Councilman Nathanson reiterated his intention to secure cooperation and agree- ment satisfactory to all interests, With this plan in mind he favored issuance of a building permit.- The type of fertilizer, kno~~ as 1770-10 from Moyer Chemical was described, and considered unobjectionable. Moved by Councilman faizis that the building permit for Chow be ~pved with a note stating that the 20 x 60 foot bUildin~ is accessory and not residential, to be dated October' 21; seconded by Councilman Saich, carried 5 _ o. 4, Mr, Leonard proposed a joint meeting with the City Coun- cil to be held October 28. This was agreed and the meeting was scheduled. Miscellaneous "I, 11r, Faws reported the results of a meeting with Gladys Snyder from the ßtate Recreation Department. She suggested the formation of citizens committees to deter- mine the wishes of the people with regard to the recrea- tion facilities desired and the money to be spent therefc 2, Councilman Wilson requested that the State Highway Depart ment be asked to provide directional signs which include Cupertino which is presently listed at only a few inter- sections in the vicinity. ). A vote on a motion of the previous meeting to increase the salary of the Ci ty Attorney to (;:200 per month was taken, with none in favor, Moved by Councilman Nathansor that the remuneration of the City Attornev in the form Q[ a retainer be raised to ~2S0 a month; seconded by Councilman Wilson, carl'ied 5 - o. 5, Otis Forge, Chairman of the Sanitary Listrict, reported that the area just east of Portal may be potential sub- division for the City of Cupertino if services such as storm drainage and sewers can be provided, It was suggested that the owners of the 53 acres along the City boundary be contacted with a view toward annexation. VI ADJOURNMENT - lO:30 P.M. A special meeting of the City Council was called for October l6 to discuss a Cupertino recommendation for State Route l14. At the meeting attended by a quorum, the four routes presented by Mark Thomas Company were examined, After some discussion, the route favored differed from any of the drawings and resulted in a request to !lark Thomas to present another sketch, The recom- mendation would place the route west of the existing state line, about 600 feet east of the railroad tracks. The joint Council-Planning Commission meeting of October 28 will be reported in the next minutes of the Planning Commission and again in the following minutes of the City Council.
