Saratoga-Sunnyvale Road 7:30 P.M. I SALUTE TO THE FLAG II ROLL CALL Councilmen Present: Councilmen Absent: Others Present: Pelosi, Benetti, Jewett, Lazaneo, Saich, None City Manager, City Attorney, City Engineer, Ci ty Clerk III Racanelli-Duvaras Application. The applicant stated he intends to withdraw his applicaton. Initial reading of Ordinance 160 indicates to him that the variance requested is no longer necessary. He said he so advised the City by phone and that he will confirm the fact of withdrawing the application in writ- ing. He was advised that he could now present plans for architect- ural and site approval. IV Yamaoka - Sakura Construction Company. Don Hobbs represented the applicant. He based his application on the fact that it would be good planning to zone R-3-H adjacent to a major freeway. He said that apartment houses would be the high- est and best land use of the property. Councilman Benetti said he had contacted the owners of adjoining land, both residential and agricultural, and that the majority have no objection to R-3-H zoning on Lucille Avenue itself, but they pre- fer the balance of the property to be placed in R-I use. Discussion followed on the exact limits of apartment and single family zoning for the property. Also reference to the present ease- ment on the east limit on Yamaoka's map. The applicant was also asked whether he will dedicate sufficient property to provide for 120 ft. ROW on Highway 9. The City Engineer noted that a 10 ft. easement would also be required for utilities to be relocated on the east side of Highway 9. This might save the necessity of mov- ing the utilities when and if Highway 9 is widened a second time. At the present time the State of California needs 10 ft. to make an 80 ft. travel way out of Highway 9 and City would require approx- imately II ft. additional or 51 ft. east of center line to accomo- date utility easement. P.G. & E. has established a policy of re- locating utilities only once. Moved by Councilman Jewett that the zoning be granted on the subject map altered as follows: R-l on the south side of the property (south of the proposed street) 120 ft. of R-3-H zoning on the west side of Lucille Avenue as Lucille Avenue is shown in Resolution 408, with the provision that Lucille Avenue be 520 ft. east of the future east- ern ROW line of Highway 9, R-3-H zoning abutting the south side of Lucille Avenue where Lucille runs east and west to the street pro- vided within the property with the provision that the applicant ded- ic~t~ la, ft. on Highway 9 plus easement rights for utilities, R-I zoning on the east side of the property, this R-I to be confined to single story zoning; Seconded by Councilman Lazaneo. AYES: Councilmen: Benetti, Jewett, Lazaneo, Saich, Pelosi NAYS: Councilmen: None ABSENT: Councilmen: None MOTION CARRIED: 5-0 V Anton & John Saich: Application for C-1-H and R-3-H north west cor- ner Stevens Creek Blvd. and Highway 9. Councilman Saich vacated his seat on the City Council. Donald A. Barr represented the Saich application. A lengthy discuss- ion followed on the meaning of Ordinance 160, the basic question be- ing whether the applicant could construct 20 apartments to the acre 234 if subdivided lots were recorded on the acre of 7500 sq. ft. each with 4 apartments per lot. It permits 20 unii.s to the acre but apparently does not permit them to be placed in such a way and the property subdivided in such a way that 4 apartments would be built on a subdivided recorded lot of 7500 sq. ft. Without divid- ing the area into lots the units do not exceed the number permitted in the Ordinance. ¡... ~ ~ ..... ¡z, Moved by Councilman Jewett that the applicant be denied approval of 4-plex units on 7500 sq. ft. lots; Seconded by Councilman Lazaneo.
