State of California l0300 Torre Avenue, Cupertino, California 95014 Phone: 252-4505 MINUTES OF THE ADJOURNED REGULAR MEETING OF THE CITY COUNCIL HELD NOVEMBER 3, 1969 IN THE LIBRARY OF THE CITY HALL, CUPERTINO, CALIFORNIA The meeting was called to order by Mayor Dempster at 7:42 P.M. Those in attendance were: Councilmen Beaven, Fitzgerald, Stokes and Dempster. Councilman absent: Noel. Also present: City Manager Storm, City Clerk-Finance Director Ryder, Public Works Director Yarborough, Planning Director Sisko Mayor Dempster introduced Mr. Earl Lewis of De Anza College and ex- plained that the purpose of the meeting was to obtain from him his sug- gestions on the scope and content of a proposed study for a City of Cupertino police facility. Mr. Lewis stated that there were two basic approaches to take, one of which would be the usual consultant study which would be made without reference to the specific needs of Cupertino. This would be the cleri-' cal approach involving statistics, standards and criteria developed from experience on a nationwide basis. The second approach, which is the one he favored, would be that of a working group in which the professional or consultant would be acting as a resource person, guiding the offici- als of the City who would be involved in this project. Mr. Lewis further explained that there were other sources besides him- self who might be considered, including the International Association of Chiefs of Police. ,the State of California through the Attorney General, or large management consulting firms. He said that the best approach to take would depend entirely on what the City wanted as an end result. He said he felt it would be much more meaningful to have the City appoint a subcommittee on safety and, thereby, become more intimately involved in the study. He reported that he would be will- ing to assist Cupertino, if requested, but felt it necessary to state that he did have bias in that he planned to run for the office of sheriff and was in favor of a strong contract system with that de- partment. ." "," " Councilman Stokes offered his opinion that in some point in time the the cost of a contract system would be as much or more than the cost of an independent police force. He considered an independent police force to be one of the more important divisions of government because of the close personal contact involved in such an operation with the citizens and the City Council's ability to establish policy through its own force. Mr. Lewis said that the eStablishment of policy was the best argument for an independent force but that the cost factor was not valid in call to order roll call speaker introduced comments by Mr. Lewis council comments page 2 Minutes of Adjourned Council meeting November 3, 1969 that, regardless whether or not an independent force was established, the citizens still were paying for the operation of a Sheriff's Department through the County's General Fund taxes. Mayor's comments Mayor Dempster offered that there was a good deal of overlapping and that independent police forces and sheriff's departments often worked at cross purposes without fully realizing the duplication of effort. Mr. Lewis answered Councilman Beaven's question that there was a rule of thumb that could be applied to personnel or hours of patrol per population figure but that Cupertino did have unique features, more prevalent in some areas, which would make such rules of thumb inaccu- rate. He referred specifically to the high volume of traffic generat- ed by the freeways within the City, the numbers of young people attending the college and the uncontrolled, commercial development in nearby areas outside the City limits. After further discussion and debate on relevant issues, Mayor Dempster, with the concurrence of the City Council, made a request of City Manager Storm to have further contact with Mr. Lewis and to submit a discussion report in writing. This report is to expand the various thoughts and direction alternates on how best to proceed with a study insofar as the question of whether or not Cupertino should have its own police facility Or should continue to contract with the Sheriff's Department for public safety services. adjournment The Mayor adjourned the meeting at 8:11 P.M.
