MINUTES OF THE ADJOURNED REGULAR MEETING OF THE CITY COUNCIL
HELD MAY 25, 1970 IN THE CONFERENCE ROOM, CITY HALL,
CUPERTINO, CALIFORNIA
The meeting was called to order at 7:32 P.M. by Mayor Stokes.

Adjournment to Executive Session
Mayor Stokes said the purpose of this adjourned meeting was to interview
applicants for the vacancies on the Planning Commission. He then re-
quested a motion to adjourn to an executive session for this purpose.

It was moved by Councilman Noel, seconded by Councilman Fitzgerald, and
passed unanimously that the City Council adjourn to an executive sessio~
for the purpose of interviewing applicants for the Planning Commission.

The City Council reconvened in open session at lO:15 P.M.
It was moved by Councilman Noel, seconded by Councilman Frolich that
John W. Buthenuth and Robert W. Meyers be appointed to full terms on
the Planning Commission.

New Business
1. Submission of appraisals on horse ranch and
Damico properties
Mayor Stokes ascertained that neither owner of the two properties in
question were in attendance, although both had been invited. He then
asked City Manager Storm for a summary review of the appraisals.
In addition to giving the Council the benefit of his personal opinions
on the appraisals, Mr. Storm also advised the Councilmen of the various
alternatives for financing such a purchase, if the Council decided to
proceed with the acquisition of these properties.
Mayor Stokes reviewed the history of the subject properties for the
benefit of the two new councilmen and how it related to the City's
interests. He said the primary question was whether or not the City
wished to acquire these properties and, if it did, by what means would
this be done.
Mayor Stokes said that it was his personal belief that the City needed
surplus land for the future. He stressed that existing land now unde-
veloped should be the first priority for development but that twenty-five
or fifty years from now people at that time would be grateful for the
far-sightedness of this council in taking steps to preserve this extra
land. He said he was not interested in the development of this property
right now or in the immediate future.
Councilman Noel agreed with the Mayor on the desirability of acquisition
but questioned the feasibility of reaching the limit of the City's bond-
ing capacity. He was advised by the City Manager that plans discussed
so far would not exceed this bonding capacity.
Mayor Stokes inquired as to the status of the plans for the Community
Center and Mr. Storm replied that they should be ready in a preliminary
fashion for the second Council meeting in June.
Councilman Fitzgerald said he was in basic agreement with the Mayor's
feelings that if this was to be considered as a possible bond issue in
November, action should be started now. He also emphasized that this
property should be the last in priority for development but that it
should be purchased.
Councilman Frolich asked if there were any summary figures on cost to
date having to do with park acquisition and development and what the
total bonding capacity was. The Mayor asked the City Manager to have
this information given to both Councilman Frolich and Councilman Green
so that they could familiarize themselves with the status of this pro-
ject.
Councilman Frolich also said that he had no objection to putting this
issue to a vote and although he was not sure at this moment how he felt
on it himself, he wondered if anyone had figured the investment costs of
the estimated purchase price over the next twenty-five or fifty years, if
it was not going to be developed.

Mayor Stokes said that when he mentioned twenty-five or fifty years, he
did not mean development would be delayed until then. It was his think-
ing that development could take place within the next five-to-ten years
and that the twenty-five to fifty-year figure was still valid, or even
more so than now because all available land would have been used up by
then. He then commented on the possibility of using this property as
income property or turning it over to the use of the Recreation Depart-
ment.
Councilman Green inquired on the possibility of obtaining Federal or
State funds. Mayor Stokes said that the City would try but success was
extremely doubtful. Past experience had indicated the need to proceed
on the basis of not receiving a grant anq should one be made, the then
existing plans could be improved accordingly.
When the question was raised as to giving the appraisals to the owners
or otherwise making them public, Councilman Frolich indicated that a
portion of the City data shown on a front page of the report was out-
dated. Councilman Noel suggested that the City Manager have this infor-
mation brought up to date and corrected by sending an addenda to the
individual councilmen.
Councilman Noel moved, Councilman Frolich seconded, and it was passed
unanimously that copies of the appraisals be forwarded to the owners
after the statistical City data had been updated.
2. Formation of City Council Subcommittees
In answer to a question by the City Manager as to whether or not the
Council wished to review the previously submitted police report, the
Mayor replied in the negative. He said that he had intended to bring
up at the last Council meeting the matter of the need for subcommittees
to review such reports in greater depth. He said the question was not
raised at that time, due to the length of the agenda.
The Mayor said that it was his intention to bring up at the next City
Council meeting the fact that the City has grown to such an extent and
with such complex problems that it prohibits the City Council effectively
working as a five-member committee of the whole. He said it was his
feeling that a definite need existed for the appointment of subcommittees,
consisting of one or two Council members, assisted by City staff or
possibly persons from the citizenry at large. He contended that this
was the only way the City could accomplish certain things, such as the
questions relating to the police department, the potential bond issue,
the revision of the Master Plan, and others. It was not possible to
spend all the time needed to do these programs justice. The }~yor said
that these were only a few of the thoughts he had on this subject and
requested the other Councilmen to think the matter over and present
their ideas at the next Council meeting.
