Snyder moved, and Comm. Small seconded, to review the minutes of the previous meeting at the next regular meeting. AYES: Adamo, Fitzgerald, Leonard, Rampy, Small, Snyder, Frolich NAYS: None 7 for, 0 against III COMMUNICATIONS: A. Written: 1. List of subdivisions recorded in Santa Clara County for July, 1963 2. Agenda for the August 7, 1963, meeting of the Santa Clara County Planning Commission and Board of Zoning Adjustment. 3. Summary of Actions for the July 17, 1963, meeting of County of Santa Clara Planning Commission and Board of Zoning Adjustment. 4. Notice of Public Hearing for rezoning of the Turner property located on the westerly side of Orange Ave. between Granada Ave, and Stevens Creek Blvd. 5. Letter from the Foothill College president, Mr. Calvin C. Flint, requesting information regard- ing contemplated changes in zoning in the vicinity of the De Anza campus. 6. Letter from George Volker to Dr. Charles Knight with copies of the Preliminary General Plan. 7. Tract Number Request by Deep Cliffe Development Co. for Deep Cliffe Estates, Unit No. 3. B. Verbal None IV HEARINGS SCHEDULED: A. BOGDANICH BUILDING CO.: Appl. 86 -Z -63 to rezone 8 acres from R -1: B -D to R -24 -H; adjoining the south side of McClellan Road, east and west of Madrid Rd. Second Hearing. (Annexation in progress.) Attorney Albert J. Ruffo advised the Planning Commission he had contacted city engineers and Ed Stephanie, of the Dept, of Public Works, regarding a variation from 80 to 60 feet on McClellan Road. He stated that it was the developer's intention to build multiples that would appeal to retired people, thereby not creating too much of a -1- traffic problem. He pointed out that this type of development in tnim location would provide a little broader tax basis. Mr. Ruffo further pointed out that if the Commissioners,do not go along with this think- ing, he would like 'to withdraw his application for R -24 -H zoning and change it, instead, to R -1. In discussing the logical routes of traffic, the Commission- ers felt there was a problem as to how the extension of Rae Lane should be handled. There has been no real planning done as yet since is isn't annexed. Commissioner Snyder requested the City Engineer make com- ments as to the availability of access streets. Mr. Shook pointed out that this property is isolated; however, it would have several outlets through Monts. Vista, There is a street heading toward Rae Lane. Commissioner Small quoted from the General Plan, "Higher density residential development has been distributed to larger vacant lands in the Cupertino core area. It is recommended that smaller acreages adjacent to existing low density residential areas be develop- ed in conformance with existing densities." Mr: Ruffo stated this was a correct precept to zoned planning but you must also be concerned with your tax base as well. Commissioner Leonard felt it would be setting a precedent by going into multiple zoning in this area. The area lends itself more favorably to single family dwellings. Commissioner Leonard felt traffic congestion could be al- leviated by a four -lane road on McClellan, east to Highway g; a four - lane road north on Bubb Rd; and /or an interchange at McClellan and the proposed freeway, Chairman Frolich called attention to the Baywood Terrace Homeowners' Association letter, signed by A. C. Barlow, President, protesting the rezoning of the Bagdanich property. This association backed up this letter with a petition containing 234 signatures, There were between 40 and 50 people at this meeting to protest this rezoning application. Mr. Ruffo was the only person who announced he was for it. Mr. Anderson, City Attorney, stated that Mr. Ruffo could add an amendment to his application if he so desired. Comm. Small made the motion that if Mr. Ruffo amends his application to change the zoning from R -1: B -D to R -1: single family, publication will have to be in the papers and it will come up for review at the next regular meeting. Comm. Fitzgerald seconded this motion. AYES: Commissioners: Adamo, Fitzgerald, Leonard, Rampy, NAYS: None Small, Snyder, Frolich 7 for, 0 against B. DUC & ELLIOTT: Appl. 88 -z -63 to rezone 10.5 acres 'from R -1r B -2 to R -1; bounded on the south.-by Stevens Creek Blvd, and on the west by Stevens Creek. First Hearing, continued. Tentative Map - 37 lots (Appl. 27- TM -63). Presentation was made by Mr. Larry Schott, 1003 E1 Camino, Sunnyvale, of MacKay & Somps Engineering Firm. He indicated this con- cerned the front portion of the Davis ranch. Comm. Snyder asked if the construction was going to be similar to the first development and was assured that it was. All storm sewers, outlets, and utilities will be adequate. The Health Dept, says there is a well between lots 29 and 23, which must be seal- ed within their specifications. It was also pointed out the irrigation line must be relocated. It was suggested the developer could have just as many, but smaller, lots and then dedicate land to further our park system. Mr. Schott did not feel this was feasible because of the small parcel -2- of land involved. It would then make it necessary to obtain variances from the city for a few of the homes which don't have as large lots as the rest. Comm. Adamo wondered if anything had been done previously about a park along this line. Comm. Fitzgerald stated nothing has been done previously, and he felt this would create a hardship for the developer. Comm. Snyder asked if Pharlap Drive at Stevens Creek Road would have traffic problems. Mr. Schott stated he would like to work this out with the En .-sneering Department. Comm. Fitzgerald asked if Stevens Creek would be improved at this point. The Engineering Dept, indicated it would. Comm. Snyder made the following motion: "Whereas, the Planning Commission feels that the proposed use is suitable for this area, now, therefore, let it be resolved that the Planning Commission recommend approval of;the zoning request for Application 88 -z -63, subject to the following conditions: 1 through 12 of standard city conditions (Exhibit B) 13, that fencing be constructed along Stevens Creek Road, subject to the approval of the H Control Committee." Mr. Small seconded the motion. AYES: Commissioners: Adamo, Fitzgerald, Leonard, Rampy Small, Snyder, Frolich NAYS: None 7 for, 0 against Comm. Fitzgerald moved to continue the first Hearing on the tentative map, and asked for a staff report on the Stevens Creek improvements. Motion was seconded by Comm. Leonard. AYES: Commissioners: Adamo, Fitzgerald, Leonard, Rampy, Small, Snyder, Frolich NAYS: None 7 for, 0 against C. GEORGE YAMAOKA: Appl. 89 -z -63 to rezone 7.85 acres from A -2: B -4 to R -3 -H; on the south side of Lucille between Blaney Avenue and Randy Lane. First Hearing continued. City Attorney Anderson stated that R -3 would be out of order. Applicant must check into R -24. The project can't be built because of the private streets involved. Comm. Leonard made a motion to continue this Hearing at the next regular Planning Commission meeting. Comm. Fitzgerald seconded. LOUIS A PAGANINI: Appl. 80 -Z -63 to rezone 22 acres from R -1: B -2 to R -24 -H (15 acres) and P -OH (7 acres); approximately 500' south of Stevens Creek Blvd, opposite Portal. First Hearing. Comm. Small asked to be excused from this particular hearing. Mr. Irving Castor, Designer, made the presentation. The developer's plan calls for 199 units, with 199 covered spaces and better than half that many uncovered spaces. The price range will be between $20,000 and $25,000, with 25% down payment with conventional financing. -3- Comm. Snyder brought up the fact that the Planning Con- sultant is recommending that the city acquire land adjoining schools and develop them into parks. Comm. Fitzgerald stated he was in favor, if the city has the money to pay for it. Comm. Adamo felt that something should be set aside for parks, and Comm. Snyder felt it would be quite feasible to set aside about five acres on option for the city to purchase. Chairman Frolich suggested the developer discuss this poss- ibility of using a small parcel of subject land for a park. Comm. Leonard pointed out the Idlewild developers solved the flood control problem but did not solve the park situation in that area. Mr. Castor stated that Mr. Parsley would pave and improve the full width of Prive Avenue if Cupertino would obtain dedication of the land. Mr. Nick Kuhn, 10225 Richwood Drive, Cupertino, pointed out that the carports of the proposed plan are very close to residences on Richwood Drive and that if split level construction was utilized, the privacy of the back yards of these residences would be seriously im- paired. Mr. Kuhn also pointed out that the proposed plan shows the traffic would have trouble getting onto Stevens Creek Blvd. Idlewild Homeowners' Association President, Mr. Gary Stokes, 10199 Richwood Drive, Cupertino, pointed out the traffic problems, the school problems, and that the plan showed too much commercial use of the land. Comm. Fitzgerald asked Mr. Stokes if this was any im- provement over the previous application. Mr. Stokes replied that it was not. Mr. John Parsley, 3359 Lynn Oaks Drive, Cupertino, asked if he could still have split level homes if it went R -1. Answer was yes. Regarding the financing of these homes, Betty Parsley, 3359 Lynn Oaks Drive, Cupertino, pointed out the regulation that the minimum down payment of 3% only goes to $13,000, and that the normal down payments would run in excess of $2,000. She felt that people willing to put this amount down on a home could not be classed as transient. Mr. David Lange, 1335 Phelps, Palo Alto, stated that statistics prove that the national average ownership on homes is six and one -half years. Chairman Frolich noted that the audience contained fourteen against this application and ten in favor -- six of them being the principals in the case. Comm. Leonard made the motion this first Hearing be closed. Comm. Rampy seconded. AYES: Commissioners: Adamo, Fitzgerald, Leonard, Rampy, Snyder, Frolich NAYS: None ABSENT: Commissioner Small 6 for, 0 against E. ELL VEE CONSTRUCTION CO.: Appl. 91 -Z -63 to rezone 34 acres from A to R -24 -H; bounded on the north by Stevens Creek Blvd., on the east by the lands of Foothill Col- lege, on the south by McClellan Road and on the west by the Southern Pacific Railroad. First Hearing. Presentation was made by Mr. Ned H. Abrams, Architect. The proposed plan shows about 400 units, with twelve to the acre. It would cont-in 5-1/2 acres of parko. There will be 61 two -- bedroom units and the remainder would be three - bedroom. 'There will be park- ing under the buildings and the units would be individually owned. The owners will belong to an association which will be responsible for maintaining the park area. -4- Attorney Anderson offered the information that the railroad on the west boundary is the Permanente spur and will be permanent. Comm. Leonard asked what the feasibility of light industrial zoning in this area mi -ht be. Comm. Small stated the junior college is opposed to industrial zoning near the college. Chairman Frolich stated he would like the Commission to have a meeting with the junior college officers regarding management of financing. To Comm. Adamo's question about price range of the proposed units, Mr. Abrams indicated they would run in the low $20,000's. Chairman Frolich requested the City EngineerinZ Dept, check into the parcel of land earmarked for a corporation yard. Comm. Snyder requested an inventory of existing multiple zoning and the proposed multiple zoning. Mr. A. C. Barlow, 21739 Terrace Drive, Cupertino, cited the inevitable traffic problems, to which Comm. Fitzgerald stated this par- cel of land could go to San Jose and they could put 1200 people there. Comm. Leonard commented that this parcel of land is under process of annexation by Cupertino now. Mr. Ray Vandervere, 7910 September Drive, San Jose, wondered when it would be decided if this area were to go light industrial. It was pointed out it will go before the Council sometime in October. Mr. L. V. Saylor, 1163 El Camino, Sunnyvale, stated he would like to put multiples on this property. Comm. Fitzgerald moved the first Hearing be closed. Comm. Adamo seconded.
