I SALUTE TO THE FLAG II ROLL CALL: Commissioners present: Adamo, Fitzgerald, Rampy, Small, Snyder, Thomson, Frolich Staff present: City Attorney, Assistant City Engineer MINUTES OF THE PREVIOUS MEETINGS: 12/9 and 16/196ni Corrections for the December 9th minutes: Comm. Adamo had a correction for Pg. 6, Para. 10, stating that the correct spelling is Mrs. Henrietta Marcotte. Chairman Frolich offered the following corrections to the minutes of December 9th: Pg. 6, Para. 4, the correct spell- ing "i: "Mr.Ray Bowdle. Same page, Para. 11, the 5th word from the end of the sentence should be spelled "assessed." On Pg. 8, Para. 7, the City Attorney also stated that the bond should probably be a long -term one; it must be renewed each year. Comm. Snyder moved the minutes be approved as corrected. Motion was seconded by Comm. Rampy. Motion carried, 7 -0 III COMMUNICATIONS: A. Written: (1) The Assistant City Engineer presented a tentative map from the County of the Lands located at the end of Lindy Lane, just outside the city limits. (2) Newsletter of the American Society of Planning Officials. B. Verbal Chairman Frolich asked if anyone in the audience had any communications that were not related to applications on the agenda. There were none. Comm. Rampy moved the communications be received and filed. Motion seconded by Comm. Snyder. Motion carried, 7 -0 IV HEARINGS SCHEDULED: A. GENERAL PLAN FOR CUPERTINO: Second Hearing. -1- Mr. George Gatter, of Wilsey, Ham and Blair, presented the slightly altered map to the Commission and the audience. He indicated the area adjacent to the junior college site is no longer earmarked for industrial use. The other change is that another park has been indicated near one of the junior high schools. Comm. Fitzgerald asked if Mr. Gatter's firm planned to have any Public Hearings on the zoning map? Mr. Gatter said this was not within the scope of the contractural agreement; however, they did plan to have numerous discussions with the Planning Commission on it. He added that under a new agreement they could come back and help with the Public Hearings. Comm. Small stated he has heard comments around town on the plan regarding lightdensity around Stevens Creek Blvd. Mr. Gatter explained that just because an area shows light density on the map at a specific point does not mean that is exactly where it should be; rather, it indicates how that whole area should balance out. Mr. Ray Schoenfeld, also with Wilsey, Ham and Blair, stated that low density means 3 to 7 families per acre; medium density means 9 to 10 families to the acre; and medium -high density indicates 12.5 families per acre. Chairman Frolich felt something should be worked out be- tween the staff and the consultants to enable them to assist on the Public Hearings of the zoning map. He also felt that the density should not be raised, but perhaps it should be lowered. He felt his obligation is to the citizens who already live in Cupertino. Chairman Frolich asked if there were additional comments from the Commission. There were none. He then asked for comments from the audience. Mr. K. Engleson, P.O. Box 303, Cupertino, explained that he was a resident of Los Gatos but nevertheless wanted to com- ment on a few points of interest. lie referred to the Thursday, December 12th issue of the Mercury -News, article entitled, "Apartment Dwellers Pay Their Way." He said he was in favor of multiples. He also felt that perhaps in 20 years Monta Vista will be ready for urban renewal. Mr. Engleson stated that it was wishful thinking to expect industry to come to Vallco. Chairman Frolich stated that R -1 does not pay their way and he is not convinced that multiples pay their way. Comm. Thomson felt that the multiples in this area seem to carry quite a few children, and when you start filling in an area with multiples you increase the amount of services needed -- more recreation, fire and police protection, etc. It is certainly not all "gravy." Mr. Noor Billawala, of Coastal Valley Development Company, P.O. Box 656, Cupertino, wanted to know what this proposed map encompasses. Mr. Gatter explained it was a 20 -year schematic or plan, whereas zoning is a short -term plan. He added that the red dots were schematic indications of the commercial needs within a given area. Mr. Billawala wanted to know if this plan would prevent strip commercial development. Mr. Gatter said it would not. Comm. Snyder felt the existing and proposed zoning should be considered in the future zoning map. -2- Mr. Joseph Sparagna, 10415 Plum Tree Lane, Cupertino, wanted to know what the Planners' criteria was in placing parks per density. Mr. Schoenfeld stated that the California Re- creation Department recommended 6.5 acres per thousand. Comm. Thomson felt the city needs a general plan of some kind and this plan does not seem so bad that it cannot be used as a guide to follow. The City Attorney gave a few words of caution at this time. He said the Planning Commission should probably have a study session before sending it on to the Council level. There has already been an investment of about $30,000 and it would not be provident to rush it in order to meet a dead- line. He felt each Commissioner would probably wish to offer his comments and /or amendments, but the first step would be to close the Second Hearing. Comm. Snyder moved to close the Second Hearing. Comm. Rampy seconded the motion. AYES: Comm.: Adamo, Fitzgerald, Rampy, Small, Snyder, Thomson, Frolich NAYS: None Motion carried, 7 -0 The City Attorney felt that each of the Commissioners could offer motions and the City Staff could prepare a Resolution based on these motions. Comm. Snyder moved to use the Proposed General Plan as an attachment to the General Plan, with the condition that the gross density on the legend be changed to net density. Comm. Adamo seconded the motion.. AYES: Comm.: Adamo, Fitzgerald, Rampy, Small, Snyder, Thomson, Frolich NAYS: None Motion carried, 7 -0 Comm. Snyder moved that there be no increase in the pre- sently indicated densities. Comm. Fitzgerald seconded. AYES: Comm.: Adamo, Fitzgerald, Rampy, Small, Snyder, Thomson, Frolich NAYS: None Motion carried, 7 -0 Comm. Fitzgerald moved to have the red dots eliminated from the map. Motion died for lack of a second. Comm. Fitzgerald offered the information that as per this evening's newspaper, the railroad is to remain. Comm. Snyder moved to recommend approval of the General Plan and that the staff be instructed to draw up a Resolu- tion indicating the adopted conditions of tonight's meet- ing and including the map as an attachment. Motion seconded by Comm. Rampy. AYES: Comm.: Adamo, Fitzgerald, Rampy, Small, Snyder, Thomson, Frolich NAYS: None Motion carried, 7 -0 -3- Comm. Fitzgerald moved this Resolution be continued to the next regular meeting. Comm. Small seconded. DURA -STYLE HOMES, INC.: Appl. 102 -Z -63 to rezone 35 acres from R -1:13-2 to R -24 -11; east side of Foothill Blvd. and south side of Hartman Drive. Second Hearing. Comm. Small stated that sooner or later we are going to have to accept this concept of town house development. He stated he had recently seen a film entitled New Concepts in Land Planning, ' and expressed a desire for the whole Commission to see it. He felt a study session was in order before any decisions were made. Comm. Small moved to continue this application at the next regular meeting. Comm. Rampy seconded the motion. Motion carried, 7--0 C. ITSUO UENAKA: Appl. 104 -Z -63 to rezone 3 acres from R -1:13-2 and R -3 to M -1 -11; west side of Highway 9, 240' south of Mariani Avenue. First Hearing. D. ITSUO UENAKA: Appl. 105 -Z -63 to rezone 3 acres from R -1:13-2 to R -3 -H; east end of Dunbar Drive. First Hearing. It was decided to take both C and D under consideration at the same time. Mr. Uenaka stated his reason for the appli- cations was to make the zoning conform with the existing use of the land. (Cupertino Nursery) The City Attorney felt it would be in order for the appli- cant to state his reason for requesting M - -1 -H zoning. Mr. Uenaka stated that it was his understanding this would be proper use of the land since we do not have C -2 zoning. Chairman Frolich asked if it would inconvenience Mr. Uenaka to wait until after the General Plan and zoning are approved. The City Attorney stated there should be a staff report as to what specific zoning this use should come under. Comm. Snyder asked if Mr. Uenaka was planning to expand or improve his property at this time. Mr. Uenaka stated he was planning this, but not immediately. Ile said he would be willing to wait, but that he has already waited 12 years on his C -2 application. Comm. Thomson moved to continue applications 104 -Z -63 and 105 -z -63 until the first meeting in March. Comm. Small seconded the motion. Comm. Thomson amended the motion to have the City Staff handle the publication of the notice, due to the length of time until this Hearing. Comm. Small seconded the motion. AYES: Comm.: Adamo, Fitzgerald, Rampy, Small, Snyder, Thomson, Frolich NAYS: None Motion carried, 7 -0 Comm. Snyder requested the staff submit a report on whether or not M -1 -H is the suitable category under the present use of Mr. Uenaka's property. Comm. Snyder later withdrew this motion. -4- The City Attorney stated, "We cannot have a revolution -- rather an evolution in the zoning of the City." E. PAUL MARIANI, ET AL: Appl. 106 - 110 -z -63 to rezone ap- proximately 114.5 acres from A- 2:B -4, R- 1:B -2, R - -1 and R -3 -H to PC -H and C -1 -11; east and west of Highway 9, north and south of Mariani Avenue. First Hearing. Mr. Mariani felt there were 3 major factors involved in the location of a commercial development: 1) location of popu- lation, 2) access, and 3) location of competing shopping centers. He stated that he was here at the express request of the City Council to re- request rezoning. He felt their original request was not wrong - possibly it was premature. In April, 1961, the City was conservative in its projections. Mr. Mariani stated that west of Highway 9, the original plan was to have a professional development such as Western Electric, which they lost. The thinking now is to devote a large portion of the property to high- density multiples - perhaps some high rise. He stated that it was necessary for the neighbors to get together on this rezoning application in order to qualify for PC -H zoning. Comm. Small moved the Planning Commission include the 100 acres on the one side of the freeway and the 10 acres on the other side of the freeway as one parcel. Comm. Rampy seconded. AYES: Comm.: Adamo, Fitzgerald, Rampy, Small, Snyder, Thomson, Frolich NAYS: None Motion carried, 7 -0 Comm. Thomson asked the applicant if it was not necessary to state his proposed use of the property to the Commission. Mr. Mariani said he was looking to the Commission for coun- sel at this time. He said they purposely stayed away from hypothetical pictures when they really don't know as yet what is going to go where. Mr. Mariani wanted to know about the Ordinance regarding high rise. The City Attorney stated it was decided as the applications came up. Comm. Fitzgerald advised the applicant to go through the checklist of the PC -H requirements. He requested a report from the staff to this effect. Comm. Small moved to close the First Hearing. Comm. Thomson seconded the motion. AYES: Comm.: Adamo, Fitzgerald, Rampy, Small, Snyder, Thomson, Frolich NAYS: None Motion carried, 7 -0 Comm. Small moved to continue to the next Hearing a report from the staff regarding the applicant's meeting the requirements of the checklist. Comm. Thomson seconded. AYES: Comm.: Adamo, Fitzgerald, Rampy, Small, Snyder, Thomson, Frolich NAYS: None Motion carried, 7 -0 Chairman Frolich called for a 5 -- minute break. He asked that Vice - Chairman Fitzgerald take over the meeting since he was becoming quite ill. ­5- u F. SMILIN' BILL'S FURNITURE CO.: Appl. 111 -Z -63 to rezone 2 acres from R -1:B -2 and R -3 -H to C -1 -H; north side of Stevens Creek Blvd., 120' west of Portal Avenue. First Hearing. Mr. William Scilacci, stating that he was the senior partner in the business, presented plans for a concrete block build- ing. He stated there would be no air conditioning - -- that there will be a manually- operated exhaust fan to be turned on at the close of each day and the air will then be com- fortable by morning. Comm. Thomson asked where the sign would be. Mr. Scilacci stated it will be a free - standing sign in the middle of the parking lot. Comm. Small felt the City of Cupertino is in need of a furni- ture store and this seemed to be a beautiful building, but he stated he was against pink polka dots, signs plastered all over the windows, etc. Mr. Scilacci said they have upgraded from their downtown San Jose store. Comm. Small told Mr. Scilacci that the H- Control will ask for landscaping and no appurtenances on the roof. He also recommended air conditioning. Mr. Scilacci stated they were prepared to start building this spring if it is approved. Vice- Chairman Fitzgerald asked if there were any comments from the audience. There were none. Comm. Small moved the First Hearing be closed. Comm. Thomson seconded the motion. Motion carried, 6--0 G. ALLEN L. CHADWICK: The Assistant City Engineer said the applicant requested postponement on his application until January 13th. Comm. Adamo moved to continue Application 46 -V -63 to January 13th. Comm. Small seconded the motion. AYES: Comm.: Adamo, Rampy, Small, Snyder, Thomson, Fitzgerald NAYS: None ABSENT: Comm. Frolich Motion carried, 6 -0 UNFINISHED BUSINESS A. Miscellaneous - -- There was none. B. Ordinance 002(q) AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING ORDINANCE, NO. 002 AS AMENDED BY ESTABLISHING REQUIREMENTS FOR OFF- STREET PARKING WITHIN THE CITY. Returned by City Council. The City Attorney stated he had been instructed to ask the Planning Commission to delete from Section 3:3 the last sentence, beginning with the word "No" and ending with the word "garage," since it was the feeling of the staff that this creates some control over private property that we have neither the staff nor the police to enforce. -6- Mr. Burrell Leonard, appearing for Vallco, asked if it would be possible to defer the residential portion of this Ordinance but get on with the non - residential, non - controversial portion of the Ordinance. Comm. Small moved to delete from Section 3:3 the last sen- tence beginning with the word "No" and ending with the word Agarage." Comm. Rampy seconded the motion. AYES: Comm.: Adamo, Rampy, Small, Snyder, Thomson, Fitzgerald, NAYS: None ABSENT: Comm. Frolich Motion carried, 6 -0 Comm. Small moved a letter be sent by the staff to the Associated Home Builders and Contractors, 345 Saratoga Avenue, Santa Clara, reflecting the above motion. Comm. Snyder seconded the motion.
