SECOND WORK SESSION ON PROPOSED ZONING ORDINANCE, APRIL 7, 1964

It was decided that the best way to begin would be to start at
the beginning of the PROPOSED ZONING ORDINANCE (First Draft), page
by page, and to comment on any items as they come to them.
Mr. Schoenfeld stated that the first two sections were fairly
standard so they began with Section 3, DEFINITIONS.
Sec. 3.2 Accessory Use or Structure. Mr. Schoenfeld explained_
this referred to such structures as tool sheds, garages, etc.
Sec. 3.4 Agriculture. Comm. Adamo wondered if the Ca111 Feed
Company would come under this. It was decided it would not.
Sec. 3.7. Apartment. It was decided to change the word
multi - family on line 1 to multiple- family.
Sec. 3.8. Apartment, Garden Multi- family on line 1 is to be
changed to multiple family.
Chairman Frolich asked the consultant what distinguishes a
garden apartment from a regular apartment development. The consul-
tant said it has more than average garden space, is a low rise, low
density type structure.
Section 3.12 Basement. Upon the recommendation of the Chief
Building Inspector, it was decided to change the 5 feet on the last
line of the paragraph to 6 feet.
Section 3.13 Beginning Construction. The question was raised
as to how to determine at what point construction is actually begun.
The consultant explained that the land can be prepared, the forms
can be put in, but the cement cannot be poured until they have
obtained a building permit.

Section 3.17 Building, Accessory. The Chief Building
Inspector clarified this as any structure that a human can have
access to.
Section 3.18 Building, He -lZht of. T're Chief Building Inspec-
tor said he had no objection to this section.
Section 3.25 D_well_in_, Multiple. Comm. Adamo wanted it clari-
fied whether or not this included duplexes. It did not.
Section 3.27 Dwelling, Two Family. Comm. Adamo wanted to know
what happens when half of a two - family dwelling is used for commercial
purposes and half for living. The consultant said a mixed use is
possible.
Section 3.34 Garage, Public. It was decided that this defini-
tion is unclear and is to be reworked by the Consultant.
Section 3.35 Garage, Private. The subject of leasing will be
decided upon at a later date.
Section 3.40 Home Occupation. Under (e), the last line should
read, "only within an enclosed structure upon the premises."
A Use Permit should be tied into this
definition.
Section 3.56. Nursing Home. The Consultant indicated he
wanted to check into this section before it is passed.
Section 3.70 Sign, Area of. The last word on page -16- should
be changed from "the o TT7
Section 3.71 Site, Building. Chairman Frolich asked the Con-
sultant what the difference between a lot and a building site was.
After delving into this, it was decided this section should be
reworked.
Section 3.74 Story, First Change 12 to 24 and 5 to 6.
Section 3.77 Subdivision Ordinance. It was decided the Con-
sultant should check out the Subdivision Ordinance for any possible
discrepancies.
Section 3.86 Yard, Front. The next to the last line on page
-19- should read as follows, "provided, however, that if the pro-
posed right of way is greater than that of the existing street, the
front yard...."
Comm. Snyder felt a Table of Contents is needed. The other
Commissioners agreed.
Since Mr. Worcester had to leave early, Mr. Leonard stated that
Mr. Worcester is very much interested in the following items in the
Proposed Zoning Ordinance: R & D, LM, PC, LI Park, Section 17 on
page 50 - 52a,M1H, Section 17 height requirements, Section 18, and
the "Line of Sight" approach. He emphasized how experts in their
fields had worked out the buffering and building height limitation
formula at Vallco Park and he felt it would be a gross mistake if
Cupertino did not heed the existing ordinances.

Mr. Leonard commended the Consultant on his Section 3,
Definitions, saying that he has felt for a long time that this was
needed. He said he has been doing a little homework and has come
up with some additional words to add to this list, if they wanted them.
He also had suggestions for the "open" sections in the Proposed
Zoning Ordinance: Section 7 -- Garden Apartments, etc.; Section 11 --
Multiples; Section 15 -- Commercial.
On page 49, Section 16.5, Mr. Leonard did not feel this section
followed the pattern of the other sections.
