Kambiz Zomorrodi and Sima Khorshidian, husband and wife as community property with
right of survivorship, (GRANTORS) hereby irrevocably offers to dedicate in fee to the CITY
OF CUPERTINO, a California municipal corporation ("CITY"), for public purposes including,
but not limited to roadway, sidewalk, public utility and any other public purpose, together with
the right to construct, repair, operate, and maintain any and all public utilities and improvements
in, on, under, along and across the real property which shall be or become necessary for
preservation of the public safety, welfare or convenience, the real property described in Exhibit A
and shown in Exhibit B, which is situated in the City of Cupertino, County of Santa Clara, State
of California.
The dedication is not accepted by the CITY at this time. The CITY reserves the ability to accept
all or part of the dedication at a later date, pursuant to Section 7050 of the Government Code of
the State of California, or any other relevant provision oflaw.
Until such dedication is accepted and is recorded by the CITY, CITY shall not be responsible for
and shall incur no liability with respect to such offered right-of-way or any improvement thereon
or any maintenance thereof, nor shall this offer in any way alter the present status of the
described right-of-way as essentially private property until such time as the CITY formally
accepts such dedication .
It is also hereby understood and agreed by the GRANTORS that any improvements hereinafter
placed in the above described property shall be removed without cost or expense to the CITY at
such time when the CITY accepts the dedication offered. The CITY may accept the dedication
without any further action by, notice or payment of any kind to GRANTO RS.
This offer of dedication shall be irrevocable and shall be binding on the Grantor(s), heirs ,
executors, administrators, successors, and assigns .
