Description
Exceptions to the R1 ordinance for a second-story addition that results in the
second story exceeding 35% of the first story area, visible second story walls and
second story wall offsets.
Action
The Design Review Committee approved the application on a 2-0 vote. This is
effective October 27, 2004. The fourteen-calendar day appeal will expire on
November 10, 2004.

Proiect Description: Exceptions to the R1 Ordinance for a second-story addition that results in
the second story exceeding 35% of the first story area, visible second story walls and second
story wall offsets.
RECOMMENDATION:
Staff recommends that the Design Review Committee take the following action:
1. Approve R-2004-37 subject to the model resolution.
BACKGROUND
The applicant (Thomas Liu) is repairing fire damage to an existing two-story house built in the
1960s. As part of the work, the applicant is proposing to add a walk-in closet (100 sq. ft.) by
enclosing an existing second story deck area. An exception is required since the existing
second story is already 67% of the ground floor and the proposed second story walk-in closet
addition will result in a 72% second story vs. ground floor ratio.
DISCUSSION
Staff supports the exceptions since the addition will not be visible from the neighbor to the
south and from the street. There will not be any adverse visual impacts from the addition to
the rear since the neighboring property to the rear is significantly higher in grade. The
neighbor to the north will see the closet addition. However, since the addition is over the
existing building footprint and it actually reduces the size of the existing second story deck,
there will not be any significant visual impacts.
Staff believes the project satisfies the required approval findings:
1. That the literal enforcement of the provisions of this title will result in restrictions
inconsistent with the spirit and intent of this title.
. The purpose of the zoning ordinance sections 19.28.060B(3), 19.28.060E(5)(a) and (b) are
to mitigate massive second story walls and to ensure that that second story walls are
articulated. In staff's judgment, the limited visibility of the addition does not warrant
the literal enforcement of these rules.
2. That the approval of the exceptions will not result in a condition that is materially
detrimental to the public health, safety, or welfare.
. The proposed project is an allowed use and is not out of scale with the surrounding
neighborhood in terms of setbacks, height, mass, style, and design.

3. That the exceptions to be granted are ones that will require the least modification of the
prescribed regulations and the minimum variance that will accomplish the purpose.
. The proposed second floor addition is occurring over an existing footprint and is
actually decreasing the size of an existing second story deck. The addition also is
consistent with the style and design of the existing house.
4. The proposed exception will not result in significant visual impact as viewed from
abutting properties.
. The addition will not result in adverse visual impacts to the abutting properties.

inconsistent with the spirit and intent of this chapter;
2. The granting of this exception will not result in a condition that is materially
detrimental to the public health, safety and welfare;
3. The exception granted is one that will require the least modification of the prescribed
design regulation and the minimum variance that will accomplish the purpose;
4. The proposed exception will not result in significant visual impact as viewed from
abutting properties.

That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the design review application is hereby approved subject to the
conditions which are enumerated in this Resolution beginning on page 2 thereof; and

regard to the proposed project for additional conditions and requirements. Any
misrepresentation of any submitted data may invalidate an approval by the Design
Review Committee.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other
exactions. You are hereby further notified that the 90-day approval period in which you
may protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-
