Scheduled for the Planning Commission meeting on September 27.2004. ORAL COMMUNICATION: None CONSENT CALENDAR: 1. Application: Applicant: Location: EXC-2004-13 Elephant Bar Restaurant 19780 Stevens Creek Boulevard Sign Exception to allow wall signs that exceed 24 inches in height and to utilize exposed neon. 2 Design Review Committee September 15,2004 Design Review Committee decision final unless appealed. Request removal from calendar. Scheduled for the Planning Commission meeting on September 27, 2004. 2. Application: Applicant: Location: DIR-2004-19 Danny Lee 10078 Santa Clara Avenue Director's Minor Modification of a use permit (U-2004-07) to review minor architectural changes. Design Review Committee decision final unless appealed. Chairperson Wong removed the item from the consent calendar to ask if staff was comfortable with the setbacks. Application: Applicant: Location: R-2004-16 George Dayeh (Balde residence) 10775 Stevens Canyon Road Residential Design Review of a second story deck exception for a new 3,050 square foot, two-story residence. Design Review Committee decision final unless appealed. Staff Presentation: Gary Chao, Assistant Planner, described the project. Staff was concerned with the design and the size of the larger deck above the garage. The architectural consultant has reviewed the plans and has provided two alternatives and staff recommends that option #1 be adopted as part of the approval. The applicant is aware of the recommendation and has chosen not to revise the plans. The applicant will submit a final landscape plan for review and approval prior to building permit issuance to address and show privacy protection. j Design Revi.ew Committee September 15,2004 Commissioner Miller asked Mr. -Chao about the differences between option #1 and option #2. Discussion continued about the differences. Chairperson Wong asked if there were any exceptions relating to the flag lot. Mr. Balde, applicant, stated that he would like to have deck above the garage. Mr. Balde drove through the neighborhood and located many decks similar to his. Discussion continued regarding the deck. Dean Sayre, 10805 Stevens Canyon Road, was concerned about the size of the lot and did not know where the house and driveway was going to be located. Eric Carlson and Jaime Shkolnik, 10741 Santa Lucia Road, was concerned about privacy in his backyard and the general slope and grade of the lot. Mr. Chao explained why story poles were not required and stated that retaining walls will be looked at prior to building permit issuance. Mr. Chao also talked about privacy protection. Discussion continued regarding the driveway and slope. Bruce Wenniger, 10298 Mann Drive, suggested that the City Planning Department send plan sets to the adjacent neighbors. Application No.: Applicant: Location: R-2004-23 Duk Lee (Sung Lee residence) 10303 Scenic Drive Residential Design Review of a 2,477 square foot first and second story addition, and exception for the second story to exceed 35% of the first story, and a second story rear deck exception, for a total house size of 4,123 square feet. Design Review Committee decision final unless appealed 4 Design Review Committee September 15, 2004 Staff Presentation: Mr. Chao briefly described the project. A landscape plan shall be submitted and approved prior to building permit issuance. Staff recommends approval. Duk Lee, designer, stated that the applicant would like to have at least 3 bedrooms upstairs for family. MOTION: SECOND: ABSENT: ABSTAIN: VOTE: Commissioner Miller moved to approve R-2004-23. Application No.: Applicant: Location: R-2004-26 Daren Shue 10485 Scenic Boulevard Residential Design Review of a new two-story 4,487 square foot residence and second story deck exception. Design Review Committee decision final unless appealed Staff Presentation: Mr. Chao described the project and stated that the applicant is required to plant privacy protection trees to screen all second-story windows. Four Oak trees are being requested for removal. The City Arborist has reviewed the plans and stated that with the correct protection measures the trees may be preserved. The applicant is required to comply with the recommended tree protection measures outlined in the arborist's report. Tree #10 on the adjacent property will be removed. A letter of concern was received by the Planning Department from Mary Reese, 10491 Scenic Boulevard. She was concerned about the 3-car facing the ingress/egress easement and the 20-foot driveway easement was not wide enough to provide sufficient back up distance from the garage. Ms. Reese was also concerned that the driveway was not capable for supporting guests, creating a parking issue. Mr. Chao discussed the concerns in Ms. Reese's letter. Staff recommends approval. Daren Shue, applicant, described the property and the easements. Terry Brown, 21833 Grenada Avenue, stated that he was speaking on behalf of Mary Reese. Mr. Brown stated that he originally did the lot line adjustment for the original owner of the property. He does not agree with the 21-foot back-up space. Mr. Brown showed some photographs, including tree #9. compatible with the neighborhood. Greg Richmond, 10495 Scenic Boulevard, stated that other than the issue of the driveway, he likes the design and style of the house. The plans he reviewed still showed the driveway to the far right when you are looking up from the street. He believes that tree #9 needs to be saved and #10 removed. Discussion continued regarding the driveway, retaining wall and compatibility. Mr. Brown talked about the retaining wall. Mr. Shue stated that there are a lot of ways to make the easement look nice. Privacy protection trees are required along some areas of the right property line to screen views. The applicant will submit a final landscape plan for review and approval prior to building permit issuance. Staff recommends approval. Discussion continued regarding privacy protection.
