Description
Rl exception to allow a second story addition that will cause the second story
area to be more than 35% of the first story area and Minor Modification to R-

Action
The Design Review Committee approved the application on a 2-0 vote. This is
effective October 13, 2004. The fourteen-calendar day appeal will expire on
October 27, 2004.

Proiect Description: Exception to the Rl Ordinance to allow a second story addition that will
cause the second story to be more than 35% of the first story area and a minor modification to
the approved plans in R-2001-02.
RECOMMENDATION:
Staff recommends that the Design Review Committee:
1. Approve R-2004-33, subject to the model resolution;
2. Approve DIR-2004-24, subject to the model resolution.
BACKGROUND
On March 14, 2001, the Design Review Committee approved a new two-story residence with
a floor area ratio of about 43% on the subject site. The applicant seeks to add a minor
addition to the second story, requiring two approvals: (1) an exception for a second-story that
is greater than 35% of the first story, and (2) a minor modification to the approved plans from
2001.
DISCUSSION
The addition will allow for an expanded master bedroom with a large walk-in-closet. The
existing bedroom has a small walk-in-closet that will be incorporated into the master
bathroom.
Privacy
Two new second-story windows are proposed. The first is in the master bedroom and faces
the rear of the lot. Existing privacy planting will screen views from this window. A second
smaller window is proposed in the walk-in-closet, but the plate height of this window is five
feet so privacy planting is not required. If the window were enlarged such that it had less
than a five-foot plate height, this would not be a problem because privacy shrubs were .
already planted along the side property line. Unless an affected neighbor indicates that the
current privacy planting is not healthy, staff would not recommend more privacy planting
under any circumstance.
Articulation
With the proposed addition, the rear elevation will not have much articulation. Had this
project been for the entire house instead of the addition, staff would have requested wall
articulation on the rear and side of the house. However, since the second-story exists and
was approved in 2001, no such modification was requested.

Mass
Any second-story addition will increase the mass of a two-story house. The story poles
illustrate that the addition is nearly invisible when viewed from Camino Vista. The mass of
the first story and the presence of a large tree in the front yard substantially blocks any view
of the addition.
The addition will be visible from adjacent properties. Since the wall lines and roof eaves of
the addition match the existing house, the visual impact should be negligible.
In summary, staff believes that the increase in mass has been minimized to the maximum
extent possible based on the size and location of the addition.
Roof Attachment
While visiting the site, staff observed a first level roof-cover attached to the right side of the
house. This roof-cover is not permitted in the side setback area and should be removed.

WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Design Review Committee has held one or more
public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application;
and has satisfied the following requirements:
1. The literal enforcement of the provisions of this chapter will result in restrictions
inconsistent with the spirit and intent of this chapter;
2. The granting of this exception will not result in a condition that is materially
detrimental to the public health, safety and welfare;
3. The exception granted is one that will require the least modification of the prescribed
design regulation and the minimum variance that will accomplish the purpose;
4. The proposed exception will not result in significant visual impact as viewed from
abutting properties.
5. The proposed modification to Design Review Committee Resolution No. 34 does not
cause a significant increase in the mass and bulk of the original plan set.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the design review application is hereby approved subject to the
conditions which are enumerated in this Resolution beginning on page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution
are based and contained in the public hearing record concerning Application R-2004-33 and
DIR-2004-24 set forth in the Minutes of the Design Review Committee meeting of, October 13,
2004, and are incorporated by reference as though fully set forth herein.

All prior conditions of approval for R-2001-02, set forward in Design Review Committee
Resolution No. 34, remain applicable.
3. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/ or agencies with
regard to the proposed project for additional conditions and requirements. Any
misrepresentation of any submitted data may invalidate an approval by the Design
Review Committee.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other
exactions. You are hereby further notified that the 90-day approval period in which you
