RESOLUTION NO. 04-383
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ADOPTING POLICIES AND PROCEDURES FOR INSTALLING DONOR
ARTIFACTS IN CITY FACILITIES
WHEREAS, the City Council has determined that there is a need for policies and
procedures for the installation of donor artifacts in City facilities.
NOW, THEREFORE, BE IT RESOLVED:
1.
That the following policies and procedures are hereby adopted.

Policy and Procedure
Purpose
The purpose of this document is to define the policies, procedures, and
responsibilities associated with the installation of donor artifacts in City facilities,
structures, buildings, parks, equipment or furnishings, or any portion thereof.
Policy Guidelines
1. Only the authorized foundations of the pubic school districts of Foothill- De
Anza Community College, Cupertino Union, and Fremont Union High shall be
allowed to install donor artifacts in City facilities.
2. The installation of donor artifacts shall be limited to Cali Mill Plaza and the City
will have exclusive right to determine what space in the plaza is available and will
direct and approve the appearance and specifications of any and each donor
artifact.
3. The public school entity shall bear all costs associated with the installation of
donor artifacts, including but not limited to, design, fabrication, demolition,
installation, cleanup, and any necessary repair of damage.
4. A public school entity, wishing to install donor artifacts, will enter into an
agreement with the City and will be entitled to no-fee encroachment permits,
where such permits are required. Permit fees, as may be required by other utility
or service providers, shall be borne by the public school entity.

5. No installation of donor artifacts or combination of bricks, tiles, or other graphic
material, shall be permitted to form a mosaic with the potential of a secondary
meaning.
6. The City reserves the exclusive right to remove or have removed any donor
artifact the City deems inappropriate.
7. Maintenance and repair of donor artifacts shall be provided on a regular basis by
the respective public school entity to prevent unsightly or unsafe conditions.
