A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
REGARDING CUPERTINO MUNICIPAL WATER SYSTEM POTABLE WATER RATES
AND CHARGES, EFFECTIVE SEPTEMBER 15, 2016 AND RETROACTIVE TO JANUARY 1,
2016, BY 8.6% WHICH IS EQUIVALENT TO THE RATE REVIEWED AND AUTHORIZED
BY CALIFORNIA PUBLIC UTILITIES COMMISSION TO SAN JOSE WATER COMP ANY
FOR SYSTEMS OWNED AND OPERATED BY SAN JOSE WATER COMPANY
WHEREAS, the production, treatment, and distribution of potable water within the
Cupertino Municipal Water System area is determined and declared to be a health, sanitary and
safety measure necessary for the promotion, protection and preservation of the health, safety and
general welfare of the people of the City of Cupertino; and
WHEREAS, the City Council of the City of Cupertino enacted provisions of the Municipal
Code, in part, to satisfy applicable potable water safety and health requirements; and
WHEREAS, pursuant to the 1997 Agreement for Lease of Real Property (Water System)
(Lease) all operations of the Cupertino Municipal Water System is provided by a private water
utility operator collector pursuant to the terms of the Lease and Cupertino Municipal Code; and
WHEREAS, the City does not provide water system services, rather the private water
utility has agreed to protect public health, safety and welfare and compliance with applicable
laws; and
WHEREAS, as the lessee of the Cupertino Municipal Water System, San Jose Water
Company is responsible for all operations of the system including repair, maintenance, operation,
customer service, rate setting, billing, emergency service and water quality testing; and
WHEREAS, as part of its administrative role, pursuant to Lease, the City reserved the right
to consider if rates were unreasonable; and
WHEREAS, pursuant to the terms of the Lease, San Jose Water Company has the
responsibility to operate the Cupertino Municipal Water System in a manner similar to that in
which it operates in own systems and to maintain the leased system in accordance with customary
utility standards; and
WHEREAS, when rate setting for its own systems, the private water utility is solely
responsible for setting and collecting such rates and charges at a level at or below the authorized
amount set by the California Public Utilities Commission; and
WHEREAS, pursuant to the terms of the Lease, San Jose Water Company submitted a
written request and documentation in support of an adjustment for potable water rates and
charges to customers of the Cupertino Municipal Water System; and

WHEREAS, the request for a rate adjustment is equivalent to the rate reviewed and
authorized by California Public Utilities Commission for systems owned and operated by San
Jose Water Company; and
WHEREAS, the California Public Utilities Commission and Office of Rate Payer Advocates
has evaluated the requested rate adjustment and made written findings that the requested
adjustment is necessary to cover increased costs of operations in similar water systems that are
both owned and operated by San Jose Water Company; and
WHEREAS, the City has determined that the rate increase is exempt from environmental
review pursuant to the exemption in 14 Cal. Code Regs. §15601(b)(3) in that it can be seen with
certainty that there is no possibility that this action will have a significant effect on the
environment because approval of the rate adjustment is an administrative action and is not an
activity subject to CEQA;
WHEREAS, the City Council, using its independent judgment, before taking action on this
Resolution, determines that the action is exempt from CEQA as stated above;
WHEREAS, each and every customer and owner of real property within the Cupertino
municipal water system was notified of a public hearing scheduled on the proposed rate schedule
by U.S. mail prior to said public hearing; and
WHEREAS, a public hearing notice regarding the proposed adjustment to the maximum
rate schedule was posted on the City's website on July 13, 2016; and
WHEREAS, all documentation to support this rate adjustment was placed on file with the
City Clerk for public inspection and review;
WHEREAS, at its regular meeting on September 6, 2016, the City Council held a duly
noticed public hearing to consider the schedule of rates and charges for potable water; and
WHEREAS, at the public hearing, interested persons had the opportunity to testify
regarding the increase in the potable rates and charges; and
WHEREAS, the City Council of the City of Cupertino finds and determines as follows:
1. The above recitals are true and correct and material to the adoption of this
Resolution.

2. Pursuant to the Lease, after considering the potable water rate and charge
adjustment request and documentation from San Jose Water Company, the findings of the general
rate case proceedings of the California Public Utilities Commission, the public's written
comments and testimony received at this public hearing, and the staff report and information
presented at the hearing, the City Council determines that the evidence support that the
adjustment is needed to cover increased costs, and therefore, there is no basis for the City to
withhold consent to an increase the rate schedule by 8.6% effective September 15, 2016 and
retroactive to January 1, 2016.
3. The maximum rate for each service description, as set forth in the schedule labeled
as Attachment A, which is attached hereto and incorporated by this reference, represents the
effective maximum rate schedule for potable water rate and charges.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Cupertino, that:
1. Schedule of Rates and Charges. Under the Lease, the City has no basis to determine
the following rates and charges are unreasonable. Therefore, as requested by San Jose Water
Company and set by the Public Utilities Commission for non-leased system rate payors, the
maximum rate schedule for potable water rates and charges shall be increased 8.6%, effective
September 15, 2016 and retroactive to January 1, 2016, as is more particularly provided for in
Attachment A. San Jose Water Company remains responsible under the Lease for setting and
collecting rates at or below this maximum rate schedule for its customers in the leased Cupertino
Municipal Water System.

On the directive of the California Public Utilities Commission's (CPUC) D ivision of Water and
Audits (DWA), SJWC hereby provides a suJ;plement to the previously filed advice letter (AL)
492. In advice letter 492, filed June 28 , SJWC requested authorization to implement a
surcharge to true-up the difference between interim rates for the period January 1, 2016 through
June 13, 2016. Subsequent to that filing DWA directed SJWC to withdraw the separate AL 487
to amortize the uncollected remaining balance from SJWC's interim rate true -up originally
authorized in D .14-08-006 as modified by D .15-03 -048 and implemented in AL 4 71. SJWC
should instead request amo11ization of this uncollected balance in conjunction with recovery of
the interim rate true-up balance from the most recent general rate case as authorized in D.16 -06-
004. This should be accomplished by filing a supplement to AL 492 to include the uncollected
balance being sought in AL 487. The directive from the CPUC's DWA is provided as
Attachment A. Pursuant to this direction, SJWC withdrew AL 487 effective June 30th, 2016.
As of July 1 si, there is an uncollected balance of $524,389 remaining from the interim rate tiue-
up recovery originally approved in D.14-08-006 as amended by D.15-03-048 (Attachment B).
As noted in AL 492, SJWC seeks to recover $8,767,390 accumulated in the 2016 GRC Interim
Rates Memorandum Account (Attachment C). Thus, the cumulative balance of these two
accounts is $9,291,779.
Ordering Paragraph (OP) No. 2 of D.14-08-006 and OP No. 6 of D.16-06-004 requires that the
surcharge must comply with SP U-27-W, which states: "Reserve and memo account
amortization surcharges shall be spread over one year for undercollections of less than 5% of
gross revenues , over two years for undercollections of 5% to 10% of gross revenues and over
three years for undercollections over 10% of gross revenues. "1 SJWC' s authorized revenue
requirement as determined in D.16-06 -004 is $317,275,000. As noted above, the balance
requested for recovery is $9,291,779, or 2.9% of authorized revenue requirement.
SJWC 's authorized sales, as provided in D .16 -06-004, is 50,731,000 ccf. Based on the
authorized sales the calculated surcharge is $0.1832 per ccf to be applied to all sales. As

required by D.16-06-004 the undercollection will be recovered over the balance of the GRC
cycle, so the surcharge will rnn until collection is completed.
This AL is designated Tier 1 per D .14-08-006 and D.16-06-004. SJWC requests that the
surcharge become effective on July 9, 2016.
Rate Calculation and Average Bill Comparison
At the time of filing the present rates for SJWC are effective pending disposition as of June 14,
2016 by AL 489. As a result of this surcharge, the bill for a residential customer with a W'
meter using 15 ccf per month will increase by $2.75 , or 3.04% per month (Attachment D).
Protests and Responses
Anyone may respond to or protest this advice letter. A response does not oppose the filing but
presents information that may prove useful to the Commission in evaluating the advice letter. A
protest objects to the advice letter in whole or in pmt and must set fo1th the specific grounds on
which it is based. These grounds may include the following:
(1) The utility did not properly serve or give notice of the advice letter;
(2) The relief requested in the advice letter would violate statute or
Commission order, or is not authorized by statute or Commission
order on which the utility relies ;
(3) The analysis, calculations, or data in the advice letter contain material
en-or or ormss1ons;
( 4) The relief requested in the advice letter is pending before the
Commission in a fo1mal proceeding;
(5) The relief requested in the advice letter requires consideration in a
f01mal hearing, or is otherwise inappropriate for the advice letter
process; or
(6) The relief requested in the advice letter is unjust, unreasonable, or
discriminatory (provided that such a protest may not be made where it
would require relitigating a prior order of the Commission).

13. Customers who receive water deliveries for agricultural purposes under this schedule , and
who present evidence to the utility that such deliveries qualify for the lower pump tax rates
levied by the Santa Clara Valley Water District for agricultural water , shall receive a credit of
$2.4068 per 100 cubic feet on each water bill for the quantities of water used during the
period covered by that bill.

3 . The utility will supply at the point of connection only such raw waterat such pressures as may
be available from time to time from the Santa Clara Valley Water District. The customer shall
indemnify the utility and save it harmless from any and all claims arising out of service under
this schedule and shall further agree to make no claims against the utility for any loss , damage
or injury resulting from service under this schedule .
4 . As a condition for service under this schedule, all customers are required to comply with all
San Jose Water Company's tariffs, except for those identified in the Commission's General
Order 103 regarding supply of water not intended or claimed to be potable .
5 . Customers who receive water deliveries for agricultural purposes under this schedule , and
who present evidence to the utility that such deliveries qualify for the lower pump tax rates

of $2.4068 cents per 100 cubic feet for the quantities of water used . In accordance with
Santa Clara Valley Water District procedures customers will be refunded every six months.

2. The City of San Jose is responsible for the determination of customer
eligibility for the South Bay Water Recycling Program.
3. The customer is responsible for notice of and compliance with all Customer Service
Rules for use of recycled water as provided by the City of San Jose in addition to all
local, state, and federal rules and regulations that apply from time to time to the use
of recycled water, as defined in San Jose Water Company's Rule 1.
4. The utility will supply at the point of connection only such recycled water at such
pressures as may be available from time to time from the San Jose/Santa Clara Water
Pollution Control Plant. The customer agrees to make no claims against the utility for loss,
damage or injury caused by service interruptions.
5 . The customer shall defend and indemnify the utility and save it harmless from any and

to make no claims against the utility for any loss, damage or injury resulting from service
and water use under this schedule.

pursuant to General Orders Nos. 96-B and pursuant to the authority established by the California
Public Utilities Commission (Commission) in Decision No. (D) 16-06-004, dated June 9, 2016.
Public notice is not required as notice was completed at the time of filing of SJWC's General
Rate Case (GRC) proceeding A.15-01-002. This advice letter is designated a Tier I Advice
Letter. SJWC requests that the surcharges become effective July 1, 2016.
Background
SJWC filed Application 15-01-002 on January 5, 2015. In the Application SJWC sought,
amongst other items, CPUC authorization to increase rates for the Test Year 2016 and Escalation
Years 2017 and 2018. On July 14, 2015, SJWC filed the Motion of San Jose Water Company
for Interim Rate Relief. On August 4, 2015, the assigned Administrative Law Judge (ALJ)
issued a Ruling Granting Interim Rates (Attachment A). This Ruling authorized SJWC to file a
tariff implementing interim rates and to establish a Memorandum Account to track the
difference between the interim rates and the final rates adopted in A.15-01-002. SJWC received
CPUC approval of the submitted AL 480 implementing the interim rates and establishing the
Memorandum Account effective January 1, 2016.
On June 9th, 2016, the Commission issued D .16 -06-004 authorizing a general rate increase for
the Test Year 2016. This Decision was issued approximately 5 months after the interim rates
went into effect. The rates authorized by D.16-06-004 were made effective pending disposition
on June 14, 2016 through advice letter 488.
With this advice letter SJWC requests authorization to implement a surcharge of $0.1728 per ccf
for all potable and non-potable usage to collect the under-collection of $8,767,390 tracked in the
2016 GRC Interim Rates Memorandum Account over the true-up period of January 1, 2016
through June 13, 2016. The surcharge to recover the balances in the Memorandum Account has
been calculated in accordance with Standard Practice U-27-W. The surcharge will be eliminated
when the balance is recovered, which will be over the balance of the rate case cycle.
Interim True-Up Authorization
Ordering Paragraph No. 6 of D.16-06-004 (Attachment B), states that:
"6. San Jose Water Company shall.file a Tier 1 Advice Letter for a surcharge to
true-up the difference between interim rates for the period January 1, 2016 to the
implementation date of the tariffs included in this order. The surcharge must
comply with Standard Practice U-27-W This calculation will be bas ed on the
2016 tariff schedules attached to this decision that would have been implem ented
under the present rate design. The difference between the interim and final rates
based on the revenu e requirement shall be recovered over the balance of the rate
case cycle. "

Interim True-Up Calculation
The 2016 GRC Interim Rates Memorandum Account includes the following entries for eve1y
month between January 1, 2016 and June 13, 2016:
1. Revenues based on interim rates
2. Revenues based on authorized rates
3. Total net 2016 GRC Interim Rates Memorandum Account balance= (1)-(2)
4. A positive(+) balance in the memorandum account reflects a utility over collection to be
refunded, while a negative balance reflects a utility under collection to be recovered in
rates.
The 2016 GRC Interim Rates Memorandum Account includes accrual of interest on a monthly
basis at a rate equal to one-twelfth of the 90 Day Non-financial Commercial Paper Interest Rate
applied to the average of the beginning-of-month and the end-of-month balances.
The only change in rates during the true-up period occurred on March 30, 2016. Effective on
this date, SJWC increased rates by 0.55% via AL 483. However, this rate increase was not
incorporated into the rates authorized in D.16-06-004, therefore only the authorized rates
effective January 1, 2016 are included in the true-up calculation. Since only the authorized rates
effective January 1, 2016 are included in the calculation it is necessary to use only the interim
rates effective January 1, 2016 in the calculation as well. The interim rates included in this
calculation are included as Attachment C and the authorized rates are included as Attachment D.
Both revenues based on interim rates and revenues based on authorized rates are calculated
based on actual billed usage and number of billed services during the true-up period. Based on
the difference between interim rates and authorized rates applied to recorded billed service
charges and billed customer usage over the true-up period the amount included in the 2016 GRC
Interim Rates Memorandum Account for the Base Interim True-up is $8,767,390, which includes
interest at the 90 day commercial rate (Attachment E).
As noted above, Ordering Paragraph No. 6 of D.16-06-004 requires that the surcharge must
comply with SP U-27-W, which states: "Reserve and memo account amortization surcharges
shall be spread over one year for undercollections of less than 5% of gross revenues, over two
years for undercollections of 5% to 10% of gross revenues and over three years for
undercollections over 10% of gross revenues. "1 SJWC's authorized revenue requirement as
determined in D.16-06-004 is $317,275,000 . As noted above, the balance requested for recove1y
is $8,767 ,390, or 2.7% of authorized revenue requirement.

SJWC's authorized sales, as provided in D .16-06-004, is 50 ,731,000 ccf. Based on the
authorized sales the calculated surcharge is $0.1728 per ccf to be applied to all sales . As
required by D.16-06 -004 the undercollection will be recovered over the balance of the GRC
cycle, so the surcharge will rnn until collection is completed .
SJWC requests that the surcharge become effective on July 1, 2016.
Rate Calculation and Average Bill Comparison
At the time of filing the present rates for SJWC are effective pending disposition as of June 14,
2016 by AL 489 . As a result of this surcharge, the bill for a residential customer with a W'
meter using 15 ccf per month will increase by $2.59, or 2 .87% per month (Attachment F).
Protests and Responses
Anyone may respond to or protest this advice letter. A response does not oppose the filing but
presents info1mation that may prove useful to the Commission in evaluating the advice letter. A
protest objects to the advice letter in whole or in part and must set forth the specific grounds on
which it is based. These grounds may include the following:
(1) The utility did not properly serve or give notice of the advice letter;
(2) The relief requested in the advice letter would vio late statute or
Commission order, or is not authorized by statute or Commission
order on which the utility relies;
(3) The analysis, calculations, or data in the advice letter contain material
e1Tor or om1ss10ns;
( 4) The relief requested in the advice letter is pending before the
Commission in a fotmal proceeding;
(5) The relief requested in the advice letter requires consideration in a
fonnal hearing, or is otherwise inappropriate for the advice letter
process; or
( 6) The relief requested in the advice letter is unjust, unreasonable, or
discriminatory (provided that such a protest may not be made where it
would require relitigating a prior order of the Commission).

2 . The City of San Jose is responsible for the determination of customer
eligibility for the South Bay Water Recycling Program.
3. The customer is responsible for notice of and compliance with all Customer Service
Rules for use of recycled water as provided by the City of San Jose in addition to all
local, state, and federal rules and regulations that apply from time to time to the use
of recycled water, as defined in San Jose Water Company's Rule 1.
4 . The utility will supply at the point of connection only such recycled water at such
pressures as may be available from time to time from the San Jose/Santa Clara Water
Pollution Control Plant. The customer agrees to make no claims against the utility for loss,
damage or injury caused by service interruptions.
5. The customer shall defend and indemnify the utility and save it harmless from any and
all claims arising out of service and water use under this schedule and shall further agree
to make no claims against the utility for any loss , damage or injury resulting from service
and water use under this schedule.
6 . As a condition for service under this schedule , all customers are required to comply with
all of San Jose Water Company's tariffs, except for those specifically excluded by
Appendix A of the Commission's General Order 103 regarding supply of water not intended
or claimed to be potable .
7. All bills are subject to the reimbursement fee set forth on Schedule No. UF.
8 . To offset the July 2016 increase in the Recycled Water Wholesale Rate from South Bay Water
Recycling , as required by Section 792 .5 of the Public Utilities Code , an increase in recycled water
wholesale rates of $178 .00 /acre-foot , relative to the recycled purchase water costs adopted by
D.16-06-004 , and associated revenue increase of $0.4102 per 100 cu .ft .

07-028, dated July 25, 2013 . This advice letter is designated a Tier I Advice Letter consistent
with General Order 96-B . Public notice is not required as notice was completed at the time of
SJWC ' s filing of Application No. (A) 10-09-019: Application of SJWC for Approval of Cost
Recovery for Upgrading the Montevina Water Treatment Plant (MWTP). CmTently SJWC ALs
487 and 488 are outstanding before the Commission.

With this advice letter SJWC re-implements a previously approved rate base offset for plant
additions made in 2015 related to the MWTP Upgrade Project (Montevina Project). This rate
base offset has been approved by the Commission via AL 483 effective March 30, 2016 . In AL
483 the Commission approved the requested revenue increase of $1,659,451 for recovery of the
total recorded constrnction costs for calendar year 2015 of $9,053,138. Re-implementation of
this March 30, 2016 rate base offset is necessary because it is not included in the rates authorized
by Decision (D.)16-06-004 which have an effective date of Januaiy 1, 2016,.
Background
On Febrnary 29tl1, 2016, SJWC filed AL 483 seeking Commission approval of a rate base offset
for work performed on the Montevina Project in 2015. SJWC requested a rate base offset of
$9,053,138 in improvements with an associated revenue increase of $1,659,451. The requested
rate base offset was approved effective March 30, 2016, after a thorough review by both the
Commission's Division of Water and Audits (DWA) and the Commission's Office of Ratepayer
Advocates.
On May 26 111 , 2016, the Commission adopted D.16-06-004 in SJWC's General Rate Case
proceeding A.15-01-002. With this Decision the Commission authorized a revenue requirement
and rates effective back to Januaiy 1, 2016. However, since the approval of AL 483 came on
March 30th, three months after the Januaiy 1st effective date of rates approved in D .16-05-XXX,
the AL 483 rate base offset improvements were therefore not included in the rates authorized in
D.16-06-004 . Thus, if the rate base offset is not re-implemented, as requested in this advice
letter, SJWC would not receive recovery of Commission approved improvements.
On June 10th SJWC filed AL 488 to implement rates approved in D.16-06-004. These rates will
become effective on June 14th, 2016. SJWC seeks to have AL 489 rates also become effective,
and in fact supercede the AL 488 rates, effective June 14th.

CmTent authorized rates for 2016 become effective on June 14th, 2016 by AL 488.
The total revenue requirement impact for this capital addition is $1,659,451, the same as that
previously approved by the Commission via AL 483, or about 0.48% of SJWC's cun-ently
authorized revenue for 2016. SJWC seeks to recover 30%, or $497,835, of the revenue through
the service charge component and the remaining 70%, or $1,161,616, through the quantity rate
component pursuant to SJWC' s rate design approved in D .14-08-006 and continued in D .16-06-

increase by $0.14 per month from $23.84 to $23.98. The unifo1m quantity charge will increase
from $4.4873 per ccf to $4.5090 per ccf. SJWC's residential conservation rates have been
calculated using the methodology adopted in D .14-08-006, applying 90% of the unifo1m quantity
rate to Tier I, 100% of the uniform rate to Tier II and 110% of the uniform quantity rate to Tier
III. The Tier I rate charge will increase from $4.0386 per ccfto $4 .0581 per ccf. The Tier II rate
charge will increase from $4.4873 per ccf to $4.5090 per ccf. The Tier III rate charge will
increase from $4 .9360 per ccf to $4 .9599 per ccf. The rate calculations are set forth in
Attachment A. As a result of this rate change, the bill for a residential customer using 15 ccf
per month will increase by $0.46 , or 0.51 % per month (Attachment B).
Protests and Responses
Anyone may respond to or protest this advice letter. A response does not oppose the filing but
presents info1mation that may prove useful to the Commission in evaluating the advice letter . A
protest objects to the advice letter in whole or in part and must set forth the specific grounds on

With this advice letter SJWC implements the authorized rates and conditions as established in
Decision No . (D) 16-06-004 (Attachment A) dated June 9, 2016, which are designed to increase
revenue by $25,130,000, or 8.60% in Test Year 2016 . These tariffs are submitted pursuant to
General Order No . 96-B and pursuant to the authority established by the California Public
Utilities Commission (Commission) in D.16-06-004. This advice letter is designated as a Tier I
Advice Letter and will become effective pending disposition as of June 14, 2016. Public notice
is not required as notice was completed at the time of SJWC's General Rate Case proceeding
A.15 -01-002.
This advice letter is submitted as authorized by Ordering Paragraph No .5 ofD.16-06-004, which
states that:
"5. San Jose Water Company sha ll file by Tier I Advice L etter the revis ed
tariff schedules for 20 I 6 attached to this d ecision and to concurrently
cancel its present schedules for such service. This filing shall be subject
to approval by the Commission's Division of Water and Audits. Th e
effective date of the revised schedule shall be no earlier than five da ys
after the effective date of this decision, and sha ll apply only to service
rende red on or after th e effective date. "
D.16-06-004 -Attachment D , Tables G tlu·ough K (included in Attachment A), provide the
revised tariff schedules. SJWC's updated tariffs filed with this advice letter reflect these
authorized rates.
In addition to implementing the revised rates SJWC has eliminated the existing Purchased Water
and Ground Water Charge expense offset surcharges implemented in the years 2013 through
2015. The production unit cost increases associated with these surcharges have been included in
the base rates authorized with this decision , thus the surcharges are no longer necessa1y .

SPECIAL CONDITIONS
1 . Customers who receive water deliveries for agricultural purposes under this schedule , and
who present evidence to the utility that such deliveries qualify for the lower pump tax rates
levied by the Santa Clara Valley Water District for agricultural water, shall receive a credit of
$2.0033 per 100 cubic feet on each water bill for the quantities of water used during the
period covered by that bill .
2 . All bills are subject to the reimbursement fee set forth in Schedule No . UF .
3. To fund the Water Rate Ass istance Program (WRAP) for residential low-income
households, a surcharge of $1.45 per month will be added to the bill .
4. To fund the repayment of a Safe Drinking Water State Revolving Fund loan , pursuant to

GENERAL METERED SERVICE WITH
Automatic Fire Sprinkler System (Continued)
1. Any service to a residential customer who requires a larger meter because of fire flow
requirement to a fire sprinkler system will be billed (i) a meter service charge, for the
appropriate meter size determined based on the normal water use of the customer
excluding the fire flow requirement ; and (ii) an upsize charge , determined by the
difference between the actual Meter size required including the fire flow requirement
and the appropriate meter size required without the fire flow requirement ; and (iii) the
quantity rate based on the quantity of water used .
2 . For the purpose of fire protection under this schedule , the utility will supply only such
water at such pressure as may be available from time to time as a result of its operation
of the system . Section 774 of the Public Utilities Code limits the liability of the utility
resulting from a claim regarding the provision or maintenance of an adequate water supply ,
water pressure, equipment or other fire protection facility or service . Acceptance of service
under this tariff is acknowledgment of notice of the provisions of Section 774 of the
Public Utilities Code.

3 . To fund the Water Rate Assistance Program (WRAP) for residential low-income
households , a surcharge of $1.45 per month will be added to the bill.
4 . It is the Company's intent to provide service to all its customers to the full extent of its capacity
to serve, except that in the event that there is a substantial risk to the Company's ability to
maintain service to customers in the Mountain District, the Company , at its sole discretion,
may temporarily interrupt or reduce service to such customers.
Such interruption or reduction of service may occur when (1) customer consumption , or (2)
significant electrical , mechanical or supply issues challenge the Company's ability to meet
demand for service . Should service be interrupted, the Company shall give timely priority to
remedies that are within its control to alleviate the need for the interruption of service .
The Company will inform customers of planned improvements to its facilities serving the
Mountain District through its annual system status report to Redwood Estates Services Association.
When service is interrupted, the Company agrees to promptly notify the interrupted customer's
designated representative (one per mutual water company). Such notification shall be provided
by telephone or by a reasonable alternative method specified by the customer and acceptable to
the Company. It is the customer's responsibility to provide the Company , in writing , the name
and contact information for its designated representative, to update that information, in writing
when appropriate, and to ensure that any designated representative shall maintain an active
answering system and e-mail address capable of receiving and recording service interruption
information .
5 . Each of the Mutual Water Companies served by San Jose Water Company in the Mountain
District shall be charged one Service Charge , based on the Mutual's meter size . San Jose
Water Company shall provide each of the Mutual Water Companies one single quantity rate
usage allocation per customer individually served by the Mutual Water Company, as described
under Quantity Rates per Ccf. above . Thus, each Mutual Water Company will be charged at
the Single Quantity rate for usage up to 20 Ccf times the number of customers the Mutual
Water Company individually serves, and will be charged at the Overuse Rate for usage in
excess of 20 Ccf times the number of customers the Mutual Water Company individually
serves.
6 . To fund the repayment of a Safe Drinking Water State Revolving Fund loan , pursuant to

1. The fire protection service connection shall be installed by the utility and
and the cost paid by the applicant. Such payment shall not be subject to refund.
The facilities paid for by the applicant shall be the sole property of the applicant.
2 . If a distribution main of adequate size to serve a private fire protection
system, in addition to all other normal service, does not exist in the street or alley
adjacent to the premises to be served, then a service main from the nearest existing
main of adequate capacity shall then be installed by the utility and the cost paid
by applicant. Such payment shall not be subject to refund .
3. Service hereunder is for private fire protection systems to which no connections for other
than fire protection purposes are allowed and which are regularly inspected by the
underwriters having jurisdiction, are installed according to specifications of the utility, and
are maintained to the satisfaction of the utility. The utility may install the standard detector
type meter approved by the Board of Fire Underwriters for protection against theft, leakage or
waste of water and the cost paid by the applicant. Such payment shall not be subject to refund .

3. The utility will supply at the point of connection only such raw waterat such pressures as may
be available from time to time from the Santa Clara Valley Water District. The customer shall
indemnify the utility and save it harmless from any and all claims arising out of service under
this schedule and shall further agree to make no claims against the utility for any loss, damage
or injury resulting from service under this schedule .
4. As a condition for service under this schedule, all customers are required to comply with all
San Jose Water Company's tariffs, except for those identified in the Commission's General
Order 103 regarding supply of water not intended or claimed to be potable.
5. Customers who receive water deliveries for agricultural purposes under this schedule , and
who present evidence to the utility that such deliveries qualify for the lower pump tax rates
levied by the Santa Clara Valley Water District for agricultural water, shall receive a refund
of $1 .6709 cents per 100 cubic feet for the quantities of water used. In accordance with
Santa Clara Valley Water District procedures customers will be refunded every six months.

With this advice letter SJWC requests authorization to increase revenue requirement by
$1,659,451 via a rate base offset for plant additions related to the MWTP Upgrade Project
(Montevina Project).
The designation of this advice letter as Tier II is made pursuant to General Order 96-B, Industry
Rule 7.3.3 (8), which provides that "a rate base offset will be disposed of under Tier 2 when staff
determines that:
i. The Rate base offset was previously approved by the Commission in a decision or
resolution;
ii. The project scope is consistent with what the Commission approved; and
ui. The Commission approval included a budget cap and the rate base offset request is at
or below the budget cap."
OP No. 3 of D.13-07-028 (Attachment A) states in pai1 that:
"3. San Jose Water Company (Company) is authorized to file annual Tier 2 advice letters
to include in rate base properly recorded costs of the Montevina Upgrade Project. Until
moved to rate base, such costs shall accrue interest during construction on a monthly
bi1sis at the Company 's actual weighted average cost of debt, including short term debt,
and capitalized interest shall not be compounded. The total cost for the Montevina
Upgrade project included a I 0% design contingency with a total project cost estimate of
$62 million. This $62 million construction cost estimate will be treated as an advice letter
cap for ratemaking purposes.... "
This advice letter filing meets the requirements set fo11h in General Order 96-B, Indust1y Rule
7.3.3 (8) in that: (i) the rate base offset was previously approved by the Commission in D.13-07-
028, OP No.3; (ii) the project scope (upgrades to the MWTP) is consistent with what the
Commission approved; and (iii) the Commission approval included a budget cap ($62 million)
and the total rate base offset as of 12 /31/2014 ($11,221,334, comprised of $669,458 authorized
in AL 457, $1,498,738 authorized via AL 476, and $9,053 ,138 as discussed below) is at or below
this budget cap. Thus, this advice letter is designated as Tier II with an effective date 30 days
from date of filing, on or before March 30, 2016.
Background
SJWC filed A.10-09-019, seeking Commission approval for cost recove1y for upgrading the
MWTP, in September of 2010. In conjunction with that Application SJWC met all of the
necessary noticing requirements as provided for in the Commission's Rules of Practice and
Procedure , Rule No. 3.2 . In March of 2013 SJWC and the Commission's Division of Ratepayer
Advocates (now Office of Ratepayer Advocates) submitted a Joint Motion for Adoption of the
Settlement Agreement. The provisions of the Agreement are outlined in OP No . 3 of D.13-07-

028 above. On July 25 , 2013 the Commission issued D .13-07-018 approving the settlement
agreement.
In D.13-07-028 the Commission authorized SJWC to file annual Tier 2 advice letters to recover
in rates capital improvements associated with the Montevina Project. This advice letter is the
third of these Tier 2 advice letters associated with the Montevina Project. The first, AL 457,
covered work perfmmed in 2013 and requested a ratebase addition of $669 ,458 and the related
offset recove1y of $123,112 in increased revenue requirement. The second, AL 476 , covered
work performed in 2014 and requested a ratebase addition of $1,498 ,738 and the related offset
recove1y of $274,721 in increased revenue requirement. Both of these prior advice letters were
ultimately approved.
Advice letter 483 covers work performed during calendar year 2015 . Subsequent advice letters ,
covering work perfmmed during the calendar year previous to each advice letter filing, will be
filed on an annual basis until the project is completed. A description of the work completed in
2015 is provided below .
Montevina Project -Work Completed as of December 31, 2015
The Montevina Water Treatment Plant Facility Plan Project continued to make progress
throughout 2015. This year included fulfillment of work perfmmed under the Professional
Services Agreement (PSA) between San Jose Water Company (SJWC) and HDR, Inc. (HDR).
Ongoing interactions allowed the continued development of the project scope. This included
outreach efforts to potential subcontractors and pe1mitting agencies as well as ongoing
coordination with the integrator H20 Innovations , and the membrane material supplier
BASF/INGE .
Work in the beginning of2015 was perfmmed under the PSA with HDR. In Januaiy the project
scope and design were dete1mined to the 30% design level and the Basis of Design Report
(BODR) was finalized . Field data collection and design progression leading up to the 60% level
were accomplished in the early months of 2015 . This included additional soil borings and
analysis for the finalization of the geotechnical report. Additional percolation testing for
improvements to the site septic system and non invasive subsurface utility mapping were aslo
conducted . Surveys were perfo1med , research conducted and data was compiled into the initial
study prepared by a third party consultant in collaboration with HDR to meet regulato1y
compliance per the California Environmental Quality Act (CEQA). The California Depat11ment
of Water Resources (DWR), Division of Drinking Water (DDW) sponsored and operated as lead
adency to fulfill CEQA requirements. Project documentation was accepted by DDW and
published for the statutmy 3 0-day public comment period on J anuaiy 26, 2015 . Responses to
comments were provided to the lead agency prior to the notice of dete1mination (NOD) being
filed.

Febrnary tlu·ough May, the project team continued to collaborate to develop the project contract
documents to 60 %. The eff01t culminated in a finalized 60% set of design documents and
establislunent of acceptable tenns and conditions to enter into the next contract phase of the
project. The Design Build Agreement (DBA) for the construction of facilities associated with the
Montevina Water Treatment Plant Improvements Project was executed on July 20 , 2015,
HDR coordinated with SJWC to mobilize and begin construction. Site preperations for vendor
and subcontractor parking and project site access were perf01med . A staging area for material
and equipment was also pmt of the mobilization and site preparation. An on-site meeting with
emergency first responders was held.
Water treatment operations were temporarily ceased and construction stmted on August 25, 2015.
From August 25 through December 23 , 2015, the treatment plant was off-line to allow the first
physical improvements to begin. The flocculation basins were retrofitted with structural and
operational improvements. The head works of the flocculation basins were inproved with a
chemical dosing and mix ing system. Clearwell #1 was temporarily repurposed to function a s the
off-spec basin. Preparations were also made for an additional access point to the treatment plant
prope1ty from Alma Bridge Road . Preparations for foundation construction were also made to the
area of the previous off-spec basin, which is also where the membrane building structure is sited.
Continuous effort was applied to acquire ministe1ial pe1mits from agencies such as CalTrans for
proposed safety improvements within Hwy 17 and the county of Santa Clara for a variety of
building and encroaclunent permits . Specific inf01mation related to the proposed operational
changes and eventual final treatment plant design were provided to the DDW.
The project documentation for the work perf01med as of 12 /31 /2015 can be found in Attaclunent
B . Total recorded costs for this pe1iod , including capitalized interest, were $9,053 ,138.
Capitalized Interest Calculation
As noted above, D .13-07-028 OP No .3 prov ides that "Until moved to rate base, (Project) costs
shall accrne interest during construction on a monthly basis at the Company's actual weighted
average cost of debt, including short-term debt, and capitalized interest shall not be
compounded." Capitalized interest calculations are provided in Attaclunent C .

The total revenue requirement impact for this capital addition is $1,659,451 or about 0.55% of
SJWC's currently authorized interim rate revenue for 2016 (Attachment D). SJWC seeks to
recover 30%, or $497,835, of the revenue through the service charge component and the
remaining 70%, or $1,161,616, through the quantity rate component pursuant to SJWC's rate
design approved in D.14-08-006. As a result of this rate calculation, the service charge for a
standard %-inch meter will increase by $0.14 per month from $21.07 to $21.21. The uniform
quantity charge will increase from $3.5670 per ccf to $3.5888 per ccf. SJWC's residential
conservation rates have been calculated using the methodology adopted in D .14-08-006, applying
90% of the uniform quantity rate to Tier I, 100% of the uniform rate to Tier II and 110% of the
uniform quantity rate to Tier III. The Tier I rate charge will increase from $3.21030 per ccf to
$3.22992 per ccf. The Tier II rate charge will increase from $3.56700 per ccf to $3.58880 per
ccf. The Tier III rate charge will increase from $3.92370 per ccf to $3.94768 per ccf. The rate
calculations are set forth in Attachment E. As a result of this rate change, the bill for a residential
customer using 15 ccf per month will increase by $0.46, or 0.55% per month (Attachment F).
Protests and Responses
Anyone may respond to or protest this advice letter. A response does not oppose the filing but
presents information that may prove useful to the Commission in evaluating the advice letter. A
protest objects to the advice letter in whole or in part and must set forth the specific grounds on
which it is based. These grounds may include the following:
(1) The utility did not properly serve or give notice of the advice letter;
(2) The relief requested in the advice letter would violate statute or
Commission order, or is not authorized by statute or Commission order
on which the utility relies;
(3) The analysis, calculations, or data in the advice letter contain material
error or om1ss10ns ;
( 4) The relief requested in the advice letter is pending before the
Commission in a foimal proceeding;
( 5) The relief requested in the advice letter requires consideration in a
foimal hearing, or is otherwise inappropriate for the advice letter
process; or
( 6) The relief requested in the advice letter is unjust, unreasonable, or
discriminato1y (provided that such a protest may not be made where it
would require relitigating a prior order of the Commission).

SPECIAL CONDITIONS
1. Customers who receive water deliveries for agricultural purposes under this
schedule , and who present evidence to the utility that such deliveries qualify
for the lower pump ta x rates levied by the Santa Clara Valley Water District for
agricultural water, shall receive a credit of $2.0033 per 100 cubic feet on each
water bill for the quantities of water used during the period covered by that bill .
2. All bills are subject to the reimbursement fee set forth in Schedule No . UF.
