ASA-2004-13; Jim Yee (Dahlin Group), 10050 N. Wolfe Road
Description
Architectural Site Approval for an approved mixed-use project consisting of 107
condominiums and 6,386 square feet of commercial space.
Action
The Design Review Committee approved the application on a 2-0 vote. This is
effective July 7,2004. The fourteen-calendar day appeal will expire on July 21,
2004.

Description
Exception to the R1 ordinance to allow a 5-foot side setback when a 10-foot
setback is required to construct a new 3,235 square foot residence.
Action
The Design Review Committee approved the application on a 2-0 vote. This is
effective July 7, 2004. The fourteen-calendar day appeal will expire on July 21,
2004.

Project Description: Architectural site approval for an approved mixed-use project
consisting of 107 condominiums and 6,386 sq. ft. of commercial space.
RECOMMENDATION:
Staff recommends approval of ASA-2004-13, based on the model resolution.
BACKGROUND:
On December 15, 2003, the City Council approved the Menlo Equities "Metropolitan"
mixed-use project based on a positive recommendation from the Planning Commission.
A condition of approval required the following iterns to be reviewed by the Design
Review Committee prior to issuance of building permits:
Real stone base
Roof material
Aluminum storefront system
Colors
Lighting details
. Retail plaza details
. Corner plaza details
DISCUSSION:
The Planning Commission required this review of the details for the project. Staff
believes the Commission's issues are addressed in the plan set. The rest of this report
will briefly discuss each of the items referenced in the Background:
Real Stone Base
An authentic stone base was required for the retail projects. Sheet A3 shows the stone
base on the retail building. Sheet A1 shows a sample of stone base under the label
"Granite Pane!."
Roof Material
The applicant originally proposed a metal roof, but the Planning Commission requested
individual tiles. Sheet A1 shows a sample of roof tile to be used, which meets the
Commission's direction.

Aluminum Storefront
The project was required to have an aluminum storefront system, which is noted on
Sheets A17 and A18.
Colors
Colors are shown on Sheet A1 and A3. The City's consulting architect reviewed the
plan set and was comfortable with the color palette, as well as the rest of the details.
Lighting Details
Lighting details are shown on Sheet A2.

Retail Plaza Details
The retail plaza is shown in a cross-section on Sheet L-3. Details for the furniture are
shown on Sheet L-6. The umbrellas are not shown, but staff will ensure that these

Corner Plaza Details
A piece of artwork will be installed at the corner of Stevens Creek Boulevard and Wolfe
Road. The artwork has not been finalized at this time. The plan set shows the
landscaping and lighting for the area around the artwork.
The approval of the public art is the responsibility of the Fine Arts Commission. The
model resolution includes a condition that the applicant must receive approval from the
Fine Arts Commission prior to issuance of any framing permits.

WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Design Review Committee has held one or more
public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application;
and has satisfied the following requirements:
1. The proposal, at the proposed location, will not be detrimental or injurious to property
or improvements in the vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
2. The proposal is consistent with the purposes of this chapter, the General Plan, and
zoning ordinance;
3. Abrupt changes in building scale is avoided and a gradual transition related to height
and bulk is achieved; and
4. Design harmony between new and existing buildings and structures is protected
through the use of consistent or compatible design and color schemes
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the design review application is hereby approved subject to the
conditions which are enumerated in this Resolution beginning on page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution
are based and contained in the public hearing record concerning Application ASA-2004-13
set forth in the Minutes of the Design Review Committee meeting of, July 7, 2004, and are
incorporated by reference as though fully set forth herein.

requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other
exactions. You are hereby further notified that the 90-day approval period in which you
may protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-
day period complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.

Project Description: Exception to the R1 Ordnance to allow a 5-foot side setback when
10 feet is required to construct a new 3,235 square foot single story residence.
RECOMMENDATION:
Staff recommends approval of EXC-20O4-08, based on the model resolution,
DISCUSSION:
According to the R-1 Ordinance (19,28,060D2), at least one of the two side yard setbacks
must be no less than ten feet. The other side yard setback must be minimum five feet,
Lots less than 60 feet in width and less than 6,000 square feet in area shall be allowed to
have five feet on both sides, The intent of this regulation is to ensure sufficient side
yard setbacks from adjacent buildings on conforming lots (with at least 60 feet lot
width) and allow breaks for lots with substandard widths (less than 60 feet wide), The
proposed project parcel is extremely narrow (at 46 feet) in the front and widens toward
the rear, However, due to its total lot area (7,311 square feet), one of the side yards
must be at least ten feet in width,
The applicant is requesting an exception to permit a partial reduction of the required
ten-foot setback along the right (south side) side yard, Staff supports the exception for
the following reasons:
. The intent of the ordinance is addressed, The lot width is substandard, In
addition, the majority of the side yard exception being requested is along
portions of the lot that is non-conforming in width (less than less than 60 feet).
As the property widens toward the rear, the side yard setback is increased to 10
feet.
The proposed side yard exception is consistent with the surrounding
neighborhood setback patterns, Most of the homes on the same street are less
than 6,000 feet in area and less than 60 wide, thus allowing five feet setbacks on
both side yards,
Findings for Exception
Per Section 19,28,080 of the R1 Ordinance, the Design Review Committee may grant an
exception based upon the following findings:

A. Literal Enforcement of the provisions of this chapter will result in restrictions inconsistent
with the spirit and intent of this clwpter
The intent of the ordinance is addressed since the majority of the side yard exception
being requested is along portions of the lot that is non-conforming in width (less
than less than 60 feet), As the property widens toward the rear, the side yard
setback is increase to 10 feet.
B. The granting of the exception will not result in a condition which is materially detrimental to
the public health, safety, or welfare
The proposed setbacks are consistent with the neighborhood pattern and will not
create public health, safety or welfare issues.
C. The exception to be granted is one that will require the least modification of the prescribed
design regulation and the minimum variance that will accomplish the purpose
The majority of the proposed setback exceptions are proposed along portions of the
parcel that is non-conforming in width, It meets the required ten-foot setback as the
lot widens toward the rear.
D. The proposed exception will not result in significant visual impact as viewed from abutting
properties
