Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council ', and Planning Coininission in time to allow an appeal of the decision within fourteen �, calendar days. �' BACKGROUND On September 4, 2012 City Council approved the Main Street Cupertino mixed use project , consisting of 130,500 square feet of retail, a 180-room hotel, a five-level parking garage with two levels of underground parking, 260,000 square feet of office, a 120-unit market-rate live/work rental loft residential development with a 9,146-square-foot retail condonlinium unit and shared parking plan. 's .� -'� A,.��'Y The project incorporates twelve separate commercial/retail buildings labeled as Pads 1-3, Shops 1-S, Major Retail, and Flex 1-2. The subject property was previously reviewed and approved through I?IR-2Q1.6-31 1.9169 Stevens Cr�el:I�oial.e��ard Pag�2 the master permits (M-2013-03, and ASA-2012-15) for the use of space, architectural style of fhe building, Iandscaping, and parking requirements. The office and commercial components of the project have been constructed. The apartments, hotel, park, major retail, and shop 6 are under construction. The applicant, Grace King, representing Panino Giusto, is requesting to allow modifications to enclose an outdoor seating area with handrails.No changes are proposed to the main structure. ➢��S��JSS��l�T Paniilo Giusto is incorporating an outdoor dining area facing the Towne Square of Main Street. To accommodate the new patio seating, modifications include 41" tall hand rails enclosing the patio area as required by fhe State's Department of Alcoholic Beverage Control (ABC) in order to permit outdoor alcohol service. The proposed railing comprises of stained grade wood with cable wires and black metal posts. The project is considered minor, and will enhance the customer and pedestrian experience of Main Street Cupertino. ' A�B'��10T I�I � The Director of Community Development deems the modification minor and approves the projecf with the following conditions of approvaL• 1. APPROVED EXHISITS Approval is based on exhibits titled "Panino Giusto TT" prepared by Craig Miers+George Scott Architects, consisting of two (2) sheets labeled A2.1 —A2.2, dated December 15, 2015 except as may be amended by the conditions contained in this resolution. 2. ANNOTATION OF THE CONDITIONS OF APPROVAL 'The conditions'of approval set forth shall be incorporated into and annotated on the building plans. 3. ACCURACY OF THE PROTECT PLANS , The applicant/property owner is responsible to verify all pertinent property data including but not limited to properfy boundary locations, builduzg setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and may require additional review. 4. CONSULTATION WITH OTHER DEPARTMENTS , I' The applicant is responsible for consulting other departrnents and/or agencies with regard to the proposed project for additional conditions and requirements. INDEMNIFICATION Except as otherwise prohibited by law, the applicant shall indeinilify and hold harmless the City, its City Council, and its officers, employees and agents (collectively, the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against one or more of the indernnified parties or one or more of the indemnified parties and the applicant to attack, set aside, or void this Resolution or any,permit or approval authorized hereby for the ' , project, including (without limifation) reimbursing fhe City its actual attorneys' fees and costs , incurred in defense of the litigation. The applicant shall pay such attorneys' fees and � costs within 30 days following receipt of invoices from City. Such attorneys' fees and costs shall '' include amounts paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly i related to the lifigation reasonably incurred by City. ', 6. NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are , hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun.
