Chapter 19.132 of the Cupertino 1Vlunicipal Code allows for adininisirative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within 14 calendar days. l�Ac�l[��G][Z��JI�Tll� The applicant, Jessica Wang, representing the property owner, is requesting to install trash enclosure improvements in response to the requirements of the City of Cupertino's Envirorunental Programs Division. �����.T����l� As part of the approval for the tenant improvement of a restaurant, the applicant was required to provide trash enclosure improvements. ���slla]E�a�ll.�s�°e: The project proposes two trash enclosures, one to serve the property at 20956 I�omestead Road and one to serve the property at 20916 Homestead Road. The new trash enclosures measure 16'-0" by 47'-6", and are located to the rear of the property. The structure will be setback 14'-4" from the property line, and 3'-6" from a Concreate 1Vlasonry Unit (CNN) wall. The building will have a maximum height of 12'-6", and a minimum height of 12'-2". The trash enclosure will be constructed of CNlU block wall,with a metal roof and metal doors. lL9�rflcg�g: The new trash enclosure will result in the removal of three parking spaces. In order to accommodate the loss of the parking spaces, the applicant has reduced the required parking spaces. This was done through a reduction in the number of seating at the restaurants. Therefore, the project will not reduce the amount of required parking. APPROVED EXHIBITS Approval is based on exhibits titled "Trash Enclosure Proposal" prepared by Jessica Wang, consisting of six (6) sheets labeled A-1 through A-9, dated 1VIay 18 and June 22, 2016 and the provided parking analysis, except as may be amended by the conditions contained in this resolution. 2. PREVIOUS CONDITIOlVS OF APPROVAL All prior conditions of approval through past approvals shall remain in effect unless superseded by or in conflict with subsequent conditions of approval and as specifically amended by this Director's 1Vlinor Modification approval. 3. AlVNOTATION OF THE CONDITIONS OF APPROVAL The conditions of approval set forth shall be incorporated into and annotated on the building plans. 4. ACCURACY OF THE 1'ROTECT PLANS � The applicant/property owner is responsible to verify all pertinent property data including but not limited to properiy boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and may require additional review. 5. BUILDIIVG PERNIIT REQUIRED This approval does not constitute building permit approval; a separate building permit is required. 6. EXTEIZIOR NlATERIAL 'I`he final color and material shall closely resemble the details shown on the approved plans, match the aesthetic of the existing structures, and shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. 7. CONSULTATION WITH O'THER DEPART'NIENTS The applicant is responsible for consulting other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 8. MODIFICATIONS OF APPROVED PLAN Any future modifications to the approved site plan including but not limited to, landscaping and parking design shall require additional review by the Planning Division with approval by the Community Development Director. Il�TDElVINIFICATION Except as otherwise prohibited by law, the applicant shall indemnify and hold harmless the City, its City Council,and its officers, employees and agents (collectively,the "indeinnified parties") from and against any claim, action, or proceeding brought by a third party against one or more of the indemnified parties or one or more of the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant shall pay such attorneys' fees and costs within 30 days following receipt of invoices from City. Such attorneys' fees and costs shall include arnounts paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. 10. NOTICE OF FEES DEDICATIONS RESERVATIONS OR OT�IER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest tYiese fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a); has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020,you will be legally barred from later challenging such exactions. This Director's approval is effective June 24,2016.
