Subject: Director's Mu1or Modification,DIR-2016-30, to allow the construction of a trash enclosure
at an existing commercial building located at 10275 S.De Anza Boulevard.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval
of minor changes in a project. The Director reports his decision to the City Council
and Planni�.lg Commission in time to allow an appeal of the decision within fourteen
calendar days.

The applicant, Justin Bautista, representing the property owners, is requesting to install trash
enclosure impx�ovements in response to the requirements of the City of Cupertino's Environmental
Programs Division.

As-part of the approval of the Crab Lover Restaurant within the Allario Shopping Center, the
applicant was required to provide trash enclosure improvements.The new trash enclosure measures
approximately 23'by 17'and is located in the rear of the building.The 8'-7"tall roofed trash enclosure
will be constructed of a CMU block wall with galvanized steel gate and a corrugated metal roof.
Although the inclusion of the trash enclosure will reduce parking by one stall,it has been found that
parkulg on-site will be sufficient.Further,the project will not require any tree reinovals, and will not
be visible from the public rigllt-of-way.

The Director of Community Development deems the modification minor and approves the project
with the following condifions of approvaL•
1. APPROVED EXHIBITS
Approval is based on exhibits titled "Seafood Restaurant, Tenant Ixnprovement" prepared by
RCUSA Corporation, consisting of two (2) slleets labeled A1.1, and A1.2a dated November 11,
2015, except as may be ainended by the conditions contai�led in tllis resolution.

2. PREVIOUS CONDITIONS OF APPROVAL
All prior conditions of approval through past approvals shall remain in effect unless superseded
by or in conflict with subsequent conditions of approval and as specifically amended by this
Director's Minor Modification approval.
3. ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions of approval set forth shall be incorporated into and annotated on the building
plans.
4. ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify alI pertinent property data including but
not limited to property boundary locations, building setbacks, property size, building square
footage, any relevant easements and/or consfxuction records. Any misrepresentation of any
property data may invalidate this approval and may require additional review.
5. BUILDING PERMIT RE UQ IRED
This approval does not constitute building permit approval; a separate building permit is
required.
6. EXTERIOR MATERIAL
The final color and material shall closely resemble the details shown on the approved plans,
match the aesthetic of the existulg structures,and shall be reviewed and approved by the Director
of Cornmunity Development prior to issuance of builduzg permits.
7. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible for consulting other departments and/or agencies with regard to the
- proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Departrnent.
8. IVIODIFIGATIONS OF APPROVED PLAN
Any future modifications to the approved site plan including but not limited to,landscapulg and
parkuZg design shall require additional review by tlle Plaruzulg Division with approval by the
Coxrununity Development Director.
9. INDEMNIFICATION
Except as otherwise prohibited by law,the applicant shall inden�uzify and hold harrnless the City,
its City Council, and its officers, employees and agents (collectively, the "indemnified parties")
from and against any claun, action, or proceeding brougllt by a third party agavlst one or more
of the indeinnified parties or one or more of the uldei�nni.fied parties and the applicant to attack,
set aside, or void this Resolution or any permit or approval authorized hereby for the project,
uzcluding (wifllout limitation) reimbursing the City its actual attorneys' fees and costs ulcurred
u1 defense of tlle litigation. The applicant shall pay such attorneys' fees and costs withul 30
days followulg receipt of ulvoices from City. Such attorneys' fees and costs shall include
amowlts paid to coiulsel not otherwise employed as City staff and s11all ulclude City Attoi-�Zey

time and overhead costs and other City staff overhead costs and any costs directly related to the
litigation reasonably incurred by Cify.
10. NOTICE OF FEES DEDICATIONS RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Govemment Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees,and a description of the dedications,reservations, and other exactions. You are hereby
further notified that the 90-day approval period in which you may protest these fees,dedications,
reservations, and other exactions,pursuant to Government Code Section 66020(a),has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of
Section 66020,you will be Iegally barred from later challenging such exactions.
This Director's approval is effective Jw.1e 22, 2016. The 14-calendar-day appeal period will conclude
on July 6, 2016.
