Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Corninission in time to allow a�z appeal of the decision within fourteen calendar days. ]�A��C�]l���JI�Tll� The applicant,Janice Yeh of Adaptive Architecture, representing the property owner Sonya Aikins, is requesting to install two shade structures at an existing clubhouse patio for Deep Cliff Golf Course at 10700 Clubhouse Lane. The request is in conjunction with interior tenant improvements that require site accessibility and trash enclosure improvements; therefore, the applicant is also ulstalling planters and upgrading their trash enclosure. ��S��JSS��l�T � The two shade structures will be permanently affixed in an open patio area located south of the clubhouse and will replace existing individual patio table umbrellas. The structures measure 20'-0" by 20'-0" with a peak height of 14'-6" and will match the existing warm earth-tone color palette. The current development is situated af grade with the adjacent surface parking and would require truncated domes to meet accessibility standards. The applicant proposes a combination of trw.zcated domes and planter boxes that are strategically piaced between existing support-columns to enhance the frontage while reducing the placement of truncated domes. The seven beige planter boxes are made of fiber reinforced plastic (FRl') and eaclz measures 6'-0" long by 1'-6" wide by 2'-0" high. Additionally, the applicant is required to provide trash enclosure improvements. The new trash enclosure measures 12-'6" by 12'-6" and is located within the existing frash receptacle pad south of DIR-2016-27 10700 Clubhoiise Larie Page 2 the parking lot. The 9'-10" tall roofed trash enclosure will be constructed of perforated steel mesh with galvanized steel gate and roof. The scope will not reduce parking and will not require any tree removals. A�'�'��l�T The Director of Community Development deems fhe modification minor and approves the project with the following conditions of approvaL• 1. APPROVED EXHIBITS Approval is based on exhibits titled "Deep Cliff Golf Course Clubhouse" prepared by Adaptive Architecture, consisting of four (4) sheets`labeled A0.1, A1.1, A1.3, and A1.4 dated May 13, 2016 and May 19, 2016,except as may be amended by the conditions contained in this resolution. 2. PREVIOUS CONDITIONS OF APPROVAL All prior conditions of approval through past approvals shall remain in effect unless superseded by or in conflict wifih subsequent conditions of approval and as specifically amended by this Director's Minor Modification approvaL 3. ANNOTATION OF THE CONDITIONS OF APPROVAL 'I'he conditions of approval set forth shall be incorporated into and annotated on the building plans. � � ) � 4. ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including kiut , not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and may require additional review. 5. BUILDING PERMIT REQUIRED This approval does not constitute buildulg permit approval; a separate building permit is required. 6. EXTERIOR MATERIAL The final color and material shall closely resemble the details shown on the approved plans, � match the aesthetic of the existing sfructures, and shall be reviewed and approved by the Director of Community Developmenf prior to issuance of building permits. 7. GONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible for consulting other departments and/or agencies with regard to tlle proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 8. MODIFICATIONS OF APPROVED PLAN Any future modifications to the approved site plan including but not Iimited to, landscaping DIR-2016-27 10700 Clubhouse Lane Page 3 and parking design shall require additional review by the Planning Division with approval by the Community Development Director, 9. INDEMNIFICATION Except as otherwise prohibited by law, the applicant shall indemnify and hold harmless the City, ifs City Council, and its officers, employees and agents (collectively, the "indemnified parties") from and against any claim, action, or proceeding brought by a thi_rd party against one or more of the indemnified parties or one or more of the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant shall pay such attorneys' fees and costs withu130 days following receipt of invoices from City. Such attorneys' fees and costs shall include amounts paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. 10. NOTICE OF FEES,DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified Ehat the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020,you will be legally barred from Iater challenging such exactions. This Director's approval is effective May 26, 2016.
