Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Plai-u1v1g Commission in time to allow an appeal of the decision within fourteen calendar days. ]�l��][��GIl��Nl�TIl� The applicant, Buzz Bryan, repr.esenting Pan American Collision Center, is proposing exterior fa�ade and site improvements of an existing mixed-use office/warehouse building located at 10218 Imperial Ave. The proposal requires administrative approval due to the site's planned development zoning designation. 'I`he site is zoned as P(ML) for planned light industriaL ll����C�J����l�T The project proposes no structural modifications to the building. The proposed modifications focus on fa�ade upgrades to the existing structure. Exterior modifications include: � Removal of a shingle mansard roof and decreasing the height of the structure � New cement plaster and cola�r � New metal canopies � New aluininum and glass storefront Site modification includes � Restriping the existing parking area: � Landscape diamonds in the interior parking area � Landscape frontage improvements DIR-2016-06 10218 Imperial Avenue Page 2 , Public Works (Engineering)has reviewed the proposal, and added a condition of approval for surety bond for future frontage improvements;which will be provided by the applicant prior fo issuance. Public Works (Environmental Programs)has reviewed the proposal, and added the condition to provide storm drain inlet markers.The Applicant has sllown these on the plan set, and has been ulcluded as a condition of approval to be installed prior to building permit fiizal. 1��'�'g�N ; The Director of Community Development deems tlle modification minor and approves the project with the following conditions of approvaL• ; 1. APPROVED EXHIBITS The approval is based on a plan set entitled, "Office Warehouse for Pan American Collision Center, 10218 Imperial Ave. Cupertino, CA" consisting of seven sheets labeled"A.01 to A.05, and EX.01 and EX.02" dated Apri14, 2016, except as inay be amended by conditions u1 this resolution. 2. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departmenfis and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the CommLulity Development Department. 3. BUILDING PERMITS The applicant shall consult with the City Building Division to obtaul the necessary building permits for the uzstallation of the aerials and associated equipment. 7. SURETY BOND FOR FRONTAGE IMPROVEMENTS Applicant shall provide the City with a non-refiuldable cash surety bond that may be utilized by the City for installation of frontage improvements (including but not Iimited to curb, gutter, sidewallc and related facilities) along Imperial Ave adjacent to the property. The applicant will be required to install frontage improvements when directed to do so by the City Engineer. In the event that the applicant is unwilling or unable to install the frontage improvements when directed to do so by the City Engineer, the City may, at its discretion, utilize the surety bond monies to administer,design and/or install the frontage improvements as necessary for the public good. The surety bond amount shall be equivalent fo 115% of tlle estimated cost to construct the improvements. 8. STORM DRAIN INLET MARKERS Storm draul u-�let markers:All storm draul uzlets on the property shall be clearly marked with "No Dumping Flows to Creek" or "No Duxnping Flows to Bay". Example of drain u11et markers may be viewed at www.cupertino.org/nowaste. Markers must be ulstalled prior to building permit final approval[9.18.210(4)(A) CMC] 9. INDEMNIFICATION , To the extent permitted by law, the Applicant shall indemnify and hold 1larmless the City,its City Council,its officers,employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against t11e uZden�u�ified parties and the applicant to attack, set aside,or void this ordulance or any permit or approval authorized hereby for the project,including(without limitation)reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. TI1e City may, in its sole discretion, elecf to defend any such action with attorneys of its choice. 10.
