Chapter 19.164 of the Cupertino Municipal Code allows for adininistrative approval of minor changes in a project. The decision is reported to the City Council and P1��u1u1g Coirunission in time to allow an appeal of the decision withi�l fourteen calendar days. �����JS���1�T The applicant, Julie He of DWK Construction, is requesting to move a previously approved second-floor balcony associated with Minor Residential Permit RM-2015-26 from the north- facing rear of the property to the east-facing side of a new single-family, two-story home, located at 18641 Cynthia Avenue; and any significant changes to a Min.or Residential perrnit require approval by the Director of Community Development. The proposed project is consistent with the City's ordinance and pertinent development standards and design guidelines due to being located within the building mass, unenclosed, and receiving approval from the adjacent neighbors. ��'g'��l�T The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: 1. APPROVED EXHIBITS Approval is based on plans titled "Lu Residence, 18641 Cynthia Avenue, Cupertino, CA 95014" consisting of seven pages titled "A1", "A4", "A5", "A6", "A7", "A8", "A9", and a document titled "Letter of Agreement", signed'by homeowners of the abovementioned property ("Party A") and the affected adjacent homeowners located at 18631 Cynthia Avenue ("Party B") dated May 10�, 2016; except as may be amended by conditions contained in this resolution. 2. CONSULTATION WITH OTHER DEPARTMENTS The applicant is iesponsible to consult with other depart�nents and/or agencies with regard DIR-2016-15 1�641 Cynthia Avenue � Page 2 to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development I�epartment. 3. ENCLOSING OF BALCONY The property owner shall record a covenant stating that the east-elevation balcony shall be maintained as an open-air feature and shall not be enclosed. 4. BUILDING PERIVIIT The applicant shall be required to obtain the necessary building permits through the Building Division prior to commencement of work. 5. INDEMNIFICATION To the extent permitted by law, the Applicant shall inde�ulify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and ✓ against any claim, action, or proceeding brought by a third party against the indeirmified parties and the applicant to attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project, including (without limitation) reirnbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The City may, in its sole discretion,elect to defend any such action with attorneys of its choice. 6. NOTICE OF FEES DEDICATIOIVS RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Governrnent Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications,reservations, and other exactions. You are hereby fixrther notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a),has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions.
