Subject: Director's Minor Modification, DIR-2016-21, to allow the addition of 15-panel antennas
and associated equipment on an existing parking garage within Main Street Cupertino
located at 19500 Vallco Parkway.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval
of minor changes in a project. The Director reports his decision to the City Council
and P1aruling Commission in time to allow an appeal of the decision within fourteen
calendar days.
BACKGROUND
On September 4, 2012 City Council approved the Main Street Cupertino mixed use project
consisting of 130,500 square feet of retail, a 180-room hotel, a five-level parking garage with two
levels of underground parking, 260,000 square feet of office, a 120-unit market-rate live/work rental
loft residential development with a 9,146-square-foot retail condominium unit and shared parking
plan.

The project incorporates twelve separate commercial/retail buildulgs labeled as Pads 1-3, Shops 1-8,
Major Retail, and Flex 1-2. The subject property, was previously reviewed and approved through
Ia:IIi-201.b-21.

the master permits (M-2013-03, and ASA-2012-15) for the use of space, architectural style of the
�, building, landscaping, and parking requirements. The office and commercial components of the
project have been constructed. The apartments, hotel, park, major retail, and shop 6 are under
construction.
The applicant, Pamela Nobel, representing Verizon Wireless, is requesting to allow the addition of
fifteen (15) panel antennas and associated equipment on the parkulg garage elevator tower. No
changes are proposed to the garage structure.
DISCUSSION
The proposed Verizon personal wireless service facility consists of 15-panel antennas mounted at a
height of about 74.5 feet above grade on the roof of the parking garage elevator tower, extending
approximately five (5) feet above tlle existing parapet wall. However, a new 5.5-foot tall FRP screen
wall, painted and textured to match existing parapet is proposed to conceal the aerials and existing
exposed elevator equipment. Municipal Code section 19.136.050 allows for aerials to extend six (6)
feet above a parapet wall before requiring a height exception.
The Radio Frequency (RF) energy emissions report indicates that the RF energy emissions at
ground level is 1.5% of the FCC's general public limit for exposure. The project will thus comply
with the City's Wireless Facilities Master Plan and the City's Wireless Communications Facilities
Ordinance (CMC chapter 19.136).

The Director of Community Development deems the modification minor and approves the project
with the following conditions of approvaL•
1. APPROVED EXHIBITS
Approval is based on exhibits titled "Verizon Wireless" prepared by Diamond Engineering
Services, consisting of eleven (11) sheefs labeled T1, C-1 — C-3, A1 — A5, AD1, and AD2, dafed
March 31, 2016 except as may be amended by the conditions contained in this resolufion.
2. ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions of approval set forth shall be incorporated into and annotated on the building
plans.
3. ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including but
not limited to property boundary locations, building setbacks, properiy size, building square
footage, any relevant easements and/or construction records. Any misrepresentation of any
property data may invalidate this approval and may require additional review.
4. EXTERIOR MATERIAL
The final color and material shall closely resemble the details shown on the approved plans and
shall be reviewed and approved by the Director of Community Development prior to issuance
- of building permits. -
5. SCREENING
All mechanical and other equipment on the building or on the site shall be screened so they are
not visible from public street areas or adjoining developments. Screening materials/colors shall
match building features and materials. The height of the screening shall be taller than the 1leight
of the mechanical equipment that it is designed to screen. The location of equipment and
necessary screening shall be reviewed and approved by the Director of Community
Development prior to issuance of building permits.
6. REVIEW OF LIGHTING
Prior to final occupancy, plaruling staff wi11 review the proposed lighting to confirm�that the
lights installed are in conformance with the proposed lighting in the approved plans and the
lighting standards as defined in Municipal Code Chapter 19.124.
7. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible for consulting other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.

8. INDEMNIFICATION
Except as otherwise prohibited by law, the applicant shall indeinnify and hold harmless the
City, its City Council, and its officers, employees aizd agents (collectively,the "indemnified
parties ) from and against any claim, action, or proceeding brought by a thi_rd party against one

or inore of the uldeinnified parties or one or more of the indeinnified parties and the applicant
to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the
project, including (without limitation) reimbursing the City its actual attorneys' fees and costs
incurred in defense of the litigation. The applicant shall pay such attorneys' fees and
costs withu130 days following receipt of invoices from City. Such attorneys' fees and costs shall
include amounts paid to counsel not otherwise employed as City staff and shall include City
Attorney time and overhead costs and other City staff overhead costs and any costs directly
related to the litigation reasonably incurred by City.
9. NOTICE OF FEES,DEDICATIONS RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are
hereby further notified that the 90-day approval period in whicll you may protest these fees,
dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90-day period complying with all of the
requirements of Section 66020,you will be legally barred from later challenging such exactions.
This approval of the modification is effective May 19, 2016. The fourteen calendar day appeal
period will expire on June 2,2016.

Wireless, a personal wireless telecommunications carrier,to evaluate the base station(Site No. 181396
"Vallco Shopping Center")proposed to be located at 19500 Vallco Parkway in Cupertino, California,
for compliance with appropriate guidelines limiting human exposure to radio frequency ("RF")
electromagnetic fields.

Verizon proposes to install directional panel antennas above the five-story parking structure
located at 19500 Vallco I'arkway in Cupertino. The proposed operation will coinply with the
FCC guidelines limiting public exposure to RF' energy.

The U.S. Congress requires that the Federal Communications Commission ("FCC") evaluate its
actions for possible significant impact on the environment. A summary of the FCC's exposure limits
is shown in Figure 1. These limits apply for continuous exposures and are intended to provide a
prudent margin of safety for all persons, regardless of age, gender, size, or health. The most restrictive
FCC limit for exposures of unlimited duration to �adio frequency energy for several personal wireless
services are as follows:

Base stations typically consist of two distinct parts: the electronic transceivers (also called"radios" or
"channels") that are connected to the traditional wired telephone lines, and the passive antennas that
send the wireless signals created by the radios out to be received by individual subscriber units. The
transceivers are often located at ground level and are connected to the antennas by coaxial cables. A
small antenua for reception of GPS signals is also required, mounted with a c ar view of the sky.

Because of the short wavelength of the frequencies assigned by the FCC for wireless services, the
antennas require line-of-sight paths for their signals to propagate well and so are installed at some
height above ground. The antennas are designed to concentrate their energy toward the horizon, with
very little energy wasted toward the sky or the ground. This means that it is generally not possible for
exposure conditions to approach the maximum permissible exposure limits without being physically
very near the antennas.

The FCC provides direction for determining compliance in its Office of Engineering and Technology
Bulletin No. 65, "Evaluating Compliance with FCC-Specified Guidelines for Human Exposure to
l�adio Frequency Radiation," dated August 1997. Figure 2 describes the calculation methodologies,
reflecting the facts that a directional antenna's radiation pattern is not fully formed at locations very
close by (the "near-field" effect) and that at greater distances the power level from an energy source
decreases with the square of the distance from it (the "inverse square law"). The conservative nature
of this method for evaluating exposure conditions has been verified by numerous field tests.

Based upon information provided by Verizon, including zoning drawings by Diamond Engineering
Services, dated March 31, 2016, it is proposed to install fifteen Andrew Model SBNHH-1D45A
directional panel antennas behind new a view screen to be constructed around the top of the elevator
penthouse at the five-story parking structure located at 19500 Vallco Parkway in Cupertino.
The antennas would employ up to 7° downtilt and would be mounted at an effective height of about
721/z feet above ground, 18'/z feet above the roof deck. One group of three antennas would be oriented
toward 0°T, and three groups of four antennas would be oriented toward 90°T, 180°T, and 270°T.
The maximum effective radiated power in any direction would be 12,270 watts, representing
simultaneous operation at 5,220 watts for AWS, 4,890 watts for PCS, and 2,160 watts for 700 MHz
service; no operation on cellular frequencies is presently proposed from this site. There are reported
no other wireless telecommunications base stations at the site or nearby.

For a person anywhere at ground, the maximum RF exposure level due to the proposed Verizon
operation is calculated to be 0.0074 inW/cm2, which is 1.5% of the applicable public exposure limit.
The maximum calculated level at the top-floor elevation of any nearby building� is 3.5% of the public
exposure limit. The maximum calculated level at the second-floor elevation of any nearby residence�

assumptions and therefore are expected to overstate actual power density levels froin the proposed
operation.

Due to their mounting locations and height, requiring a climb up a locked ladder through a hatch to
reach the penthouse roof, the Verizon antennas would not be accessible to unauthorized persons, and
so no mitigation measures are necessary to comply with the FCC public exposure guidelines. To
prevent occupational exposures in excess of the FCC guidelines, it is recon�unended that appropriate
IZF safety training, to include review of personal monitor use and lockout/tagout procedures, be
provided to all authorized personnel who have access to the roof, including employees and contractors
of Verizon and of the property owner. No access within 25 feet directly in front of the Verizon
' antennas themselves, such as might occur during certain maintenance activities, should be allowed
while the base station is in operation, unless other ineasures can be demonstrated to ensure that
occupational protection requirements are met. It is recommended that explanatory signs$ be posted at
the hotel and on the screen in front of the antennas, readily visible from any angle of approach to
persons who might need to work within that distance.

Based on the information and analysis above, it is the usidersigned's professional opinion that
operation of the base station proposed by Verizon Wireless at 19500 Vallco Parkway in Cupertino,
California, will comply with the prevailing standards for limiting public exposure to radio frequency
energy and, therefore, will not for this reason cause a significant impact on the environment. The
highest calculated level in publicly accessible areas is much less than the prevailing standards allow
for exposures of unlimited duration. This finding is consistent with measurements of actual exposure
couditions taken at other operating base stations. Training authorized personuel and posting
explanatory signs are recommended to establish compliance with occupational exposure limits.
� Signs should comply with OET-65 color, symbol, and content recommendations. Contact infonlzation should be
provided(e.g.,a telephone nuinber)to arrange for access to restricted areas. The selection of language(s)is not an

The U.S. Congress required (1996 Telecom Act) the Federal Communications Commission ("FCC")
to adopt a nationwide human exposure standard to ensure that its licensees do not, cumulatively, have
a significant impact on the environment. The FCC adopted the limits from Report No. 86, "Biological
Effects and Exposure Criteria for Radiofrequency Electromagnetic Fields," published in 1986 by the
Congressionally chartered National Council on Radiation Protection and 1Vleasurements ("NC1ZP").
Separate limits apply for occupational and public exposure conditions, with the latter limits generally
five times more restrictive. The more recent standard, developed by the Institute of Electrical and
Electronics Engineers and approved as American National Standard ANSI/IEEE C95.1-2006, "Safety
Levels with Respect to Human Exposure to Radio Frequency Electromagnetic Fields, 3 kHz to
300 GHz," includes similar limits. These limits apply for continuous exposures from all sources and
are intended to provide a prudent margin of safety for all persons, regardless of age, gender, size, or
health.
As shown in the table and chart below, separate limits apply for occupational and public exposure
conditions, with the latter limits (in italics and/or dashed)up to five times more restrictive:

levels also are allowed for exposures to small areas, such that the spatially averaged levels do not
exceed the limits. However,neither of these allowances is incorporated in the conservative calculation
formulas in the FCC Office of Engineering and Technology Bulletin No. 65 (August 1997) for
projecting field levels. Hammett & Edison has built those fornzulas into a proprietary program that
calculates, at each location on an arbitrary rectangular grid, the total expected power density from any
number of individual radio sources. The program allows for the description of buildings and uneven
terrain, if required to obtaiii more accurate projections.

(omnidirectional) antennas, typical at wireless telecommunications base stations, as well as dish
(aperture) antennas,typically used for microwave links. The antenna patterns are not fully formed in
the near field at these antennas, and the FCC Office of Engineering and Technology Bulletin No. 65
(August 1997) gives suitable formulas for calculating power density within such zones.
