Subject: Director's Minor Modification (DIR-2016-25) to allow the removal and
replacement of six existing antennas and the addition of a new antenna and associated
equipment on the roof of an existing office building located at 10420 Bubb Road.
Chapter 19.164 of the Cupertino Murucipal Code allows for administrative
approval of minor changes in a project. The Director reports his or her
decision to the City Council and Planning Commission in time Eo allow an
appeal of the decision within 14 calendar days.

Caitlin IVIcLester, Modus Corporation, is proposing to remove and replace six existing
� antennas and add one (1) panel antenna and associated equipment for T-Mobile on its
existing personal wireless service facility located on fihe roof of an office building at
� 10420 Bubb Road. No increase is proposed in the height of the facility, or expansion of
the existing equipment pad.

The existing T-Mobile personal wireless service facility consists of six panel antennas
mounted at a height of about 35 feet above grade on the roof of an office building. The
proposed modification adds one new antenna to the wireless facility at the same height
as the existing antennas. The Radio Frequency (RF) energy emissions report indicates
that the RF energy emissions at the main roof level are 54.9% of the FCC's general
public limit for exposure. The project will thus comply with the City's Wireless
Facilities Master Plan and the City's Wireless Communications Facilities Ordinance
(CMC chapter 19.136).
Recent federal regulations, per section 6409 of the Middle Class Tax Relief and Job
Creation Act of 2012, limit the ability of cities to regulate the modification of existing
personal wireless service facilities. The T-Mobile proposal falls within this federal

legislation and must be approved by the City. Staff continues to monitor changes in
state and federal wireless legislation and will notify decision makers of its impacts on
local wireless facility regulation.

ACTION
In accordance with Cupertino Municipal Code Section 19.164, the Director of
Community Development deems the modification minor and approves the
modification described in the plan set titled: "T-Mobile Site Number SF04569A"
prepared by All States Engineering & Surveying, and consisting of ten (10) sheets
labeled T-1, GN-1, GN-2, GS-1, and A-1 through A-5, last revised 10/28/15, except as
may be modified by the conditions enumerated below.
1) BUILDING PERMIT REQUIRED
This approval does not constitute building permit approval; a separate building
permit is required.
2) ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data
including but not limited to property boundary locations, building setbacks,
property size, building square footage, any relevant easements and/or construction
records. Any misrepresentation of any property data may invalidate this approval
and require additional review.

3) .CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with
regard to the proposed project for additional conditions and requirements. Any ,
misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
4) ABANDONMENT
In the event the antennas, associated equipment, or any portion of the facility
thereof, are left unused for a period of 18 months, the property owner or applicant
shall bear the entire cost to remove the subject equipment and to restore the site to
its previous condition.
5) RADIO FREQUENCY ENERGY EXPOSURE
The independent and cumulative emissions for the proposed facilities shall meet
Federal Communications Commission regulations and guidelines to prevent public
exposures to radio frequency energy emissions that are in excess of federal safety
standards. Any cautionary signage should be in multiple Ianguages, including
Eriglish and Spanish.
6) NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant to
Government Code Section 66020(d) (1), these Conditions constitute written notice of
a statement of the amount of such fees, and a description of the dedications,
reservations, and other exactions. You are hereby further notified that'the 90-day
, approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you
fail to file a protest within this 90-day period complying with all of the requirements
' of Section 66020, you will be legally barred from later challenging such exactions.
7) INDEMNIFICATION
Except as otherwise prohibited by law, the applicant shall indemnify and hold
harmless the City, its City Council, and`its officers, employees and agents
(collectively, the "indemnified part�es") from and against any claim, action, or
proceeding brought by a third party against one or more of the indemnified
parties or one or more of the indemnified parties and the applicant to attack, set
aside, or void this Resolution or any permit or approval authorized hereby for the
project, including (without limitation) reimbursing the City its actual attorneys' fees
and costs incurred in defense of the litigation. The applicant shall pay such
attorneys' fees and costs within 30 days following receipt of ulvoices from City.

Such attorneys' fees and costs shall include amounts paid to counsel not otherwise '
employed as City staff and shall include City Attorney time and overhead costs and
other City staff overhead costs and any costs directly related to the litigation
reasonably incurred by City.
This approval is effective May 10, 2016. The 14-calendar-day appeal period will expire
on May 24, 2016.

EBI Consulting was directed to analyze the Proposed T-Mobile rooftop facility located at 10420 Bubb
Road in.Cupertino, California for the purpose of determining whether the emissions from the Proposed �
T-Nlobile Antenna Installation located on this property are within specified federal limits. This report
contains a detailed summary of the RF EME analysis for the site.
All information used in this report was analyzed as a percentage of current Maximum Permissi6le
- Exposure (% MPE) as listed in the FCC OET Bulletin 65 Edition 97-Oland Ai�SUIEEE Std C95.1. The
FCC regulates Nlaximum Permissible Exposure in units of microwatts per square centimeter (µW/cm2),
The number ofµW/cmz calculated at each sample point is called the power density. The exposure limit
: for power density varies depending upon the frequencies being utilized. Wireless Carriers and Paging
` Services use different frequency bands each with different exposure limits, therefore it is necessary to
report results and limits in terms of percent MPE rather than power density.
Alt results were compared to the FCC (Federal Communications Commission) radio frequency
exposure rules, 47 CFR I.I 307(b)(I) — (b)(3), to determine compliance with the I`laximum Permissible
Exposure (MPE) limits for General Population/Uncontrolled environments as defined below.
General:population/uncontrolled exposure limits apply to situations in which the general public may be
exposed or in which persons who are exposed as a consequence of their employment may not be made
fully aware of the potential for exposure or cannot exercise control over their exposure. Therefore,
members of the general public would always be considered under this category when exposure is not
employment related, for example, in the case of a telecommunications tower that exposes persons in a
nearby residential area.

Public exposure to radio frequencies is regulated and enforced in units of microwatts per square
centimeter (µVN/cm2). The general population exposure limit for the 700 and 800 I`1Hz Bands is 467
µV�//cmz and 567 µVN/cm2 respectively, and the general population exposure limit for the PCS and AWS
bands is I OOO µW/cmz. Because each carrier will be using different frequency bands, and each frequency
band has different exposure limits, it is necessary to report percent of f`1PE rather than power density.
Occupational/controlled exposure limits apply to situations in which persons are exposed as a
consequence of their employment and in which those persons who are exposed have been made fully
aware of the potential for exposure and can exercise control over their exposure.
Occupational/controlled exposure limits also apply where exposure is of a transient nature as a result of
incidental passage through a location where exposure levels may be above general
1 �`population/uncontrolled limits (see below), as long as the exposed person has been made fully aware of
the potential for exposure and can exercise control over his or her exposure by leaving the area or by
some other appropriate means.

Calculations were done for the Proposed T-f`lobile Wireless antenna rooftop facility located at 10420
Bubb Road in Cupertino, California using the equipment information listed below. /�II calculations were
performed per the specifications under FCC OET 65. Because of the short wavelength of PCS services,
' the antennas require line-of-site paths for good propagation, and are typically installed a distance above
ground level. Antennas are constructed to concentrate energy towards the horizon, with as little energy
as possible scattered towards the ground or the sky. This design, combined with the low power of PCS
facilities, generally results in no possibility for exposure to approach Maximum Permissible Exposure
(MPE) levels, with the exception of in areas in the immediate vicinity of the antennas.
For all calculations, equipment was calculated using the following assumptions:
I) 2 GSM / UMTS channels (PCS Band — 1950 MF-Iz) were considered for each sector of the
Proposed installation. The transmit power for these channels is 30 watts per channel.
2) 2 LTE channels (AV�/S Band —2100 NiHz) were considered for each sector of the Proposed
installation. The transmit power for these channels is 60 watts per channel.
3) I LTE channel (700 MHz Band) was considered for each sector of the Proposed installation.
The transmit power for this channel is 30 watts.
4) All radios at the Proposed installation were considered to be running at full power and were
uncombined in their RF transmissions paths per carrier prescribed configuration. Per FCC
OET Bulletin No. 65 - Edition 97-01 recommendations to achieve the maximum anticipated
value at each sample point, all power levels emitting from the Proposed antenna installation
are increased by a factor of 2.56 to account for possible in-phase reflections from the
surrounding environment. This is rarely the case, and if so, is never continuous.
5) EBI has performed theoretical worst case modeling using Roofview0 to estimate the
maximum potential power density from each antenna based on worst-case assumptions for
the number of antennas and power.
6) The Data for all T-I`lobile antennas used in this analysis is shown below in Table I. Actual
antenna gains for each antenna were used per manufacturer's specifications.
7) There are no additional carriers located on this facility.

Some calculations performed for this analysis yielded results that were above the allowable limits for
exposure to RF Emissions. Based on predictive modeling, the worst-case emitted power density may
exceed the FCC's general public limit within approximately 4 feet of the D2 antenna, within 3 feet of the
Sector C and D I antennas, and within 2 feet of the Sector A antennas at the sloped roof level. Modeling
indicates that there are no predicted exceedances of the FCC's occupational limit at the sloped rooftop
and no exceedances of the FCC's general public or occupational limits at the main roof level. T-I`lobile
can bring this site into compliance by posting the recommended signage per this report.
The anticipated maximum contribution from each sector of the T-f�lobile facility is 226.7000% of the
allowable FCC established general public limit (45.3400% of the FCC occupational limit). This was
determined through calculations along a radial from each sector taking full power values into account as
well as actual vertical plane antenna gain values per the manufacturers supplied specifications for gain.
Since there are no other carriers on site this value will determine whether the site itself is in compliance
with regards to electromagnetic emissions or whether mitigation solutions may be required to bring the
site into compliance. Additionally modeling was done at the main roof level and the maximum MPE value
� for this site is 54.9 percent of the FCC's general public limit (I 0.98 percent of the FCC's occupational
limit).
FCC guidelines state that if a site is found to be out of compliance (over allowable thresholds), that
carriers over a 5% contribution to the composite value will require measures to bring the site into
eompliance. For this facility, the composite values calculated were above the allowable I00% threshold
standard per the.federal government.
EBPs modeling indicates that there are areas in front of the T-I`lobile antennas at the sloped rooftop
level that exceed the FCC standards for general public exposure. In order to alert any workers
potentially accessing the site, a blue i�lotice is recommended at the first point of access to the rooftop.
Additionally, yellow Guidelines signs and yellow Caution signs are recommended in front of and on the
back of the T-Mobile antennas at each sector to alert workers they are entering areas that exceed the
FCC's general population and/or occupational MPE levels. Recommended signs are depicted on the
Signage Plan—Appendix B.
