F1nal builcling exterior treatment plan(inclucling but not limited to cletails on exterio�color,materlal,
architect-ural f�eat��nents and/or embellishments) shall be reviewed ancl app�oved by fhe Direcfor of
Community Development p�ior to issuance of building permits. The final builcling exte�ior plan
shall closely rese�nble the cletails shown on the orig�al approved plans. Any exterior changes
cleter�ninecl to be substantial by the I�irectop of Corr��nuni�y Development shall require a minor
rrio�ification approval with neighborhoocl input.
9. IlVDElVIl�TIFICATIOlV
Except as o-the�wise p�ohibltecl by law, the applicant shall�.clemr�ify ancl hold harmless the City, its
Cl� COUYlC1I, and its officers, employees and agents (collectively, the lnden�ifiecl pa�t�es ) f�o1n
and against any cla.im, action, o� p�oceecling brought by a thircl party against one or more of
��e ii�clemrtifiecl parties or one or more of the ir�.clemnified. par�es ancl the applicant to attaek, set
asicle, or voicl this Resolution or any permit or approva� authorizecl hereby fo� the project, including
(without lrznitation) reimbursing the City its actual attorneys' fees and costs incurrecl in clefense of
the lifigation. The applicant shall pay such attorneys' fees aricl costs with�30 clays following receipt
of invoices frorn City. Such attorneys' fees ancl costs shall include amoun�s�aicl to counsel not
othe�wise employed as City staff ancl shall�clude City Attorney time and overhead costs artd other
City s�aff ove�heacl costs and any costs clirectly relatecl to the litigat�on�easonab�y incurrecl by City.
10. 1VOTICE OF FEES DEDICATIONS I�ESERV.ATIONS OR OT�-IER EXACTIOlVS
The Conditions of Project Approval set fo�th herein may inclucle certain fees, cledication
�equirernents, reservation requi�ements, ancl other exactions. Pursuant to Government Code Section
66020(d) (1),these Conditions constitute written notice of a statement of the amount of such fees, ancl
a clescrip-�ion of the dedications, reservations, and other exactions. You are hereby further not�fied
that the 90-day approval periocl in which you may p�otest these fees, declications, reservations, and
other exac-�ons, pursuant to Government Code Section 66020(a), has begun. If you fail to file a
protest within this 90-day period co�nplying with all of the requirernents of Section 66020, you will
be legally barred from later challenging such exactions.
Please note that if this pe�mit is not vestecl within a year,it shall expire on A�ri121,2017.

adcliti.onal concli�ons were placecl as a conclition for app�oval by Cupe��o`s Municipal Code, Chapter
19.28.140(B).
1. The p�roject is consistent with the Cupertino General Plan, any applicable specific p�ans, zoning ordinances
and the purposes of this title.
The proposed projec� is consistent wi�h the General Plan as the project is with� the Low
Denslty land use area. The�e a�e no applicable specific plans that affect the pro�ect. The
project has been founcl to be consistent with the �equirements of Cupe�tino 1Vlunicipal Code
Chapter 19.2�Single Family(IZ-1)Residential.
2. The granting of the permit will not result in a condition that is detrimental or injurious to prope�ty
impYovements in the vicinity, and will not be detrimental to the public health, safety or welfare.
The granf�ng of the permit will not�esult in a concli-tion that is detri�ental or�jurious to
p�operty irnprovements�the vic�ity, and will not be cletrimental�o the publ�c health, safety
or welfare as the projects is locatecl within the R1-10 (S�gle F�ly Residential) zoning
clist�ict, artcl will be compatible with the surrouncling uses of the neighborhood.
3. The p��oposed�roject is harmonious in scale and design with tlie general neighborhood.
The pro�osecl project is located in a residential area consisting of��ngle family homes.The
proposed project maintains the single family hoine scale fo-und co�npatible with the general
neighborhood.
4. Adverse visual impacts on aajoining p��operties have been reasonably anitigated.
Any potential aclverse�npacfs on adjoining properties have been�easonably mit�gatecl
through the privacy p�otection plantings and�stallat�on of a front-ya�cl tree as required.
