Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Cominission in time to allow an appeal of the decision within fourteen calendar days. SACKGROUND The property owner, Kennetll Frangadakis of Civic Center Professional Group, is requesting to construct a roofed mechanical shelter and a new exit door and ramp for an existing dental office located at 10383 Torre Avenue as part of tenant improvements. The parcel is developed with three single-story office buildings with surface parking to the east and west of the buildings. DIR-2016-14 10383 Torre Avenue Page 2 ��S�gJSS��I�t The roofed shelter will consist of a new mechanical closest housing a dental air compressor, a vacuum pump, and an e�aust fan; a new wall-hung medical gas cabinet; and an existing telephone cabinet. The shelter is approximately 55 square feet in area and measured at a height of 11 feet at the highest point of the shed roof. The applicant proposes to utilize tile roof and painted stucco to match existing building wall and roof materials. The shelter will be enclosed on three sides with an open entrance way. The mechanical equipment will run periodically during the business hours of Monday-Friday from 8 a.m. to 5 p.m. and on Saturdays from 9 a.m. to 3 p.m. with periodic noise incidents that will not exceed the threshold for noise increment above the normaT standard and the duration of the noise within a two-hour period as prescribed in the Cupertino Municipal Code Section 10.48.050 - Brief Daytime Incidents. Furthermore, the mechanical closet will be insulated and fitted with solid core � doors with gaskets and the overall noise level is expected to not exceed 65 dBA at the source. Therefore, the operations will be within the City's day-time noise Ievels for non-residential properties and will not operate during the night-time hours. Additionally,the applicarit proposes two new windows on the east elevation, a new exif door with a new accessible ramp and modifications to an existing accessible ramp on the north elevation. Moreover, the applicant proposes minor floor area reductions to the subject and adjacent tenarit spaces to comply with ADA'regulations for depth and turning radius for accessible ramps. The scope will include removal of existing landscaping, but will not reduce parking, not require any tree removals, and no odors are expected from fihese dental utilities. APPROVED EXHIBITS Approval is based on exhibits titled "Cupertino Dental" prepared by Nielson Studios, consisting of six(6) sheets labeled A0.0,A1.0, A2.0, A2.1,A3.0, and A3.1 dated on April 20,2016, except as may be ainended by the conditions contained in this resolution. 2. PREVIOUS CONDITIONS OF APPROVAL All prior conditions of approval through past approvals shall remain in effect unless superseded by or in conflict with subsequent conditions of approval and as specifically amended by this Director's Minor Modification approval. 3. ANNOTATION OF THE CONDITIONS OF APPROVAL The conditions of approval set forfh shall be ulcorporated into and annotated on the building plans. DIR-2016-14 10383 Torre Avenue Page 3 4. ACCURACY OF THE PROTECT PLANS ' The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidafe this approval and may require additional review. 5. BUILDING PERMIT REQUIRED This approval does not constitute building permit approval; a separate building permit is required. 6. EXTERIOR MATERIAL The final color and material shall closely resemble the details shown on the approved plans, match the aesthetic of the bus shelters as approved in ASA-2015-03, and shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. 7. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible for consulting other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 8. MODIFICATIONS OF APPROVED PLAN Any futu.re modifications to the approved site plan including but not limited to, landscaping aild parking design shall require additional review by the Planning Division with approval by the Community Development Director. 9. INDEMNIFICATION Except as otherwise prohibited by Iaw, the applicant shall indemnify and hold harmless the City, its City Council, and its officers, employees and agents (collectively,the "indemrufied parties") from and against any claim, action, or proceeding brought by a third party against one or more of the indemnified parties or one or more of the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant shall pay such attorneys' fees and costs within 30 days following receipt of invoices from City. Such attorneys' fees and cosfs shall include amounts paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other Gity staff overhead costs and any costs directly related to the litigation reasonably incurred by City. 10. NOTICE OF FEES DEDICATIONS RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requireinents, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), DIR-2016-14 10383 Torre Avemie Page 4 has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020,you will be legally barred from later challenging such exactions. This Director's approval is effective Apri126, 2016.
