The required replacement trees are three 24-inch box irees or a combination of one 24-inch

removed without a Tree Removal Perrnit and that they shall be responsible for ensuring the
proper maintenance and care of the trees. The applicant shall also disclose the location and
species of all replacements trees on site upon sale of the property.

I was asked by Ellen Yau, Assistant Planner, City of Cupertino to inspect the remains of
Tree#209 and to provide an opinion regarding whether or not this tree had been an
Emergency Tree Removal.
Observations
I inspected the Tree#209 on March 3, 2016. Tree#209 was a Tulip tree (LiNiodend�on
tulipeNa).
Tree#209 had existed in a bed of English Ivy(Hede�a helix), which covered the view of
the shimp from a distance. However, the remains of the stump were visible upon
approaching the edge of the ivy bed.

The fact is that all of the trees in the immediate area,where Tree#209 had existed, are
showing signs of severe drought stress. Several of the other Tulip trees in this area have
very sparse canopies and appear to be dying. The tops of the Coast Redwoods in this
area are browning. These symptoms suggest that the irrigation system has become non-
functional in this area or the irrigation system in this area has been shut-off.
The tulip tree species (Li�iodend�on tulipife�a) and the coast redwood species (Sequoia
sencpe�vi�ens) are both high water volume consumers.
Also, it may be usefitl to note that ivy is a fierce competitor for moisture and nutrients.
As such, a bed of ivy is as strong of a competitor as other thirsty trees. At locations at
this site where ivy exists, one may expect the trees in the area to decline more sharply
compared to areas where no ivy exists.

Simply because a tree has died does not mean it is an immediate hazard. Dead trees often
remain standing for months, sometimes years.
However, if one was able to observe (prior to removal) a severe decayed area on the
trunk or on the root collar in combination with the faet the tree has died, the potential for
failure is much greater. A dead tree without any other indications that the wood has been
compromised is not an immediate hazard.
The definition of Tree Hazard requires that there be a target. The higher the value of the
target(the risk of life or serious injury is the highest level target, especially children; the
risk of damage to a structure or building is typically not the highest value rating), the
greater the risk or Hazard. In this case, there were no pedestrians at all during the period
that I visited the site in this immediate area. Only 3 or 4 vehicles passed by during tlie
time I was on site. It does not appear to be a high<use area. Also, it does not appear that
any portion of Tree#209 would have landed in the street, and, thus, have posed a risk to
passing vehicles.

Judging by the volume of decay found on the root collar of Tree#209, it is reasonable to
assume that decay of the root collar was visible prior to the removal, despite the fact that
there is no way I can be completely certain.

Based on my conchisions, I recom�nend that this case be given the benefit of the doubt
and that we presume the assessment of immediate hazard warranted the Emergency
removal.
C�r��ne�ata�y
Occasionally a pruning company calls me for advice on this matter, as they stand looking
at an individual tree. My advice is that they must be reasonably certain that the hazard is
imminent and that they should document the specific hazard (s) that they see with photos
and notes, in the event of an inquiry,prior to the removal:
L suggest that photos and at least brief notes be required in the fiiture concerning an
Emergency removaL Otherwise, the owner assumes the risk of the case judged as a
removal by intentionally avoidirig the permit process.

several other tulip trees in the immediate area.

Without any other information than the condition of the existing stump, I must conclude
that Tree#204 was not an immediate hazard.
In this case, without photos of the specific hazard(for example,photos of a cavity or
photos showing the extent of decay), this lack of information and the existing condition
of the stump does not warrant an Emergency removal.
