Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his.decision to the
City Council and Planning Coininission in time to allow any Councilmember or
Planning Com�nissioner to appeal the decision within fourteen calendar days.

The applicant, A.R.A. Creative Design, is proposing an addition to a single family home
in a Planned Development Zoning District with Residential Hillside densities. The
property is in a planned single-family residential development located near the NW
corner of Alpine Drive and Foothill Expressway. The property owner proposes to add a
total of 237 square feet to the existing 2,516 square foot residence by doing the
following:
■ Adding an office space on the northern side of the first floor;
■ Adding an exterior closet along the northern side of the garage; and
■ Adding a bathroom- a portion of which is being accommodated by demolishing
a portion of the existing three car garage;
In addition, the property owner is also proposing interior remodeling on the second
floor to relocate a staircase and separate an existing office/sitting area from the Master
Bedroom. '
The subject gross 1ot size is 20,908 square feet. There is a Santa Clara Valley Water
District easement on the subject lot of a total of 2,�71 square feet. Therefore, the subject
net lot area is 18,037 square feet. The proposed additions will increase the Floor Area
Ratio of the subject property from 23.02% to 24.34%.
The proposed additions are within the building envelope specified in the Use Permit
(16-U-77) for the property. The new first floor office and bedroom expansion are not
visible from the street and will not have any negative visual impacfs.

The Director of Community Development deems the modification minor and approves
the application DIR-2016-04 with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibifs titled "The Cohen Residence" prepared by A.R.A Creative
Designs, consisting of nine (9) sheets received on February 21, 2016, except as may be
amended by the conditions contained in this resolution.
2. PREVIOUS CONDITIONS OF APPROVAL
All prior conditions of approval through past approvals shall remain in effect unless
superseded by or in conflict with subsequent conditions of approval and as specifically
amended by this Director's Minor IVlodification approval.
3. ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions of approval set forth shall be incorporated into and annotated on the
building plans. I
4. ACCURACY OF THE PROTECT PLANS '
The applicant/property owner is responsible to verity all pertinent properiy data including
but not limited to property boundary locations, building setbacks, property size, building
sguare footage, any relevant easements and/or construction records. Any misrepresentation '
of any property data may invalidate this approval and may require additional review.
5. BUILDING PERIVIIT REQUIRED
This approval does not constitute building permit approval; a separate building permit is
required.
6. EAVE OVERHANG
Prior to building permit issuance, the applicant shall modify the plans to ensure that the
length of fhe roof eave overhangs of the addition matches the length of the eave overhangs
of the existing home.
7. EXTERIOR MATERIAL
The final color and material shall closely resemble the details shown on the approved
plans, match the existing materials and colors, and shall be reviewed and approved by the
Director of Community Development'prior to issuance of building permits.
8. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible for consulting other departmenfs and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation

of any submitted data may invalidate an approval by the Community Development
Depariment.
9. INDEMNIFICATION
Except as otherwise prohibited by law,the applicant shall indemnify and hold harmless the
City, its City Council, and its officers, employees and agents (collectively,the "indeirulified
parties") from and against any claim, action, or proceeding brought by a third party
against one or more of the indemnified parties or one or more of the indexnnified
parties and the applicant to attack, set aside, or void this Resolution or any permit or
appro�al authorized hereby for the project, including (without limitation) reimbursing the
City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant
shall pay such attorneys' fees and costs within 30 days following receipt of invoices from
City. Such attorneys' fees and costs shall include amounts paid to counsel not otherwise
employed as City staff and shall include City Attorney time and overhead costs and other
City staff overhead costs and any costs directly related to the litigation reasonably incurred
by City.

10. NOTICE OF FEES DEDICATIONS RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government '
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications,reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a),has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective March 3,2016. The fourteen calendar day appeal
period will expire on March 18,2016.
