ORDINANCE NO. 1753
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ADOPTING AMENDMENTS TO THE STEVENS CREEK BOULEVARD SPECIFIC
PLAN (THE HEART OF THE CITY) WHICH DEFINE APPROPRIATE LAND USES
AND INTENSITIES FOR LAND IN THE CITY CENTER AREA AND APPROVES
THE TRANSFER OF 141,000 SQUARE FEET OF OFFICE DEVELOPMENT ALLOCATION
FROM APPLE COMPUTER TO SYMANTEC CORPORATION FOR AN OFFICE
BUILDING PROJECT IN THE CITY CENTER AREA (APPLICATION NO. 81,152)
WHEREAS, the City Council of the City of Cupertino has received an application to
amend the Stevens Creek Boulevard Specific Plan (Heart of the City) from the Planning
Commission; and
WHEREAS, the Planning Commission has noticed and held at least one public hearing
on the specific plan amendment proposals and has made a written recommendation on the
proposals; and
WHEREAS, the City Council has conducted at least one noticed public hearing on the
proposed specific plan amendments attached hereto as Exhibit "A-I" and "B-1" and finds that:

The amendments provide a mixture of land uses in the City Center area that
would better promote the goal of increasing pedestrian activity; and
2)
The amendments define maximum building heights in keeping with City urban
design concepts, particularly in stepping buildings away from the street; and
3)
The City Council approved the transfer of 141,000 square feet of office
development allocation from Apple Computer to Symantec Corporation for an
office project at City Center on September 3, 1996 and that the specific plan was
not amended by ordinance as required by state law;
This ordinance rectifies this oversight and reaffirms the decision of the City
Council taken at its public hearing of September 3, 1996, and this specific plan
amendment is described in Exhibit "A-I";
The specific plan amendments are consistent with the Cupertino General Plan.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
I. That the text and map amendments described in attached Exhibit "A-I" and "B-1"
are hereby adopted and made a part of the Stevens Creek Boulevard Specific Plan.
2. That this ordinance shall take effect and be in force thirty (30) days after its
passage.
