CC Resolution No. 04-282 RESOLUTION NO. 04-282 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO APPROVING A POLICY TO REQUIRE THE VIRTUAL ELIMINATION OF MERCURY FROM CONTROLLABLE SOURCES THAT MAY AFFECT URBAN RUNOFF DUE TO MUNICIPAL OPERATIONS WHEREAS, the u.S. Environmental Protection Agency has listed the South San Francisco Bay and the Guadalupe River Watershed as impaired by mercury under Section 303(d) of the Clean Water Act; and WHEREAS, the City's recently revised National Pollutant Discharge Elimination System (stormwater) permit provision C.9.c.i requires that all permittees establish a policy for the virtual elimination of mercury ftom controllable sources in urban runoff, including the identification of mercury-containing products used by the jurisdictions and a schedule for their timely phase out; and WHEREAS, the Santa Clara Valley Urban Runoff Pollution Prevention Program (SCVURPPP) has developed a Mercury Pollution Prevention Plan (Mercury Plan) consistent with this provision, which include regional efforts as well as local efforts; WHEREAS, proper recycling and disposal methods for mercury-containing products, as is the practice now, will be part of the pollution prevention plan for those products that cannot be completely eliminated due to technological, safety, or economic factors. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cupertino hereby approves the "Policy to Require The Virtual Elimination of Mercury In Municipal Operations."
