Staff Presentation: Gary Chao, Assistant Planner, briefly described the project. Staff
recommends approval.
Chairperson Wong inquired about the reason for the second stairwell. Mr. Chao stated
that the second stairwell was proposed by the applicant in order to satisfy building
codes.
Tom Sloan, Architect, stated that due to the proposed commercial square footage, the
building code requires a second stairwell to provide a second way of escape in case of a
fire. The two stairwells could not be too far away, as required by building code.
Commissioner Miller asked about the possibility of providing growies/vines along the
north elevation of the commercial building. Mr. Sloan stated that growies/vines cause
building maintenance and fire concerns. Commissioner Miller inquired about planting
them on the second floor. Mr. Sloan stated that there might be some form of
landscaping on the second floor, such as planting pots and growies.

Residential Design Review for a new 4,699 square foot, two-story residence and
an exception for a 41 % ratio of second floor area to first floor area.
Design Review Committee decision final unless appealed.
Staff Presentation: Gary Chao, Assistant Planner, briefly described the project. Staff
recommends approval.
Commissioner Miller inquired about second story setbacks. Mr. Chao explained that
the proposed second story is placed in the middle of the lot and provides smooth
transition to the neighboring single-family homes on both sides.

Chairperson Wong asked if the project had been annexed into the city. Mr. Chao
explained that the property had been approved to be annexed into the city by the city
initiated Monta Yista area annexation plan. There may be an appeal period involved
and the project would have to wait until the appeal period expires before issuance of
building permits.
Robert Mark, 10382 Orange Avenue, expressed complete support of the project. Mr.
Mark did not want any additional trees to be planted along his rear yard.
Mr. Chao stated that he did receive a letter of concern from Mr. Jiang, 10394 Orange
Avenue. Mr. Jiang was concerned about privacy impacts from the second story
windows. Staff has communicated with Mr. Jiang on the phone and he has withdrawn
his concerns after the applicant agreed to plant additional privacy screen trees along the
adjoining property line.
Commissioner Wong asked the applicant if the 35% second floor to ground floor ratio
was too restrictive and what would be a good ratio.
William Hurt, applicant, stated that the main reason for the exception request was to be
able to place 3 bedrooms upstairs. The 35% ratio does not allow for that and would
present an awkward floor plan and living environment.
Steve Simpson, Architect, stated that 45% would be a good percentage. 50% would be
nice since it would allow more flexibility and option on the design.
