Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes nz a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. BACKGROUND On September 4, 2012 City Council approved the Main Street Cupertino mixed use project consisting of 130,500 square feet of retail, a 180-room hotel, a five-level parking garage with two levels of underground parking, 260,000 square feet of office, a 120-unit market-rate live/work rental loft residential development with a 9,146 square foot retail condominium unit and shared parking plan. The subject property, was previously reviewed and approved through the master permits (M-2013-03, and ASA-2012-15) for the use of space, architectural style of the building, landscaping, and parking requirements. The office and commercial components of the project have been constructed. The apartments, hotel, park, major retail, and shop 6 are under construction. On july 28, 2015, Rootstock Wine Bar, which will occupy Pad 3, had been approved for a full service bar with late night hours and entertainment (U-2015-03), and enhancements for the exterior patio at the existing building (ASA-2015-16). The applicant, Jim Foley, representuzg Rootstock Wine Bar, is requesting to modify the proposed outdoor patio seating area on the west. No changes are proposed to the previously approved east side outdoor patio seating area. DISCUSSION The intent of the proposed exterior modification is to enhance the dining experience of the patrons and improve the ambiance of the common area between Pad 3 and Shop 4 along the western side of the building by adding the following: ■ A wood trellis structure approximately 11'5" high and covering an outdoor area of approximately 363 square feet. ■ Heat lamps will be attached to the trellis structure, and ■ Festival lighting on the trellis structure. The proposed modifications continue to meet the intent of providing a pedestrian friendly, outdoor eating experience, and is substantially in conformance with the prior approval. Staff will review and approve the final lighting types prior to final occupancy. This has been added as a condition of approval. ACTION The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: 1. APPROVED EXHIBITS Approval is based on exhibits titled "Tenant Improvement Rootstock Wine Bar" prepared by Tecta Associates, consisting of three (3) sheets labeled A-2.0, A-5.0, and A-5.1, dated January 16, 2016 except as may be amended by the conditions contained in this resolution. 2. PREVIOUS CONDITIONS OF APPROVAL All previous conditions of approval form Resolution No. 12-098 shall remain in effect unless superseded by or in conflict with subsequent conditions of approval, including the conditions contained herein in this resolution. 3. ANNOTATION OF THE CONDITIONS OF APPROVAL The conditions of approval set forth shall be incorporated into and annotated on the building plans. D1P-2016-0"1 1.9389 Stevens Creel< I3oul.evard I'age 3 4. ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and may require additional review. 5. EXTERIOR MATERIAL The final color and material shall closely resemble the details shown on the approved plans and shall be reviewed and approved by the Director of Community Development prior fo issuance of building permits. 6. SCREENING All mechanical and other equipment on the building or on the site shall be screened so they are not visible from public street areas or adjoining developments. Screening materials/colors shall match building features and materials. The height of the screening shall be taller than the height of the mechanical equipment that it is designed to screen. The location of equipment and necessary screening shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. 7. REVIEW OF LIGHTING Prior to final occupancy, plannulg staff will review the proposed lighting to confirm that the lights installed are in conformance with the proposed lighting in the approved plans and the Iighting standards as defined in Municipal Code Chapter 19.124. 8. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible for consulting other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 9. INDEMNIFICATION Except as otherwise prohibited by law, the applicant shall indemnify and hold harmless the City, its City Council, and its officers, employees and agents (collectively, the "indemnified parties") from and against any claun, action, or proceeding brought by a third party against one or more of the indeinili.fied parties or one or more of the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant shall pay such attorneys' fees and costs withu130 days following receipt of invoices from City. Such attorneys' fees and costs shall include amounts paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020,you will be legally barred from later challenging such exactions. This approval of the modification is effective January 29, 2016. The fourteen calendar day appeal period will expire on February 12, 2016.
