The Director reports his decision to the City Council - and Planning Coinmission in time to allow an appeal of the decision within fourteen calendar days. BACKGROU1vD In April 1986, the City Council approved the development of a maximum 240-room hotel within the City Center.mixed use development.The hotel was constructed in 2002 and the property owner, at the time, was permitted one additional ground sign, two additional wall signs, and an increase to the size of walls signs with Sign Exception (EXC-2002-01). The entitlement included approvals for three hotel wall signs, one hotel ground sign, one restaurant wall sign, and one restaurant ground sign for the same parcel where only one wall sign for each business and one ground sign for the parcel was permitted. In May 2002, the restaurant operator applied for a Director's Minor Modification (DIR-2002-15) to allow design modifications to the previously approved restaurant ground sign. In January 2003, as part of the larger Cupertino City Center development, the two hotel wall signs and. the hotel ground sign were included in the Master Sign Program (EXC-2002-12). In 2015, the hotel changed hands leading to a change in the branding and name. The applicant, Michael Dunne, representing the current property owner, Cupertino Hotel Owner LLC, is requesting to modify the previously approved, existing site signage and various internal directional and parking lot signs from"Cypress Hotel" to "Juniper Hotel." In addition,to reflect the restaurant's name and brand change from "Park Place" to "Parkview Kitchen & Spirits", the applicant is requesting a modification to the design of the ground sign and to install a new wall � , sign. The applicant is not proposing an increase to the overall number of signs within the development. DISCUSSION Table 1 below indicates a schedule of the signs proposed at the project site. All illuminated signs are proposed to be below the maximum allowance of 250 foot-lamberts. The applicant proposes to change the copy of two illuminated wall signs (A & B) on the hotel tower, one non-illuminated aluminum lettered wall sign (C) in the courtyard, one illuminated hotel ground sign (D), and one non-illuminated restaurant ground sign (DP). In addition, the applicant proposes a new wall sign for the restaurant's western fa�ade (AP). While the sign copy of the non-illuminated hotel wall sign (C) will be changed from a single row to a double row of text, the sign area of the new sign will be less than that of the existing sign. It will continue to be centered horizontally with the arch of the wall and centered vertically between the base of trim and the top of the arch as previously approved. Subsequent renovations at the restaurant included removal of tlze subject wall and the installation of trellises at the restaurant's outdoor patio areas, effectively rendering relocating a wall sign at the approved location infeasible. At this time, the applicant is proposing to install a wall sign on the entry feature on t11e western elevation. The proposed relocated sign is designed as a circular logo with a sign area significantly below the originally permitted sign area and the allowed maximum area for permanent wall signs in non-residential zones as listed in CMC 19.104.140. APPROVED EXHIBITS Approval is based on e�ibits titled "Juniper Hotel" prepared by Chandler Signs, consisting of twenty (20) sheets labeled 1-20, received on January 11, 2016, except as may be amended by the conditions contained in this resolution. 2. PREVIOUS CONDITIONS OF APPROVAL All prior conditions of approval through past approvals shall remain in effect unless superseded by or in conflict with subsequent conditions of approval and as specifically amended by this Director's Minor Modification approval. ACCURACY OF THE PROJECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may ulvalidate this approval and may require additional review. 5. LANDSCAPE AREA All ground signs shall be located within a landscaped area proportionate to the size of the sign. Additional landscape appropriate to the site shall be placed at the base of the sign. 6. EXTERIOR MATERIAL The final color and material shall closely resemble the details shown on the approved plans and shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. 7. SIGN INSTALLATION All wall signs, excepting the two wall signs on the hotel tower, shall not be installed on sign raceways and shall be directly mounted to the wall surface. S. LIGHTING INTENSIT'Y The intensity of the illuminated signs shall not exceed 250 foot-lamberts.After the installation of alI signage, if the light intensity levels associated with signage are deemed to be too intense by the Director of Community Development, the applicant shall lower the intensity of the Iight to an acceptable level. In addition, the applicant shall provide an installation report from a photometric professional certifying that the intensity of the signs is less than 250 foot-lamberts. 9. HOURS OF ILLUMINATION All illuminated signs shall be equipped with a timer which would automatically ensure that the signs are turned off at or by 11:00 p.m. or within two hours after fl1e business is closed, whichever is the later time. A letter from the business operator shall be provided prior to final , building permit approval acknowledging this condition of approval and incorporated in the builduzg permit plans. 10. SIGN PERMITS REQUIRED The applicant shall consult with the City's Building Division to obtain the necessary sign permits for this project. 11. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible for consulting other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. DIR-201.5-22 10050 S De Anza�3(vd. Page 5 12. INDEMNIFICATION Except as otherwise prohibited by law, the applicant shall indemnify and hold harinless the ` City, its City Council, and its officers, employees and agents (collectively, the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against one or more of the indemnified parties or one or more of the indeinnified parties and the applicant to attack, set aside, or void_this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant shall pay such attorneys' fees and costs within 30 days following receipt of invoices from City. Such attorneys' fees and costs shall include amounts paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. 13. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Goven-�ment Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This Director's approval is effective January 14, 2016. The fourteen calendar day appeal period will expire on January 28, 2016.
